MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT made and entered into at San Jose, Occidental Mindoro this
_____ day of ________________ by and between

PHILIPPINE CENTRAL ISLANDS COLLEGE, a duly recognized and authorized higher education
institution with office address at Bagong Silang, San Jose, Occidental Mindoro, represented by
DEZA L. TUMBAGA, OIC - Administrator, who is duly authorized to represent it in this
transaction, hereinafter referred to as the FIRST PARTY OF THE FIRST PART,

-AND-

HOTEL PLATINUM, with office address at Liboro St., Corner, Captain Cooper St., San Jose,
Occidental Mindoro, represented by ANA LIZA S. SEVILLA, Chief Operations Officer, who is duly
authorized to represent it in this transaction, hereinafter referred to as the PARTY OF THE
SECOND PART,

-WITNESSETH THAT-

WHEREAS, the PARTY OF THE FIRST PART, in line with its mission to promote education through
linkages with government agencies, non-government organizations, private companies and non-profit
organizations hereby providing Senior High School (SHS) students exposure to the real world situations
enabling them to experience what they learn inside the four walls of the classroom, has instituted an
On-the–Job Training for its students in the Senior High School;

WHEREAS, the PARTY OF THE SECOND PART, in its effort to enhance the education and training in
schools by exposing and providing the students with hands-on experiences and other related works, has
willingly shared its facilities to the practicum students of Philippine Central Islands College;

NOW, THERFORE, for and in consideration of the foregoing premises, the PARTIES do hereby agree to
stipulate the following:

A. THE PARTY OF THE FIRST PART shall:


1. Recommend students who will undergo on the job training
2. Supervise the student-trainees and monitor their performance and attendance during the
practicum period.
3. Adopt and enforce policies, rules and guidelines that will govern the practicum of students.
4. Abide by the PARTY OF THE SECOND PART’S rules and guidelines and comply with those
impose for the on-the-job-training.

B. The PARTY OF THE SECOND PART shall:


1. Determine the number of slots for the OJT and deploy the student-trainees to the
appropriate operating areas of the organization.
2. Assign personnel to take charge and supervise the student-trainees.
3. Abide by the policies, procedures and guidelines of the PARTY OF THE FIRST PART governing
the practicum of the students.
4. Accomplish the necessary forms required in connection with the training of the students.
5. Issue a certificate of completion to the students who will successfully finish the training.
6. Adopt and enforce rules that will govern the conduct of the On-the-Job Training. Such rules
shall be made known to the PARTY OF THE FIRST PART and the student-trainees before the
start of the training.
7. No salary/allowance shall be required for the second party for students on their On-the-Job
Training period.
C. Under this MEMORANDUM OF AGREEMENT, the following terms and conditions are likewise
included:

1. That the work immersion shall be allowed only between 8:00 o’clock in the morning and
5:00 o’clock in the afternoon.
2. There will be no-employee-employer relationship between the PARTY OF THE SECOND PART
and the student trainees.
3. Either party may discontinue the training of any student on reasonable grounds after a
written notice to the party concerned.
4. The PARTY OF THE SECOND PART shall not be held responsible for any untoward incident
that may occur within its premises beyond its control during the practicum period.

C. This MEMORANDUM OF AGREEMENT shall take effect upon signing by both parties,
regardless of the date of execution hereof and shall continue thereafter, provided however, that
any provision of this agreement may be amended by written consent of both parties herein, and
provided further that the PARTY OF THE SECOIND PART reserves the right to withdraw its
participation in the AGREEMENT upon notice.

IN WITNESS WHEREOF, the parties hereto have caused these presents to be signed by their proper
officers and their corporate seals to be affixed this __________ day of _____________ 2022.
