1. Discuss in detail the circumstances that led India to agree to inclusion of substantive
norms and standards for the protection of Intellectual Property Rights(IPRs) within
the negotiating mandate of 1986 Punta del Este Ministerial Declaration that launched
the Uruguay Round of Multilateral Trade Negotiations. What was the transition period
available to the Indian pharmaceutical industry to adapt to the changes introduced by
TRIPS?
2. Welfarica, a WTO member country provides the following in its patent legislation -
"Certain Acts not to be considered as infringement-For the purpose of this Act-
(a) any act of making, constructing, using, selling or importing a patented
invention solely for uses reasonably related to the development and
submission of information required under any law for the time being in force,
in Welfarica, or in a country other than Welfarica, that regulates the
manufacture, construction, use, sale or import of any product
(b) Any act of making , constructing , using or selling a patented invention in
accordance with subsection (1) to make, construct or use the invention,
during the three month period immediately preceding the date on which the

In pursuance of this, Accessiba Ltd., a pharmaceutical company based in Welfarica
has manufactured 10000 capsules of BACTIFED, a patented medicine, and exported
4000 capsules to its neighboiring country, Dependica. The patent in BACTIFED is
expiring on 31st December, 2020. The patent is owned by Galaxo Pharmaceuticals
based in Capitalica, a powerful WTO member country. Capitalica is keen on
challenging the measure before WTO DSB and seeks your opinion on consistency of
the provision with TRIPS. Write a detailed legal advice for Capitalica.
3. (a) TRIPS is responsible for TRIPS plus standards of Intellectual Property protection
in Free Trade Agreements (FTAs) which in turn has adversely impacted access to
medicines. Do you agree? Explain, giving reasons
(b) Rilead is a medicine critical for treating Rica- an epidemic ravaging parts of
Latin America. The medicine is patented in India by Care Ltd, one of the
world’s biggest pharmaceutical company headquartered in U. S. India granted
compulsory license to the medicine under Section 92 A of the Patents Act,
1970 to Affala Pvt. Ltd. After the grant of compulsory license, Affala starts
exporting the medicine to countries in Latin America affected by Rica. However,
U. S. sees the grant of compulsory license as flagrant violation of TRIPS
and threatens India with trade dispute. In view of this, Indian government seeks
your opinion on the consistency of its measure with TRIPS. Write a detailed
legal advice for the Indian Government.
4. (a) In her 2019 book “Bottle of Lies”, Katherine Eban writes that “the lower quality
manufacturing and lax regulation means that individual Indian patients are
getting substandard and ineffective drugs.”
Do you think providing data exclusivity regime for the pharmaceutical industry in
