MOTION TO CANCEL AND TRANSFER

COMES NOW the Private Complainant, through the undersigned

counsel, unto this Honorable Court, respectfully states that:

1. Undersigned received today November 12, 2019, an order setting

this case on November 14, 2019 at 2:00 o’clock in the afternoon. However,
undersigned has a previous setting at RTC – Br. 62, Bago City, case entitled
” with Spec Proc. No. 2030. Attached is the order dated September 19, 2019
in Spec Proc. No. 2030. Whereof as Annex “A” hereof.

2. In view of the conflict in schedule, undersigned respectfully begs

the kind indulgence of this Honorable Court to reset the trial of this case to
November 21, 2019 at 2:00 o’clock in the afternoon.

3. This motion is not intended to delay the case.

Wherefore, it is respectfully prayed that the hearing on November 14,

2019 be canceled and reset to November 21, 2019 at 2:00 o’clock in the
afternoon.
