    विषय:-Brand Rate drawback claims filed by IOCL for different


    months-regarding
    Please refer to your office letter C. No. 22/CUS/GPT/IOCL/ DBK/
    Misc./1390 dated 08.10.2022 on the above cited subject.

    2. On perusal of the referred letter and other earlier correspondences


    on this issue, the following points are noticed by this office:-

    i. All the individual drawback claims, forwarded by your office on


    monthly basis, are found to be below Rs. One Lakh. Instead of
    sanctioning drawback claims, it is noticed that all the
    individual Bill of Export are signed by the Superintendents by
    fixing stamp “Claim for …….. are liable to be sanctioned”.

    ii. In terms of Circular No. 17/2000-Cus dated 29.02.2000, power


    to sanction drawback claims (triplicate copy of Bill of Export)
    upto Rs. One Lakh is bestowed to the Appraisers subject to test
    check of 5% cases on a random basis by the Assistant/Deputy
    Commissioner. Therefore, drawback claims below Rs. One Lakh
    should be forwarded to this office only for test check and not
    for sanctioning it.

    3. Apart from this, total amounts of month wise drawback claims


    were not found mentioned in the forwarding letters of any of the 14
    cases of referred letter, forwarded by your office. Proper details should be

    sent for issuance of cheques in respect of all the 14 cases by quoting


    specific details viz. name of the party and amount etc. after completion
    of sanction, test check and other formalities of the said claims.
