Terms and Conditions
1. The Client shall pay the Acceptance Fee upon agreement. The Client shall furnish a
copy of payment if made via bank. The Client agrees that the Lawyer’s Acceptance Fee is
non-refundable and may be retained by the Lawyer as liquidated damage for
opportunity costs.
(Ang Kliyente ay magbabayad ng Acceptance Fee kapag nagkaroon na ng Kasunduan. Ang
Kliyente ay magbibigay ng kopya ng pruweba ng pagbabayad, kung ito ay sa bangko. Ang
Kliyente ay sumasang-ayon na ang Acceptance Fee ng Abogado ay hindi na ibabalik at maaring
kunin ng Abogado bilang pinagkasunduang danyos para sa mga pagkakataon na kanyang
pinalampas.)
2. Payment shall mean the Client agrees to the rate for the legal services and to the terms
and conditions set forth in this document.
(Ang pagbabayad ay nangangahulugan na ang Kliyente ay umaayon sa naitakdang halaga para
sa serbisyong legal at sa mga kondisyon na nakasaad sa dokumentong ito.)
3. The Client shall only pay in cash or via deposit. No post-dated checks shall be
accepted.
(Ang Kliyente ay magbabayad lamang ng cash o sa pamamagitan ng pag-deposito nito sa bangko.
Ang post-dated check ay hindi tatanggapin.)
4. The Client-Lawyer relationship shall be governed by the Code of Professional
Responsibility, Lawyer’s Oath, Orders and Rulings by the Supreme Court, and pertinent
laws.
(Ang propesyonal na relasyon sa pagitan ng Abogado at Kliyente ay mapapasailalim ng Code of
Professional Responsibility, Lawyer’s Oath, Mga Utos at Desisyon ng Korte Suprema, at iba
pang may kinalamang batas.)
5. Lawyer retains the right to charge Client costs for additional undertakings outside of
court proceedings, such as but not limited to Appearance Fee, Staff Cost, Transportation,
and Meal Allowance. Client shall be informed and shall receive liquidation from the
Lawyer.
(Ang Abogado ay may karapatan na singilin ang Kliyente sa ano mang gastusin para sa
karagdagang proseso o aksyon sa labas ng nasabing proseso sa korte, tulad ng Appearance Fee,
Staff Cost, Transportation, at Meal Allowance. Ang Kliyente ay aabisuhan at bibigyan ng
paglalahad ng nasabing gastusin).
6. The Lawyer retains the right to terminate the Client-Lawyer relationship should the
client, as solely determined by the Lawyer, chooses a course of action that is contrary to
the law, morals, good custom, and directive of the Court, without reimbursement of the
Legal Fee as defined above.
(Ang Abogado ay may karapatan na wakasan ang propesyonal na relasyon ng Abogado at
Kliyente kung ang huli, sa palagay ng una, ay pipili ng mga aksyon na labag at labas sa batas, sa
moralidad, mabuting nakagawian at direktiba ng Korte, nang hindi kinakailangang isauli ang
Legal Fees na nakasaad sa itaas.)
7. In no case shall a postponement due to reason outside the control of the Lawyer be a
ground to forfeit the appearance fee. Appearance fee shall be paid at least Three (3)
days before the setting . Client shall pay the full amount of Appearance fee if the lawyer
had already left for ________ or is already in _________. Client shall pay the half of the
Appearance fee if the vista is postponed AND the lawyer has not yet left for ________.
(Kung ang kaso ay pinagpaliban dahil sa kadahilanan na wala sa control ng Abogado, ang
Appearance Fee ay hindi kailangan isauli ng Abogado, at ito ay dapat bayaran tatlong (3) araw
bago ang nakatakdang vista sa Korte. Kung sakaling ang Abogado ay nakarating man o hindi pa
sa Mamburao, ang limampung (50%) porsyento o kalahati ng napagkasunduang halaga ng
Appearance Fee na lamang ang siyang babayaran ng Kliyente. )
8. Success Fee is contingent to the success or recovery of the Amount or actual amount
recovered either by judicial or extra-judicial means. It means if nothing is collected, the
Lawyer will also get no Success Fee.
