KONTRA-SALAYSAY
Ako, MICHAEL R. SARINAS, nasa hustong gulang at
naninirahan sa may 385 Medicion II-E, Imus, Cavite, matapos
makapanumpa sa ilalim sa batas ay malaya at kusang loob na
nagpapahayag ng mga sumusunod:

1. Ako ang akusado sa kasong Attempted Homicide na


kasalukuyang dinidinig sa kagalang-galang na hukumang
ito;

2. Na ang tunay na nangyari ay ang sumusunod:

3. Na noong Hunyo 07, 2022, ako po ay nakikipag inuman


kasama sila Jermie Guina (aking pinsan), Fernando
Almazan, bayaw ni Jermie, at Arthur Guerero. Maayos at
masaya kami nag iinuman hangang umabot sa mga biruan

na mag lalabas daw si Fernando ng Php 50,000.00 at
susunugin niya ito sa harapan namin;
4. Inutusan niya si Jermie na kunin ang kanyang bag sa
kanilang bahay, subalit hindi ito naidala ni Jermie. Kami ay
nag tawanan at siya ay patuloy naming biniro na wala
naman atang pera;

5. Sa kadahilanan na ito, si Fernando na mismo ang tumayo at


pumunta sa kanilang bahay upang kuhanin niya ng personal
ang bag na naglalaman daw ng Php 50,000.00. Kami ay
naiwan na nag iinuman habang hinihintay si Fernando
bumalik;

6. Nang makabalik si Fernando, siya ay walang dalang bag o


pera na kanyang sinasabi na susunugin kaya lalo siya
napahiya noong gabing iyon. Hindi ko napansin na siya ay
galit na noong mga oras na iyon, kaya akin pa siyang biniro
biro, kung saan ako ay kanyang tinulak, sinuntok sa ulo at
matapos akong bumagsak, ako ay tinadyakan ;

7. Ako ay bumagsak sa sahig, habang siya ay inaawat ng


aming mga kainuman. Habang siya ay inaawat ng aming
mga kainumman, minarapat ko ng umuwi upang
magpalipas ng oras;

8. Makalipas ang ilang minuto, aking natanaw sila Fernando


Almazan at iba pa niyang mga kasama na nakatingin sakin
at nag tatawanan. Lumapit ako upang makipag ayos dahil

napag isipan ko na maaaring sumobra ang aking
pangangantiyaw sa kanya nung inuman. Subalit pag lapit
ko sa kanila, bigla nalang ako hinawakan ni Jerry Guina,
ang aking tiyuhin;

9. Ako ay nag pupumiglas sa dahil nakita ko palapit na si


Fernando sa akin. Habang ako ay nag pupumiglas,
nakatamo ako ng ilang pasa sa likod dahil sa suntok o
hambalos sakin, at ako ay tuluyan na napagtutulungan nila
Fernando.

10. Sa kabutihang palad, lumabas sa kanyang bahay si


Mervin Ibañez at ako ay kanyang tinulungan makawala sa
pagkakahawak ni Jerry Guina at bigla nalang ako ni hinila
papalayo ni Mervin Ibañez dahil sa tensyon na nangyayari;

11. Under Article 6 and 249 of the Revised Penal Code:

“Article 6. Consummated, frustrated, and


attempted felonies. - Consummated felonies as well as
those which are frustrated and attempted, are
punishable.

A felony is consummated when all the


elements necessary for its execution and
accomplishment are present; and it is frustrated when
the offender performs all the acts of execution which
would produce the felony as a consequence but which,

nevertheless, do not produce it by reason of causes
independent of the will of the perpetrator.

There is an attempt when the offender


commences the commission of a felony directly or
over acts, and does not perform all the acts of
execution which should produce the felony by reason
of some cause or accident other than this own
spontaneous desistance.” (Emphasis Supplied)

“Article 249. Homicide. - Any person who,


not falling within the provisions of Article 246, shall
kill another without the attendance of any of the
circumstances enumerated in the next preceding
article, shall be deemed guilty of homicide and be
punished by reclusion temporal”

In the case at bar, intent to kill must be proved


with certainty to establish the alleged crime. In a
consummated crime of Homicide, intent to kill is
inherent or considered as a General Criminal Intent,
while in attempted or frustrated stage, intent to kill
becomes a Special Criminal Intent which must be
proved with certainty.

