LEASE AND LICENSEE AGREEMENT

THIS LEASE AND LICENSE AGREEMENT made on


22th day of September , 2022 , between , Jai Shankar Jha by
faith Hindu , by occupation Business , Residing at Samastipur
Bihar hereinafter referred to as the Licensor/Landlord of the
First Part.

AND

BRAJESH KUMAR JHA S/O RAJESH KUMAR JHA ,45, R.S.TANK,


NEAR OLD LABER OFFICE BALBAHADARPUR , DARBHANGA 846
001 by faith HINDU ,BY Occupation Service in M/s Madhus Garage
Equipment Pvt Ltd No 46/2 Doddakallasandra Konnankunte Cross
Kanakpura Road , Bangalore – 560 062 hereinafter referred to as
the Licensee/Tenant of the Second Part.
WHEREAS the First party / Licensor is the absolute
owner of the Flat on 3RD Floor East - North consisting of 2
Room, Dining , 1 Kitchen, 2 toilet with Modular Kitchen ,

3 lights, 3 Fans, 2 Air conditions, Inter com Phone , situated


at Premises No.177 / 5 /1 , Picnic Garden Road,Kolkata- 700039
and the licensor herein is searching for an eligible person to give the
said furnished room which is particularly mentioned in the
schedule hereunder written on leave and license basis in such terms
and conditions , which are mentioned herein below .

AND WHEREAS the Licensee herein approached the Licensor


herein to take the schedule property on license basis and satisfied
with the terms and conditions contained herein below .

NOW THE LICENSEE AGREEMENT WITNESSTH AS FOLLOWS :-


THAT the Licensor shall take on monthly license as License basis all
that the Furnished Flat on 3 RD Floor East - North consisting of 2
Room, Dining , 1 Kitchen, 2 toilet with Modular Kitchen ,

3 lights, 3 Fans, 2 Air conditions, Inter com Phone , situated


at Premises No.177 / 5 /1 , Picnic Garden Road,Kolkata- 700039
at that this agreement will commence from and /or with the effect
from 22 nd day of September 2022 which will expire as on 21st
August 2022 ( 11 Months Only ).
i) That Licensee shall pay including Maintenance Licensee Fee of Rs
18000 ( Rupees Eighteen Thousand only ) will pay accordingly to 1st
– 15th English calendar month of every month positively 1 month
Current Rent .

ii) That the License paid Rs 36000/- ( Rupees Thirty Six Thousand
only ) As security deposit will return back without interest at the
end of the Agreement .

iii ) That this agreement shall run from 18TH day of July 2022 which
will expire as on 17th June 2022.

iv) That the Licensee will use the said schedule property for
residential Purpose only .

v) That it is further agreed , declared and covenanted by and


between the Parties that the schedule property will be used
and occupied by the Licensee on the following terms and
conditions besides as agreed hereinabove :-

a) Damage of wall, Paint, Tap water etc.including if any damage of


Room /lights/fixtures , at the time vacating Licensee has to pay
the repairing charges or repair the same.

b) That the save and except as aforesaid, the License shall otherwise
maintain and preserve the said schedule property in good
condition or order, protect the same against moth and white ants.

c) That the Licensee shall use the property for residential cum office
purpose only and that the Licensee should not carry on Godown in
the Schedule Property or use the same for illegal and unlawful
purpose or will not make the same any Office of any political party
/NGO nor carry out any connected activities .

d) That the Licensee will keep the schedule property in good


Condition including the said flat room without any damages.

e) That the Licensee shall neither hold nor cause, allow to hold held
any public Performance meeting or public function in the
schedule property.

f) That the Licensee shall not create or cause to be created any


nuisance or annoyance in the schedule property or building
premises causing disturbance to other residents .

g) That the Licensee shall not make any material alteration to


the schedule property unless approved and sanctioned by the
Licensor in writing and in any event such alteration, if permitted,
shall be made by the Licensee at his own cost , expenses and / or
on such terms and additions shall in all cases if it becomes
permanent fixture of the schedule property then the Licensee shall
not be entitled to cause any removal/return/destruction or in any
condition to seek any compensation on that account.

h) That the Licensee shall not transfer/let out/lease the schedule


property /licensed portion whole or any portion thereof to any person
or persons.
i) That if the Licensee causes any damage to the schedule
property in that event mason will be appointed to asses the quantum
damages and accordingly equal amount will be paid by the Licensee
to the Licensor.

j) That the Licensee shall not leave the licensed portion under
lock and key in any condition for any long period beyond 7 days
without the consent of the Licensor.

k) That day to day repairs , leakages of water taps etc.shall have to


be done by the Licensee at their own cost but major repairs
such as leakages/fault in Electricity or bursting in pipes to be
done by the Licensor at their own cost.

l) That the Licensee has inspected the schedule property and is


fully satisfied about its condition and internal arrangement and has
thereafter freely and voluntarily agreed to the terms of this
agreement and shall not hereafter make any grievance on
any account whatsoever.

m) That the Licensee cannot lock for more than 7 days any flat room
or the schedule property and if the Licensee violates the same then
licensor shall have right to take over the possession of the flat room
by breaking open the lock without consent of the licensee and
whatever good and materials belonging to the licensee exist same
shall be removed/thrown out without the licensor being liable for the
same in any manner whatsoever and for the same licensee cannot
make any objection before any person or authority.
n) That if the Licensee wishes to vacate the Licensed portion before
the licensed period mentioned herein above he will be liable to give
15 days prior notice to the Licensor and similarly Licensor shall
also be liable to give 15 days prior notice to the Licensee if he needs
the Licensed portion before the Licensed period as mentioned above

. In any event the period of license expires on from 22 nd day of


September 2022 which will expire as on 21st August 2022 ( 11
Months Only ).on or before upon which the Licensee has to vacate
the schedule premises with all her belongings and shall not be
allowed to stay or keep any belongings for any period beyond 21st
August 2022.

o) That accommodation permits only Brjaesh Kumar Jha ,not


over that and only as 1 person/ member will stay in the licensed
flat room.

p) That any female member (s) are not allowed


to enter/access/stay in the said flat.

q) The Licensee has to pay for electricity charges separately(CESC).

r) That if the flat room is damaged then the Licensee will carry
out the repair at her own cost else have to pay for the said damage
charges to the Licensor.

s)That if the Licensee fail to pay the Licensee fees of 1 months


then Licensee will have to vacate the said schedule property
immediately .
t) That if the Licensee carries out any illegal work or Licensor receives
any complaint from any quarter whether verbal or written about
carrying out of any illegal/immoral activities by the Licensee within
the schedule property or the building , then the Licensee shall have
to vacate the schedule property immediately without any
notice/hearing .

u) That the Licensee has not been granted any parking space in
the said building .

v) That any breach of this agreement by the Licensee including


any attempt to overstay beyond period of license expiring on 17 th
June 2022 will render the Licensee liable to pay penalty of
Rs10000.00 per day to the Licensor calculated upto the date of
vacation and handing over peaceful & quiet possession of the
schedule property to the Licensor.

.IN WITNESS WHEREOF the parties hereinto have set and


subscribed their hands and Seal on the day month and year
mentioned hereinabove.
SCHEDULE PROPERTY

Furnished Flat on 1stFloor East - North consisting of 2 Room, Dining


, 1 Kitchen, 2 toilet with Modular Kitchen , 2 Bed , 2 Sofa , 1
Dining Table with chairs , 1 Refrigerator, 3 lights, 3 Fans, 2 Air
conditions, Inter com Phone , situated at Premises No.177 / 5
/1 , Picnic Garden Road,Kolkata- 700039