(Ang Success Fee ay kabayarang nakadepende sa pagkapanalo o pagkakabalik ng Halaga o
Halagang itinakda ng Korte o proseso sa labas ng Korte. Nangangahulugan na kung hindi
Manalo o walang mabawing Halaga, wala ring Success Fee ang Abogado.)

9. In collection cases, the Client grants the exclusive right to the Lawyer to pursue the
action and undertake all other necessary and reasonable steps, and shall issue a Special
Power of Attorney in favor of the Lawyer in effect. Such exclusivity shall be good for
one (1) year from agreement.
(Sa kasong koleksyon, ang Kliyente ay nagbibigay ng eklusibong kapangayarihan sa loob ng
isang taon upang umaksyon ang Abogado at magsagawa ng lahat ng kailangan at resonable na
aksyon. Ang Kliyente ay magbibigay ng Special Power of Attorney sa Abogado.)
10. For convenience of the lawyer, the Client shall set up in coordination with the
Lawyer a revolving fund, which also covers the minimum amount of Success Fee,
against which the Lawyer may bill the Client.
(Para mas madali ang kumilos para sa Abogado, ang Kliyente ay magbibigay ng Revolving Fund
o pondo kung saan kukunin ng Abogado ang ano mang gastusin na hindi pa nababayaran. Ang
Revolving Fund ay hindi bababa sa Success Fee.)
11. The Term of this Agreement shall be for one (1) year, renewable upon mutual
agreement of the parties.
(Ang termino at kondisyon na nakasaad dito ay epektibo sa loob ng isang (1) taon, na maaring
muling repasuhin depende sa kasunduan ng Abogado at Kliyente.)
12. This Agreement expressly excludes appeals, which shall be covered by a separate
agreement.
(Ang Kasunduang ito ay hindi kasama ang appeals, na mayroong ibang Kasunduan).
13. Whenever applicable, the Retainer Fees shall be payable every 15 th of the month
during the Term as provided in the previous clause or until the conclusion of the case at
the first level. Retainer Fees shall be due and demandable whether or not actual service
is rendered.
(Kung ito ay kasama, ang Retainer Fee ay kailangang bayaran kada ika-15 ng bawat buwan, sa
loob ng terminong nakasaad sa itaas, o hanggang ang kaso ay matapos sa unang lebel. Ang
Retainer Fee ay dapat bayaran kung mayroon mang legal na serbisyong nagawa o wala.)
14. The Client agrees to maintain the confidentiality of this Agreement and all other
communication between the Client and the lawyer.
(Ang Kliyente ay pananatalihing konpidensyal ang Kasunduang ito at lahat ng komunikasyon at
paguusap ng Kliyente at Abogado.)
15. The Client agrees to limit communication to the Lawyer within reasonable office
hours, except in emergency. The Client also agrees to receive communication from the
Lawyer within the said limits.
(Ang Kliyente ay sumasangayon na tawagan o padalhan ng mensahe ang Abogado sa loob ng
oras ng opisina, maliban na lamang kung ito ay emergency. Ang Kliyente ay pumapayag na
makatanggap ng tawag o mensahe mula sa Abogado sa loob din ng nasabing limitasyon).
16. The Client agrees and authorizes the Lawyer to register unpaid fees and charges as
Attorney’s Lien on any or all of Client’s property, without need of prior demand or
judicial action, for the purpose of payment of such unpaid fees and charges.
(Ang Kliyente ay pumapayag at binibigyang kapangyarihan ang Abogado na i-rehistro ang ano
mang bayarin sa Abogado na hindi pa nababayaran bilang Attornery’s Lien sa lahat o ano mang
ari-arian ng Kliyente, na hindi kinakailangan na magdemanda o maghabla sa korte, upang
mabayaran ang Abogado.)
CLIENT’S AGREEMENT
I have read and understood the rate and terms and conditions above. It
had been explained to me thoroughly and in a language known to me. I agree to the rate
and terms and conditions freely and voluntarily.