It is clear from the complaint-affidavit that the


complainant only suffered injuries by reason that he
attempted to prevent the respondent in approaching

Fernando. Further, there is no showing that the
respondent has intent kill any of the persons present
during the incident, he was merely trying to
apologize or clear the misunderstanding that
happened that night contrary to the allegation of
Fernando that the respondent uttered words that
respondent intended to kill him. Furthermore, the
allege weapon that was used, was never presented
nor even a picture of it was attached;

12. In the case of Jun Mupas and Gil Mupas vs People of


the Philippines, G.R. No. 172834, February 06, 2008,
states that:

“Assuming that Gil alias Banjo had any


participation, there is likewise no evidence that he or
Jun had intent to kill Rogelio. Intent to kill is the
principal element of homicide or murder, in whatever
stage of commission. Such intent must be proved in a
clear and evident manner to exclude every possible
doubt as to the homicidal intent of the aggressor.”

13. In Palaganas vs People of the Philippines, 533 Phil.


169, 193 (2006):

“The Court held that attempted murder or


attempted homicide is committed when the accused
intended to kill the victim, as manifested by the use of

a deadly weapon in the assault, and the wound/s
sustained by the victim was/were not fatal.”
(Emphasis Supplied)

14. Moreover, they are claiming that there was a profuse


bleeding on the part of the complainant, which is doubtful.
Even assuming that there was really a profuse bleeding, a
natural response to such, is to bring the complainant to the
nearest hospital that is within the vicinity of the place of
incident and not to a hospital that is farther. The
complainant was brought to the Las Piñas General
Hospital, despite knowing the fact that the allege injuries
suffered by the complainant requires immediate medical
attention;

15. Even the medical certificate that was presented is


doubtful, it states that the complainant was treated only on
June 08, 2022 or one (1) day after the allege incident
contrary to the affidavit of the witness that states they
immediately brought the complainant to the hospital.
Further, what they have presented was merely a medical
certificate issued by a general surgeon, and not a medico-
legal report made by a medico-legal officer;

16. Furthermore, despite claiming that there was a profuse


bleeding on the part of the complainant, findings of the

general surgeon merely states that the patient needs
medical attention for a period of Two (2) days;

17. While the medical certificate states that the


complainant suffered injuries secondary to assault, it
creates doubt as whether or not it is the respondent who
was really responsible of the said injury, considering that it
was made a day after the incident, and in addition there was
no time stated in the certificate nor in the affidavits of the
complainant and his witness, as to when was the
complainant was treated. Assuming that the complainant
will give the time they began their drinking spree and the
time he was treated, this is merely an attempt to cure the
defect or doubt ,so as to match the incident;

18. It is an elementary rule that mere allegations not


supported with evidence is not sufficient to hold a
conviction:

“The basic rule is that mere allegation is not


evidence and is not equivalent to proof. Charges
based on mere suspicion and speculation likewise
cannot be given credence. When the complainant
relies on mere conjectures and suppositions, and fails
to substantiate his allegations, the complaint must be
dismissed for lack of merit. (Agdeppa v. Office of the

Ombudsman, supra note 56, at 333 citing De Jesus v.
Guerrero III, 614 Phil. 520, 529.)”

19. Wala pong katotohanan ang binibintang sa akin,


inuman lang ang aking pinunta noong gabing iyon, wala
ako intentsyon na manakit.;

20. Malaking pagkakamali ko po na patuloy kong inasar si


Fernando noong gabing iyon dahil sa mali kong akala na
kami ay patuloy parin nagbibiruan;

21. Na ang lahat ng ito po na ginawang pagbibintang ng


biktima ay nakapagdulot sa akin at sa aking pamilya ng
matinding abala at danyos.

Na aking inilagda ang aking pangalan sa kasulatang ito


ngayong ika-__ ng September 2022, dito sa Lungsod ng Imus,
Lalawigan ng Cavite.
