NOTICE OF ADVERSE CLAIM

I, MELINDE D. TOKUMASU, of legal age, Filipino, and a

resident of Purok Malipayun, Barangay 35, Bacolod City,
Negros Occidental, as represented by my Attorney-In-Fact,
CARMEN JEAN DELA PEÑA1, of legal age, Filipino and a
resident of Purok Malipayun, Barangay 35, Bacolod City,
Negros Occidental, after having been duly sworn to in
accordance with the law, do hereby depose and state that:

1. On June 26, 2020, I purchased a parcel of land with

improvements for and in consideration of the amount
of TWO MILLION THREE HUNDRED NINETY FIVE THOUSAND
PESOS (Php2,395,000.00) covered by TCT No. 341480
owned and registered in the name of MULTI- J REALTY
AND DEVELOPMENT CORPORATION, and particularly
described as follows;

“A parcel of land (Lot 4, Blk 11, Psd-

06- 005131, being a cons. subd of Lots 1088-
B-2-C & 1088-B-2-E, Psd-06-069132,
situated in Barangay Estafania, City of
Bacolod, Island of Negros. Bounded on the
NE., along line 1-2 by Lot 3: on the SE along
line 2-3 by Lot 6, both of Block 11; on the
SW, along line 3-4 by Road Lot 13; and on the
NW along line 4-1 by Lot 2, Block 11, all of
the cons.- subd. Plan. Beginning at a point
marked “1” on the plan, x x x x x
containing an area of ONE HUNDRED (100)
SQUARE METERS, more or less.”

Attached as Annex “B” is a photocopy of the said

title

2. That on July 24, 2020, I paid MULTI- J REALTY

DEVELOPMENT CORPORATION the sum of THIRTY THOUSAND
(Php 30,000.00) PESOS as down payment thereof. A copy
of the Official Receipt issued by Multi-J Realty and
Development Corporation is hereto attached as Annex
“C”;

Attached as Annex “A” the Special Power of Attorney granting CARMEN JEAN DELA PEÑA
authority to represent MELINDE D. TOKUMASU in this instance.
 3. Subsequent additional down payments were also made on
the following dates with the respective amounts, to
wit:

Attached as Annexes “D”, “E”, “F”, and “G” are copies

of the Acknowledgment Receipt issued by Multi-J Realty and
Development Corporation as proof of payment thereof;

4. That despite payment of the down-payments thereof,

Multi-J Realty & Development is currently selling and
vending the said property online, to my damage and
prejudice. Attached herewith as Annex “H” is a copy
of the screenshot as proof that the developer is
selling the said parcel of land;

5. I am therefore registering an annotation this Adverse

Claim in order to protect and defend my right as the
first buyer of the above-stated property herein, and
to provide sufficient notice to all third persons
that the said property was sold to the undersigned
herein.
