KNOW ALL MEN BY THESE PRESENTS:

THIS DEED OF DONATION and ACCEPTANCE (the “Deed”)

is made and executed by and between:

“DONEE”

WHEREAS, it is well-entrenched constitutional principle under

Section 5, Article II, 1987 Constitution that “the maintenance of peace
and order, the protection of life, liberty and property and the
promotion of the general welfare are essential for the enjoyment by

all the people of the blessings of democracy”;

WHEREAS, Section 16, Chapter II, Title I of the Local

Government Code of 1991 provides “Every local government unit
shall exercise the power expressly granted, those necessarily implied
there from, as well as powers necessary, appropriate, or incidental for
its efficient and effective governance and those which are essentials
for the general welfare.”

WHEREAS, the legal mandate of the Bureau of Fire Protection

to prevent and suppress all destructive fires on all buildings, houses
and other structures, forest land, transportation vehicles and
equipment, ships or vessels docked at piers or wharves or anchored
in major seaports, petroleum industry installations, plane crashes and

 other similar incidents as well as the enforcement of the Fire Code
and other related laws;

WHEREAS, the Local Government Unit of Iligan City and the

Bureau of Fire Protection-10 vowed in the dynamic partners in
providing fire protection, respond to various incidents and in general,
all fire prevention and suppression measures to secure the safety of
life and property of the citizenry;

NOW THEREFORE, with the foregoing premises, parties
hereto forged the herein Deed of Donation as follows:

THAT the DONOR, is the owner of a certain parcel of land

located at San Miguel, Iligan City with total area consisting of Nine
Thousand Eighty-Five (9, 085) square meters covered by Transfer
Certificate of Title (TCT) No. T-26, 401 (A.F.) of the Register of
Deeds (ROD) of Iligan City;

THAT for and consideration of a desire to contribute said parcel

of land for the construction of a modern Fire Station Building of Iligan
City Fire Marshall, Iligan City which the DONEE inspires in the
DONOR, and as an act of liberality and generosity, the DONOR

hereby voluntarily and freely transfers and conveys, by way of
donation to the DONEE, his successors and assigns, all the rights,
title and interest of a portion of thereof consisting of EIGHT
HUNDRED (800) SQUARE METERS as indicated in the Sketch
Plan/Lot Plan (A COPY IS ATTACHED HEREWITH AS ANNEX “B”)
which said DONOR has in the above described real property,
together with all the buildings and improvements found therein, free
from all liens, encumbrances and charges whatsoever and more
particularly describe as:

THAT THE DONEE hereby accepts said donation of the above

described parcel of land and does hereby express gratitude for the
support and kindness of the DONOR and commits that the said lot

consisting of 800 sq.m. shall be utilized only for the construction of a
Modern Fire Station Building of Iligan City;

THAT THE DONOR represents and warrants to the DONEE

that it has the power and authority to execute and deliver this Deed
and to perform all the terms and conditions hereof. And, that the
DONOR has the legal right to make this donation of said property
being to free portion under the New Civil Code and other existing
laws, which he can freely dispose of;

THAT THE DONEE shall in no case sell, alienate, exchange,
mortgage or in any manner encumber the donated lot to the
government or private entity otherwise, this donation shall be deemed
ipso facto revoked;

THAT THE DONOR undertakes to cause the transfer of the

same to the name of the DONEE;

THAT THE DONEE does hereby accept the foregoing donation

with the corresponding conditions thereof from the DONOR and
expresses his sincere appreciation and gratitude for the kindness and
liberality shown by the DONOR;

THAT THIS DEED shall be governed by and interpreted in
accordance with the laws of the Philippines;

THAT IN CASE ANY OF THE PROVISIONS contained herein

shall, for any reason, be held to be invalid, illegal or unenforceable in
any respect, such invalidity, illegality or unenforceability shall not
affect any other provision of this DEED, and the remaining valid
provisions shall be valid and enforceable to the fullest extent.

IN WITNESS WHEREOF, the parties have hereunto set their
