Selepas 1985, Undang-Undang Perlembagaan Tubuh Kerajaan

Kelantan telah dipinda beberapa kali pada tahun 1987, 1988, 1989,
1990, 1992, 1993, 1994 dan 2003 Pada tahun 2008, menurut Perkara
65 ndang-Undang Perlembagaan Tubuh Kerajaan Kelantan (Sahagian
Yang Pertama), Percetakan Nasianal Malaysia Serhad dengan
persetujuan KeBawah Duli Yang Maha Mulia AI-Sultan, telah mencetak
semula Undang-Undang Perlembagaan buh Kerajaan Kelantan bagi
kali yang kedu8. Semula pada tahun 2008 telah memasukkan
mengemaskinikan semua pindaan tersebut sehingga 1 Januari
2008. Cetakan Tahun 2008 juga telah disediakan dalam teks
Bahasa Melayu (Jawi Rumi) serta teks Bahasa Inggeris.

4 Undang-Undang Negeri Kelantan

2. Undang-Undang Perlembagaan Tubuh Kerajaan Kelantan

(Bahagian Yang Kedua) dipinda dengan memasukkan selepas Fasal (2),
fasal yang berikut:

"(3) Dengan tidak mengendahkan syarat-syarat Fasal 0)

perkara ini, Wads tidaklah boleh meninggalkan Negeri Kelantan
atas apa-apa sebab jua bagi apa-apa tempoh yang lebih daripada lima
belm; hari berturut-turut melainkan peninggalan itu telah mendapat
persetujuan Raja."

ENACTED by the Legislature of the State of Kelantan as

follows:

1. (1) This Enactment may be cited as the Laws of the

Constitution of Kelantan (Second Part) (Amendment)
Enactment 2008.

(2) This Enactment shall come into operation on a date to be

appointed by the State Executive Council by notification in the
Gazette',

2. Article XXXII of the Laws of the Constitution of Kelantan

(Second Part) is amended by inserting after Clause (2), the
following clause:

"(3) Notwithstanding the prOV]SlOn of Clause (1) of this

Article, the Heir shall not absent himself from the State of Kelantan
for whatever cause for any consecutive period exceeding fifteen
days unless such absence has been consented by the Sovereign."

Short title and commencement

1. (1) This Enactment may be cited as the Laws of the

Constitution of Kelantan (Second Part) (Amendment)
Enactmen t 2009.

(2) This Enactment shall be deemed to hace come into

operation on 24 May 2009.

Wassalatu-wassalamu- 'ala Sayyidina Muhammadin-wa' ala alihi
wasahbihi ajma'in.

DENGAN KURNIA ALLAH, TENGKU MVHAMMAD FARIS PETRA

IBNI SULTAN ISMAIL PETRA, D.K., S.P.M.K., Pemangku Raja
Kelantan.

BAHAWASANYA menurut Fasal (2) Perkara 3 Vndang-Vndang

Perlembagaan Tubuh Kerajaan Kelantan (Bahagian Yang Kedua) KITA
menyimpan kepada diri KITA kuasa untuk meminda peruntukan­
peruntukan yang tertentu daripada Undang-Undang Perlembagaan itu
dengan suatu Perwawai yang dikeluarkan dengan persertaan dan
persetujuan Majlis Penasihat Raja Kelantan;

DAN BAHAWASANY AKITA memikirkan mustahak

mengisytiharkan dan mengkanunkan suatu pindaan selanjutnya kepada
suatu peruntukan dalam Undang-Undang Perlembagaan Tubuh
Kerajaan Kelantan (Bahagian Yang Kedua);

MAKA YANG DEMIKIAN, pada menjalankan kuasa-kuasa yang

diperuntukkan oleh Fasal (2) Perkara 3 Undang-Undang Perlembagaan
Tubuh Kerajaan Kelantan (Bahagian Yang Kedua), KlTA DENGAN INI
MENYATAKAN DAN MENGISYTIHARKAN seperti berikut:

Nama dan permulaan kuat kuasa

1. (1) Vndang-Undang ini bolehlah dinamakan Undang-Undang
Perlembagaan Tubuh Kerajaan Kelantan (Bahagian Yang Kedua)
(Pindaan) 2010.

