EX PARTE MOTION TO RELEASE BAIL 

ACCUSED, unto this Honorable Court, respectfully states:

1. That accused posted bail for his provisional liberty in the above-entitled
case as evidenced by Official Receipt No. 1970934, dated October 10, 2022, a
copy of which is hereto attached as Annex “A” and made an integral part
hereof;

2. By virtue of the ORDER of the Regional Trial Court, Branch 65, Jordan,
Guimaras dated February 1, 2023, the above-captioned case was provisionally
dismissed, and the dispositive portion of the order reads as follows:

“The court finds merit in the motion. In view of the failure of the
prosecution to present evidence against the accused, Criminal Case
No. 22-3678 against Ronaldo Palmes y Sipagan is PROVISIONALLY
DISMISSED as of today subject to revival within two (2) years.

3. Further, the said Order also provides for the release of the bail bond posted
by the undersigned accused which read, as follows:

“In view of the provisional dismissal of the case, the Clerk of Court of
MTCC, Passi City is ordered to RELEASE the bail bond posted by the
accused in the amount of Php 36,000.00 under O.R No. 1970934D
dated October 19, 2022 upon presentation of original receipt.”

PRAYER
WHEREFORE, premises considered, it is most respectfully prayed of this
Honorable Court that the cash bail bond in the amount of Thirty-Six Thousand
Pesos (Php 36, 000.00) be released.

       Other just and equitable reliefs are likewise prayed for.
