The United Nations Security council,


Emphasizes, the importance of maintaining international maritime peace and order,
Affirms, the importance of free and fair trade in the South east Asian region,
Believing, in the ideals of freedom, democracy and economic development for all,
Alarmed by, the growing complications and military skirmishes happening in South China Sea,
Fully aware, of the dangers posed to international peace and order by the dispute of nations concerning
the South China sea,
Recognizing, the means of diplomacy and peaceful negotiations as the best plausible way to come to
solutions of problems pertaining to maritime territorial disputes between states,
Noting, the various implications of international trade blockades, sanctions, and unofficial trade wars,
Fully understanding, and making note of all the viewpoints of all member states of the security council,
Considering, “An Arbitration before an arbitral tribunal constituted under Annex VII to the 1982 United
Nations Convention on Law(UNCLOS) of the Sea between the Republic of the Philippines and the
People's Republic of China” as conducted by “An arbitral tribunal constituted under Annex VII to the
1982 United Nations Convention on Law of the Sea” whose verdict was announced on 12th July, 2016,
Cognizant, “The declaration of conduct of parties in the South China Sea” as agreed upon by ASEAN
and the People’s Republic of China,
Upholding the values enshrined within the charter of the United Nations,
1. Declares, that the Chinese claims of the nine dash line are invalid;
2. Decides, the creation of UNSC sub-committee known as “United Nations South China Sea Maritime
Watch” (UNSCSMW) whose main focus would be to ensure peace and stability in the region The
body would work as follows,

a. Constituent members & working,


i. All UNSC permanent member states along with Taiwan, The Republic of Philippines,
The Socialist Republic of Vietnam, The Republic of Indonesia, The Federation of
Malaya, The State of Brunei Darussalam, & The Republic of Singapore would form
this subcommittee,
ii. The subcommittee would meet once every two years, the dates of which are to be
decided by the Security Council The committee can also be called to meet as per the
discretion of the Security council,
iii. The Headquarters of this subcommittee would be located in The Republic of
Singapore,
iv. This subcommittee would be headed by an executive board shared by three roles,
I. President – Elected once every time, just before the subcommittee meets by
the member states of the security council within themselves, The president
cannot be a member of the subcommittee,
II. Vice President – Nominated by the President and may be a member of the
subcommittee,
III. Director – Deputy Director of the United Nations Security Council,

v. It must also be noted that the permanent member states would not give up their veto
rights while participating in this subcommittee,

b. Functions and Responsibilities,


i. To maintain maritime security in the South China sea,
ii. To report directly to the Security Council any and all updates in the region,
iii. To diplomatically address any and all maritime territorial disputes in the region,
iv. To promote friendly relations amongst nations to ensure free and fair trade to all in
the region,
v. To set up a system of extraction of natural resources in the region and an equitable
distribution of all,
vi. To protect the right of innocent passage of all vessels passing through the region,
vii. To prevent the construction of artificial islands in the region,
viii. To prevent military skirmishes and illegal settlements in the region,
ix. To combat piracy and crimes committed by non-state actors in the region by directing
the “South China Sea Special Squad” (SCSSS),
x. To produce accurate, unbiased reports of all the developments in the region and
submit it to the UNSC after every meeting,
xi. To host multilateral and bilateral talks between all the member states’ leaders to
promote peace, harmony and mutual understanding,

c. With respect to natural resource extraction,


i. Any and all natural resources lying in the region outside the specified Exclusive
Economic Zone (EEZ) as defined by UNCLOS, will be equally shared amongst all
claimants,
ii. Any and all natural resources lying in the region inside the EEZ’s of the claimant
countries’, will be shared on the following grounds,
I. 100% of all natural resources extracted would be awarded to the country
whose EEZ the resources are being extracted from,
II. All natural resources extracted from overlapping regions would be stored in a
separate “emergency reserve” which could be accessed by claimants in the
case of a crisis in the claimants’ nations,
III. However, such a right can be exercised only upon reasonable justification and
acceptance of it through voting, where vetoes would not be applicable,

iii. Any and all natural resources, that lies beyond the claimed “Nine dash-line” but under
the EEZs of the claimant countries’, would be awarded 100% to the respective
countries’ whose EEZ is being referred to,
iv. In order to ensure free, fair and transparent extraction of all natural resources in the
manner as mentioned above, the UNSCSMW would overlook the process;

3. Requests, the Member States of the UNSC except the claimants of the South China sea, (Republic of
China, (Taiwan), The Republic of Philippines, The Socialist Republic of Vietnam, The Republic of
Indonesia, The Federation of Malaya, The State of Brunei Darussalam, People’s Republic of China)
to contribute to the formation of a new UNSC military squad known as “South China Sea Special
Squad” (SCSSS) which will be permanently stationed in the Spratly & Paracel Islands, The
constitution and working of this squad is as follows,
a. The Squad will constitute of a fraction of the standing military of the voluntary members of
the countries who wish to contribute,
b. The Squad will be directly answerable to the UNSCSMW which in turn is answerable to the
UNSC and in the case of any unforeseen situations arising due to the actions of a particular
country which has participated in the squad, that particular country’s delegation is answerable
to the UNSC and UNSCSMW,
c. The main function of such a squad will be to defend the annexation and occupation of Spratly
and Paracel islands,
d. The squad shall work faithfully and dutifully towards the maintenance of peace and stability
in the region,
e. To conduct bi-annual FONOPS missions and report back to UNSCSMW and subsequently
the UNSC any and all updates in the region,
f. The SCSSS shall also ensure and enforce the right to innocent passage in the region as
directed by the UNSCSMW and in special circumstances, the UNSC;

4. Calls for the removal of the 3 months moratorium imposed by the Chinese government, to 3 weeks
of moratorium for the revival of the marine life for sustainable fishery and management:
a. As it takes a fortnight for the revival of the marine life ,
b. And one week for the increase in marine population for sustainable fishery in those regions;

5. Declares that PRC shall not build, terraform or develop maritime features in the EEZ, as defined by
the UNCLOS, of the claimants of the south China sea:
a. Step by step dismantling of the artificial maritime features with respect to the international
laws regarding marine ecology;

6. Instructs the Chinese military forces to be withdrawn from the Shoalborough shoal:
a. the 5 nautical miles from the 12 nautical miles around the Shoalborough shoal to be declared
a peaceful region:
i. No military vessels are supposed to enter the peaceful region,
ii. Chinese military shall be given 1 month from the date of passing of this resolution to
remove their military settlements on the above-mentioned region;
7. Decides on the prohibition of the further creation of military bases on:
a. Disputed islands in the South China sea,
b. Terraformed islands in the South China sea,
c. Or any South China sea area outside territorial waters(as accepted by United Nations);

8. Takes note of the invalidity of the historic claims of the Chinese government over the South China
sea:
a. The historic claims even if registered under the United Nations obligation of article 102 of
the un charter gains no precedence as it comes in conflict with UNCLOS which gains power
and authority from the UN Charter,
b. Article 103 of the UN charter makes clear that in the event of a conflict of past treaties or
agreements and the obligations of the members of the United Nations, UN charter shall
prevail.