(2) Undang-Undang ini hendaklah disifatkan telah mula berkuat

kuasa pada 19 lulai 2010 bersamaan dengan 7 Syaaban 1431H.

Baru 23A

Undang-Undang Perlembagaan Tubuh Kerajaan Kelantan

(Bahagian Yang Kedua), adalah dipinda dengan memasukkan selepas
Perkara 23 dengan Perkara yang berikut:

"Kelucutan Takhta Kerajaan kerana kecacatan yang besar dan berat

23A. lika sekiranya setelah disiasat dengan sepenuhnya dan

secukupnya, Majlis Perajaan Negeri berpendapat bahawa Raja ada
mempunyai apa-apa kecacatan yang besar dan berat yang
menyalahi sifat-sifat Raja, yang tidak dibenarkan oleh Hukum
Syarak untuk menjadi Raja, maka seorang Pengganti hendaklah
dipilih dan dilantik oleh Majlis Perajaan Negeri untuk menjadi
Raja mengikut syarat-syarat di bawah Bahagian inL".

Bahkan demikianlah.

Itulah Undang-Undang Perlembagaan Tubuh Kerajaan Kelantan

(Bahagian Yang Kedua) (Pindaan) 2010.

Mudah-mudahan ALLAH Yang Maha Kuasa melalui junjungan KITA

NABI MUHAMMAD (Sallallahu 'alaihi wassallam) melimpahkan
rahmatNya kepada Undang-Undang Perlembagaan Tubuh Kerajaan
Kelantan (Bahagian Yang Kedua) (Pindaan) 2010 ini selama-lamanya.

19 lulai 2010 bersamaan dengan 7 Syaaban 1431H.

ALLAH, the Lord of the Universe, and may the benedication and peace
of ALLAH be upon Our Leader Muhammad and upon all his Relations
and Friends.

By THE GRACE OF ALLAH, TENGKU MUHAMMAD FARIS

PETRA IBNI SULTAN ISMAIL PETRA, D.K., S.P.M.K., Regent of
Kelantan.

WHEREAS by Clause (2) of Article III of the Laws of the

Constitution of Kelantan (Second Part), WE reserve to Ourselves the
power to amend certain provisions of the said Laws of the
Constitution by a Proclamation issued with the consent and
concurrence of the Council of Advisers, Kelantan.

AND WHEREAS WE deem it expedient to declare and ordain a

further amendment to certain provisions of the Laws of the
Constitution of Kelantan (Second Part);

NOW THEREFORE, in exercise of the powers in Clause (2) of

Article III of the Laws of the Constitution of Kelantan (Second Part),
WE DO HEREBY DECLARE AND PROCLAIM as follows:

and Commencement
1. (1) This Law may be cited as Laws of the Constitution of Kelantan
(Second Part) (Amendment) 2010.
(2) This Laws shall be deemed to come into operation on 19 July
2010 corresponding to 7 Syaaban 1431H.

New Article XXIII A

The Laws of the Constitution of Kelantan (Second Part) is amended
by inserting after Article XXIII the following Article:
"Loss of Sovereignty owing to great and serious defect
XXIIIA. If after a full and complete enquiry, the Council of
Succession shall consider the Sovereign to have some great and
serious defect derogatory to the quality of a Sovereign, of which
he would not be permitted by the Hukum Syarak to become a
Sovereign, a Successor shall be chosen and appointed by the
Council of Succession to become a Sovereign in accordance with
the provisions of this Part.".
So be it.

Such is the Laws of the Constitution of the State of Kelantan

(Second Part) (Amendment) 2010.

