Please institute necessary mitigating measures to address all negative environmental impacts that may occur during the implementation and operation of your project. Please be advised to inform this Office of any plan for expansion of modification for further assessment or evaluation of the same Non-compliance with any ECC condition shall be a sufficient cause for the imposition of a fine in an amount not to exceed Fifty Thousand Pesos (P30,000.00) pursuant to the provision of PD 1586 otherwise known as the Philippine Environmental Impact Statement (EIS) System and its Implementing Rules and Regulations (IRR). ERNESTO LUZANO located at Sitio Abulao, Brgy. Magallanes, Tayug, Pangasinan, pursuant to the application received by this Office on December 16, 2015. | 1, MA. VICTORIA V. ABRERA, Regional Director, EMB - Region 1, by virtue of the powers vested in me by law, do hereby order. Section 1. Amendment. | Section 1.2: Project Description should now read as follows: | PROJECT DESCRIPTION This Certificate covers the construction and operation of a 3.75 metric tons per hour Multi-Pass Ricemill run by AC Motors Consisting of warehouse, stockpile area of sacks/palay, mill building, office building, 1 unit palay bin, 1 unit palay sifter, 3 units rubber hullers, 1 unit hulls. ‘sifter, 1 unit blower box, 1 unit hulled palay sifter, 1 unit paddy separator, 1 unit destoner, 3 units vertical rice polishers, 2 units rice sifters, 3 units mist polishers, 1 unit rice sorter, 1 unit rice bin, 2 units rice graders, 4 units cyclone product collectors, 2 units cyclone dust collectors, 1 unit rice husk bin, 2 units rice husk mills, 1 unit cyclone dust collector, 1 unit dust bags and other support facilities; all confined within an area of 3,830 5. meters. | Section 1.3: BCC Conditions should now read as follows: pe 1 | CONDITIONS |ENVIRONMENTAL MANAGEMENT ‘The proponent shall strictly implement the following mitigating, enhancement, and rehabilitating measures: 1. Secure all necessary permits and/or clearances from concerned government offices that have administrative jurisdiction over such projects/operations, i.e. DENR, EMB, LGU, etc., prior to implementation of each phase of the project; 2. Adequate and appropriate drainage system and soil control measures including other structural measures which will conform with natural topography shall be constructed /provided to avoid erosion and flooding of the adjoining properties; 3. Regular sanitary housekeeping practices, proper collection of solid and hazardous waste resulting from the implementation/operation of the project shall be strictly observed. The waste management plan shall include adequate facilities for disposal of wastes which shall be done from the start of pat pale 4. In case of vegetation loss due to construction activities such as clearing and | excavation works, the project proponent shall plant appropriate tree species and/or other forms of vegetation to compensate for the damaged vegetation; S| Cutting of trees shall be covered by a valid permit from the DENR pursuant to | the provisions of PD 705 and PD 953; GENERAL CONDITIONS 6, Conduct an effective Information, Education and Communication (IEC) Program | to inform and educate all stakeholders, especially its contractors, workers, and | local residents about the mitigating measures embodied in its IEEC, the conditions stipulated in this Certificate and the environmental and human | safety features of the project for greater awareness, understanding and | Sustained acceptance of the project. The program shall be submitted to EMB Regional Office on an annual basis; 7. The proponent shall designate an Environmental Officer or a Pollution Control | Officer pursuant to DAO 2014-02 who shall handle the environmental aspects of the project; 8.| That a Compliance Monitoring Report (Annex 3-1 of RPM) shall be prepared jand jsubmitted by the Proponent/PCO to this Office semi-annually; the submission of which shall be done not later done every fifteenth day after each semester (January 15 and/or July 15) starting from the issuance of this | certificate; 9. |The plant operations shall conform with the provisions of RA 6969 (Toxic Substances and Hazardous and Nuclear Wastes Control Act of 1990), RA 8749 \(Philippine Clean Air Act of 1999), RA 9003 (Ecological Solid Waste [Management Act of 2000), and RA 9275 (Philippine Clean Water Act of 2004) jens other relevant policies, rules and regulations; Pe | I.| RESTRICTIONS 10. No activities shall be undertaken other than what were stipulated in the IEEC. Should there be any expansion of the project beyond the project description or any change in the activity or transfer of location shall be subject to a new Envirénmental Impact Assessment; and 11. tn case of transfer of ownership of this Project, these same conditions and festrictions shall apply and the transferee shall be required to notify the EMB Central Office within fifteen (15) days from the transfer of ownership to allow fie necessary changes brought about by such transfer. Section 2. Applicability. | All provisions in this Amendment shall now prevail over the previous conditionalities cited in ECC-R1-0803-046-3118 issued last March 28, 2008. Section 3. Effectivity.
