IRREVOCABLE SPECIAL POWER OF ATTORNEY

KNOW ALL MEN BY THESE PRESENTS:

That WE, SPOUSES EDGARDO AND ELSA DE TORRES, Filipinos, of


legal age and are residents of ______________ Taysan, Batangas, after
having been sworn to in accordance with law, do hereby depose and say
that:

1. We are the borrowers in a housing loan with Bangko Kabayan Inc.


under Account No. 04102/50/005132/65 which is secured by a THREE
STOREY RESIDENTIAL BUILDING located at
___________________, registered under the name of Spouses Oscar
and Lolita Mendoza, covered by Transfer Certificate of Title No.
__________ ;

2. In connection thereto, we also secured an insurance policy with


Malayan Insurance on 13 July 2021 and a Fire Insurance Policy was
issued in our favor on 14 July 2021. A copy of the Fire Insurance
Policy is attached hereto as Annex “A”;

3. Said building was destroyed due to fire which occurred on or about


10:39 in the morning on 8 September 2021. A copy of the Fire Incident
Certification and Police Blotter Extract is attached hereto as Annexes
“B” and “C”, respectively.

In line with the foregoing facts, we do hereby IRREVOCABLY NAME,


CONSTITUTE AND APPOINT OSCAR MENDOZA and/or LOLITA
MENDOZA, Filipinos, of legal age, married and are residents of
________________, to be our true and lawful Attorneys-in-Fact, for us and
in our name, place and stead to do and perform all or any of the following,
to wit:

1. To represent us in any and all negotiations pertaining to the release


of the insurance proceeds from the Fire Insurance Policy attached
herein with Malayan Insurance, and to pay for and in our behalf the
fees required therefor, as well as to sign and receive any and all
documents and papers related thereto;
2. To receive the proceeds of the aforementioned insurance policy for
and in our behalf, which shall be used exclusively for the payment of
the loan we secured from Bangko Kabayan Inc.

3. To pay the remaining balance of the housing loan after applying the
proceeds of the said insurance.

4. To represent us in any and all negotiations pertaining to the loan we


secured from Bangko Kabayan Inc;

5. To represent us for and in our behalf in the execution, payment of


fees required and to sign and receive any and all documents and
papers related to the said loan;

6. To cancel the mortgage for and in our behalf and receive the Title
after full payment of the loan amount with Bangko Kabayan Inc.;

GIVING AND GRANTING unto said ATTORNEYS-IN-FACT full


power and authority to do and perform all and every act and deed
whatsoever requisite and necessary to be done in and about the
premises, as fully as to all intents and purposes as we may could
lawfully do if personally present and hereby RATIFYING and
CONFIRMING all that our ATTORNEYS-IN-FACT can lawfully do or
cause to be done by virtue thereof.