PROPHET MUHAMMAD (Sallallahu 'alaihi wassallam) grant His Blessing

DENGAN KURNlA ALLAH, TENGKU MUHAMMAD FARIS PETRA

SULTAN ISMAIL PETRA, D.K., S.P.M.K., Pemangku Raja

BAHAWASANYA menurut Fasal (2) Perkara 3 Undang-Undang

Perlembagaan Tubuh Kerajaan Kelantan (Bahagian Yang Kedua) KITA
menyimpan kepada diri KITA kuasa untuk meminda peruntukan­
peruntukan yang tertentu daripada Undang-Undang Perlembagaan itu
dengan suatu Perwawai yang dikeluarkan dengan persertaan dan
persetujuan Majlis Penasihat Raja Ke]antan;

DAN AHA W ASANYA KIT A memikirkan mustahak

mengisytiharkan dan mengkanunkan suatu pindaan selanjutnya kepada
peruntukan dalam Undang-Undang Perlembagaan Tubuh
Kerajaan Kelantan (Bahagian Yang Kedua);

MAKA YANG DEMIKIAN, pada menjalankan kuasa-kuasa yang

diperuntukkan oleh Fasal (2) Perkara 3 Undang-Undang Perlembagaan
Tubuh Kerajaan Kelantan (Bahagian Yang Kedua), KITA DENGAN INI
MENYATAKAN DAN MENGISYTIHARKAN seperti berikut:

L (1) Undang-Undang ini bolehlah dinamakan Undang-Undang

Perlembagaan Tubuh Kerajaan Kelantan (Bahagian Yang Kedua)
(Pindaan No.2) 2010.

(2) Undang-Undang ini hendaklah disifatkan telah mula berkuat

kuasa pada 28 Ogos 2010 bersamaan dengan 18 Ramadhan 1431H.

Pindaan Perkara 23A

2. Undang-Undang Perlembagaan Tubuh Kerajaan Kelantan
(Bahagian Yang Kedua), yang disebut "Undang-Undang Perlembagaan
Tubuh" dalam Perwawai ini, dipinda dalam Perkara 23A­
(a) dengan menomborkan semula Perkara sedia ada sebagai
Fasal (1) Perkara itu; dan
(b) dengan memasukkan selepas Fasal (1) Fasal yang berikut:

"(2) Jika sekiranya Raja telah digantikan dengan seorang

Pengganti mengikut Fasal (1) Perkara ini maka Baginda
hendaklah disifatkan tidak lagi menjadi Raja dan telah
menarik diri daripada Negeri ini dan daripada hak-hak dan
tuntutan-tuntutannya di atas Negeri ini:
Dengan syarat bahawa hendaklah Baginda terhak kepada
elaun seumur hidup, akan dikenakan daripada Kumpulan
Wang Yang Disatukan, yang hendaklah ditetapkan oleh
Dewan Negeri; dan elaun itu yang hendaklah tidak kurang
daripada separuh daripada jumlah yang ditetapkan bagi
perbelanjaan hidupnya pada masa Baginda menjadi Raja yang
memerintah, dan berhaklah di dalam masa hidupnya
mendapat sebuah tempat kediaman yang layak yang
disediakan berserta perkakas alatan dan perhiasan dengan
kakitangan kediaman serta kenderaan yang munasabah
dan sesuai kerana memelihara tarafnya. Maka gelaran
Baginda hendaklah bertukar dengan sendirinya daripada
"Kebawah Duli Yang Maha Mulia AI-Sultan Kelantan"
kepada "Duli Yang Maha Mulia Sultan (nama tubuh).".

Pindaan Perkara 25
3. Perkara 25 Undang-Undang Perlembagaan Tubuh dipinda­
(a) dengan memasukkan tanda koma selepas perkataan dan angka
"Perkara 23"; dan
(b) dengan memasukkan selepas perkataan dan angka
"Perkara 23" angka "23A".

Perkara 26 Undang-Undang Perlembagaan Tubuh dipinda dengan

menggantikan Fasal (2) dengan Fasal berikut:

Sekiranya berlaku kemangkatan at au penggantian Raja maka

Isterinya itu hendaklah bertukar dengan sendirinya
daripada "Raja Perempuan (Kelantan)" kepada "Yang Maha Mulia
Perempuan (nama tubuh)", dan jikalau berlaku perceraian
maka gelaran itu hendaklah terlucut dengan sendirinya.".

