AN ORDINANCE REQUIRING PESO TO ESTABLISH A YOUTH EMPLOYMENT


SERVICE DESK FOR UNEMPLOYED YOUTH IN EVERY MUNICIPALITY IN THE
PROVINCE OF ORIENTAL MINDORO AND APPROPRIATING FUNDS THEREOF

WHEREAS, Section 3, Article XIII of the 1987 Constitution of the Philippines affirms that the
State shall regulate and promote full protection and equality of employment opportunities;
WHEREAS, Section 4 of Republic Act 8759 also known as Public Employment Service Office
(PESO) Act of 1999 provides the establishment of PESO to ensure the prompt, timely and
efficient delivery of employment service and provision of information on the other Department
of Labor and Employment (DOLE) programs.
WHEREAS, DOLE Administrative Order No. 260-15 aims to provide opportunities and engage
young workers to serve general public and government agencies/entities projects and programs at
national and local levels.
WHEREAS, 2020 Philippine Statistics Authority (PSA) census on labor force participation rate
in Oriental Mindoro shows that 31% of youth belong in the group of gainful workers in the
province while in 2021 unemployment rate translates to 28,000 unemployed persons in the
province and three (3) out of then (10) employed persons are underemployed.
WHEREAS, the Sangguniang Panlalawigan of Oriental Mindoro believes;
(a) that development goals must focus on the continuing improvement of technical training
accessibility, quality, affordability, with primary focus on skills that will provide employment
opportunities to the youth and make the labor force of the province nationally or globally
competitive, providing quality technical vocational training and skills development program to
the out-of-school youth and the labor force, to strengthen their employment qualifications, (b)
that is imperative for the government to address youth unemployment and enhance the
employability of its workforce.
NOW THEREFORE, be it ordained by the Sangguniang Lalawigan in session duly assemble
that;
SECTION 1:TITLE:
This Ordinance shall be known as “AN ORDINANCE REQUIRING PESO TO ESTABLISH A
YOUTH EMPLOYMENT DESK FOR UNEMPLOYED YOUTH IN EVERY MUNICIPALITY
IN THE PROVINCE OF ORIENTAL MINDORO AND APPROPRIATING FUNDS
THEREOF”
SECTION 2: OBJECTIVES
a. To establish a service frontline desk that will initiate and coordinate comprehensive
training necessary for job employability of unemployed youth of Oriental Mindoro
province.
b. To gather, assess, and utilize information about the factors affecting youth unemployment
that will serve as the basis for local policy-makers in formulating intervention programs.
c. To assist unemployed youth by providing an opportunity to explore their interests and
potential career pathways, develop relevant workplace skills, and engage in learning
experiences.

SECTION 3: DECLARATION OF POLICY


In order to improve the human capital investment of the province and provide efficient
employment service to youth, it is hereby declared to be the purpose of this ordinance to
establish Youth Employment Service in every municipality in the province of oriental mindoro.

SECTION 4: COVERAGE
Unemployed youth from 15 to 30 years of age in the province of Oriental Mindoro.

SECTION 5: DEFINITION OF TERMS


1. Capacity Training - implies the enhancement of capabilities of people and institutions in a
sustainable manner to improve their competence and problem solving capacities.
2. Skills Enhancement. Provision of necessary training for improving technical and
vocational skills.
3. Intervention Program - programs designed to identify individuals with developmental
disabilities in need of services and to assist them in obtaining the appropriate service.
4. Job Market - the number of jobs that are available in a particular place or for a particular
type of work.
5. Unemployed Youth. Those youth ages 15-30 years old who are unable to seek a job.
6. PESO Employment Information System (PEIs). A database of active manpower supply
containing the profiles of all persons and employers registered under the National Skill
Registration Program. (DOLE)
7. Job Market Skills - these are the skills valued by employers that can be applied in a
variety of work settings.
SECTION 6: ESTABLISHMENT OF YOUTH EMPLOYMENT DESK
There shall be a Youth Employment Service (YES) Desk under the PESO in every municipality
that will enable the Youth in entering the labor market, especially the youth who have limited
skills or no working experience.
SECTION 7: DUTIES AND FUNCTIONS
a. Profiling and Pre-Assessment. The YES Desk shall conduct profiling of youths to
determine the needed training that is suited for the applicant.
b. Capacity Training and Skills Enhancement. The YES Desk shall plan and coordinate with
concerned agencies such as, but not limited to DOLE, TESDA, DepEd, Higher
Educational Institutions (HEIs), and Private Sectors for the conduct of training and
workshops.
c. Outsourcing. The YES Desk shall coordinate with concerned units under PESO for the
purpose of transacting with different enterprises and employers to refer trained young
workers.
d. Information dissemination and awareness campaign. The YES Desk shall organize,
publish and conduct information dissemination and awareness campaign on the programs
and activities of government, HEIs and NGOs relative to employment concerning youth.
e. Monitoring, Evaluation, and Feedback. The YES Desk shall monitor the status of young
workers, evaluating such results and operation for the purpose of improvement.
SECTION 8: SERVICES OF THE YOUTH EMPLOYMENT DESK

a. Trainings for unemployed youths and provide them with the necessary job-market skills;
b. Utilize existing government youth training activities and programs to better prepare the
youth for employment;
c. Facilitate employment of the youth in the public and private sectors of the economy.
d. Creating and maintaining connections with concerned institutions or organizations such
as but not limited to TESDA, DOLE, DICT, DepEd, and HEIs for the implementation of
programs relating to youth employment.

SECTION 9: RESPONSIBILITIES OF PUBLIC EMPLOYMENT AND SERVICES


OFFICE
a. Monitor and supervise the programs and activities of the YES DESK, and its
accomplishments.
b. Provide YES DESK access to Public Employment Information System (PEIS) to
effectively accomplish its duties and functions.
SECTION 10: RESPONSIBILITIES OF LGU
a. Shall adopt and implement the ordinance in their respective localities.
b. Provide sufficient funding to support the establishment of the YES Desk.
c. Shall ensure that the focal person of YES DESK is performing his/her task accordingly.
d. Create a plantilla position for personnel of YES DESK depending on the availability of
fund and personnel service limitation.
SECTION 12: FUNDING - The cost of maintenance and other operating expenses of the YES
Desk shall be charged under the Public Employment Services Office. Expenses on capability
development of officer/personnel under the YES Desk shall be charged under the Provincial
Youth Development Office.
SECTION 13: REPEALING CLAUSE
All laws, decrees, executive orders, proclamations, rules and regulations or parts thereof
inconsistent herewith are hereby replaced or modified accordingly.
SECTION 14: SEPARABILITY CLAUSE
If any provisions of this act is held invalid or unconstitutional, the other provision not affected
hereby shall remain valid and subsisting.
SECTION 15: EFFECTIVITY CLAUSE
This ordinance shall take right after its approval.
