Case #1: Gina Attends a Birthday Party

Case History:
Gina is an incoming freshman college student. Her boyfriend is 17-year-old Rock Estrada.
With their high school classmates, both are trying to enjoy the summer vacation before
they enter college.

Manny Crisostomo is 17 years old. He is also a classmate of Gina and Rock at Doña
Facunda High School.

On May 13, 2011, around 2:30PM, Gina received a text message from Manny’s number.
The message said “[R]ock to. Nkkgamit lng kc deadbat na fon. Habol k d2 kna Manny.
Bday nya. Papunta na d2 tropa.” Gina hurriedly dressed up and told her father that she
will go to the public library. Then she proceeded to Manny’s house, located four blocks
away from their residence.

When Gina arrived at Manny’s house, no one was there. She asked Manny where Rock
and the others were. Manny told her that Rock left to buy ice at a nearby Mini-Stop.
“[B]abalik yun agad, eto nga iniwan n’ya na fone n’ya kasi drained na battery. Yung
tropa parating na rin.” Then Manny offered her a glass of orange juice and told her to
make herself comfortable while waiting for the others. Gina drank the orange juice.
Suddenly, she felt dizzy.

When Gina woke up, she was already lying down naked on a bed. Still feeling very
wobbly, she tried to stand up and pick up her clothes strewn on the floor. Then she
overheard two voices. The first voice, sounding desperate, belongs to Manny. He said:
“[K]uya, tulungan mo na ako. Parating na sina Mommy at Daddy.” The second voice
belongs to a stranger who said: “Gago ka! Pati ako idadamay mo pa sa mga kalokohan
mo! Ilalabas ko na ang motor. Bihisan mo na para madispatsa natin yan bago pa
dumating sina Mommy. Bilis!”

Gina fainted again. When she recovered, she was on board a moving motorcycle
sandwiched between two bodies. The one at the back was holding her to keep her from
falling off the motorcyle.

Gina was dumped near a construction area. Paeng Meloto, a foreman, and his construction
workers found the unconscious Gina. Paeng is a friend of Gina’s father. He immediately
rang Lito. “Pare, wag ka mabibigla. Nandito sa site si Gina. Hindi maganda ang lagay.
Mukhang in-shock. Hindi namin mabuhat. Nagwawala kapag may lumalapit sa kanya.
Baliktad ang t-shirt na suot. Yung maong n’ya baliktad din ang pagkakasuot. Punta ka na
dito. Nasa sa ‘yo kung isasama mo si Mare. Pero baka di n’ya kayanin.”

Lito instructed his wife to pack some clothes for Gina and meet him at the emergency
room of the Philippine General Hospital. Accompanied by Rock whose help they also
sought to look for his daughter, he rushed to the construction site to fetch Gina.

When Lito first saw Gina, he could not speak. His daughter was very pale. Gina was
crying and incoherent. She did not want anyone to get near her. She only calmed down
when she heard her father’s voice. Lito soothingly told his daughter “Anak, nandito na si
Papa. Dadalhin ka namin sa hospital, ha? Nauna na si Mama mo doon. Inaantay tayo. In
response, Gina was repeatedly saying “[S]orry, Papa.” Except for “Manny,” “orange
juice,” and “rape,” her other words were mumbled and incoherent.