Bahkan demikianlah.

(Bahagian Yang Kedua) (Pindaan No.2) 2010 ini
selama-Iamanya.

CLAUSE (1) AKD (2) OF ARTICLE III

In the name of ALLAH, the Compassionate, the Merciful, PRAISE be to

ALLAH, the Lord of the Universe, and may the benedication and peace
of ALLAH be upon Our Leader Muhammad and upon all his Relations
and Friends.

By THE GRACE OF ALLAH, TENGKU MUHAMMAD FARIS

PETRA IBNI SULTAN ISMAIL PETRA, D.K., S.P.M.K., Regent of
Kelantan.

WHEREAS by Clause (2) of Article III of the Laws of the

Constitution of Kelantan (Second Part), WE reserve to Ourselves the
power to amend certain provisions of the said Laws of the
Constitution by a Proclamation issued with the consent and
concurrence of the Council of Advisers, Kelantan.

AND WHEREAS WE deem it expedient to declare and ordain a

further amendment to certain provisions of the Laws of the Constitution
of Kelantan (Second Part);

NOW THEREFORE, in exercise of the powers in Clause (2) of

Article III of the Laws of the Constitution of Kelantan (Second Part),
WE DO HEREBY DECLARE AND PROCLAIM as follows:

Title and commencement

1. (1) This Law may be cited as the Laws of the Constitution of

Kelantan (Second Part) (Amendment No.2) 2010.

Laws shall be deemed to come into operation on

August 2010 corresponding to 18 Ramadhan 143

Article XXIIIA

The Laws of the Constitution of Kelantan (Second Part), which

to as the "Laws of the Constitution" in this Proclamation,
amended

by renumbering the existing Article as Clause (l) of that

Article: and

(b) by inserting after Clause (l) the following Clause:

"(2) If the Sovereign has been replaced with a Successor

by virtue of Clause (1) of this Article, he shall be deemed
no longer to be the Sovereign and to have withdrawn from
the State and from his rights and claims in the State.

Provided that he shall be entitled to an allowance for life, to be

charged on the Consolidated Fund, as shall be fixed by the
Legislative Assembly; and such allowance which shall not be
less than a half of the sum fixed for his maintenance when he
was the reigning Sovereign and shall have the right during his
life to be provided with a suitable place of residence and
equitably furnished together with household staff and vehicle,
in keeping and commensurating with his dignity. And his title
shall change automatically from "Kebawah Duli Yang
Maha Mulia AI-Sultan Kelantan" to "Du1i Yang Maha Mulia
Sultan (personal name).".

Amendment of Article XXV

3. Article XXV of the Laws of the Constitution is amended

(a) by inserting a coma after the words and figures "Articles XXIII;
and

(b) by inserting after the words and figures "Article "XXIII" the
figures "XXIIIA",

Amendment of Article XXVI

4. Clause (2) of Article XXVI of the Laws of the Constitution IS
amended by substituting Clause (2) with the following­

"(2) In the event of the demise or the replacement of the Sovereign

the title of His Consort shall change automatically from
"Raja Perempuan (Kelantan)" to "Yang Maha Mulia Raja
Perempuan (personal name)", and in the event of a divorce the
title shall automatically cease to apply.".

So be it.

Such is the Laws of the Constitution of the State of Kelantan

(Second Part) (Amendment No.2) 2010.

May ALLAH, Lord of the Universe, through the Greatness of

Amendment of Article LXI

2. The Laws of the Constitution of Kelantan (First Part) IS

amended­

(a) in Clause (2) by substituting for the words "four other

members" the words "six other members"; and
4 Laws of the State of Kelantan ENACTMENT A40

(b) in paragraph (vi) of Clause (5) by substituting for the words

"the Judge of the Federal Court" the words" the Judge of the
High Court".
