LEAVE AND LICENSE AGREEMENT

This agreement of leave and license is made & executed at Pune on this 1 st day
of January in the Christian year Two Thousand & Twenty Two.

unless repugnant to the context or meaning thereof, shall mean and include his
executors, administrators and assigns) of the FIRST PART.

..… Hereinafter referred to as the Licensee alone of the SECOND PART.

WHEREAS
A) The licensor is the institute/College and absolute owner of the property
described in the schedule I, written hereunder (hereinafter referred to as the
said premises);
B) And the licensor college wishes/required to give the said premises on rent
for a running a college canteen;
C) And the licensee requested the licensor to grant to the licensee the license
for the period of 36 months for college canteen purpose in respect of the said
premises.
NOW THEREFORE THIS INDENTURE WITNESSETH AND IT IS HEREBY
AGREED BY AND BETWEEN THE PARTIES as under:
1. The licensor agreed to grant the license to the licensee for college canteen
use of the said premises for the period of 36 months, commencing from 1 st
January 2022 to 31st December 2024, on the terms and conditions
mentioned hereunder.
2. The licensee shall pay to the licensor the license fee of Rs. 8,000/-(Rupees
eight Thousand only) per month on or before 5 th day of each month in
respect of the said premises.

3. On expiry of the period of the said Leave and License agreement, if it is so
desired, the said agreement can be renewed subject to mutual consent of
both the parties; otherwise the licensee shall hand over possession without
any excuses.
4. The licensee agrees with the licensor as follows:
i) To use the said premises temporarily for the purpose of college canteen
use of the licensee and for no other purpose.
ii) To pay the license fee on or before 5th day of each month.
iii) To surrender the vacant possession of the said premises in the event of
early determination/expiry of the period of 36 months.
iv) To use the premises as a reasonable and prudent man and would
observe rules of the College.
v) Not to sub-lease the said premises or any part thereof.
vi) Electricity charges shall be paid by the licensor and; maintenance
charges and other taxes / dues are not to be borne separately by the
licensee during the period of the agreement.
vii) Shop Act and Food license is mandatory for the licensee.
viii) Licensee shall keep the canteen premises clean and clear.
ix) Licensee shall keep the wet and dry garbage separate
x) Licensee canteen staff should be fully vaccinated and have fitness
certificate of staff.
xi) Licensee shall every year prepare menu card and rate after consulting
with the licensor as per college regulation.
xii) Licensee shall provide water after filter or purify for dirking water in
canteen.
xiii) Licensee shall install fire safety equipment in canteen.
xiv) Licensee shall do sanitization in canteen every week without
fail.
5. Notwithstanding anything contained in this agreement/elsewhere, it is
agreed and expressly declared by and between the parties that there is no
intention to create in favour of the licensee any lease tenancy or any interest
of whatsoever nature in the said premises. There is no intention of creating
any relationship of landlord and tenant or any relation except that of
licensor and licensee.
6. The agreement is renewable at option of both the parties after 36 months
and license fee will be decided at the time of every renewal in future.
7. Either party to this agreement may terminate or rescind the agreement
without assigning any reason, by giving to other party One months’ notice.
8. Damages:
At the time of handing back possession by termination/early determination,
if it is found that some damages are caused to the said premises, the
licensor shall be entitled to recover damages/compensation for the same.

9. Fixtures & Furniture Maintenance:
a) Licensor shall maintain the said premises through
painting and repairs at his own cost.
b) Licensee may put up his furniture & fixtures and shall
remove it at the time of surrendering the possession.
10. The license is not transferable and is personal and for temporary period.

SCHEDULE - I
All that piece and parcel of the flat premises, situated at,
Pradhikaran campus, behind Tukaram Garden, Sector 27A, Pradhikaran, Pune,
Maharashtra 411044, admeasuring about 1500 sq.ft., located in the IICMR
College Building.
IN WITNESS WHEREOF THE PARTIES HAVE SIGNED AND EXECUED THIS
AGREEMENT ON THE DATE HEREINABOVE MENTIONED.
