The alleged libelous post reads as follows:

“At my age, I value my peace over shit but if you act like a privileged asshole,
I wouldn’t mind unleashing the demon in me.

Whoever knows Ms. Vanessa Dumaran Latuza, please tell her I’m excited to
see her again, after pleading 3 three times last May 9 NLE. She wanted to be
prioritized from the queue because she is from “PAO”.

Don’t make it look like we owe you an explanation and call it your “election
duties”. What have you done, biatch? Kaentitled na ba!”

2. The complainant anchored her complaint to the alleged defamatory remarks which
consist of the following words: “asshole”, “entitled” and “biatch”.

3. It should be noted that the alleged post was composed of three paragraphs that
contained sentences with different meanings and interpretations. Thus, there is a need to
dissect and examine carefully the construction of each and every sentence to come up with the
plain meaning and exact usage of the words that compose the same.

4. The word “asshole” which is found in the first paragraph was not directed to the person
of the complainant but rather it was addressed to any person in general. It is worthy to note that
the name of the complainant did not appear in the said paragraph. What I was trying to express
here is that if someone acts like a privileged asshole, I will not hesitate to retaliate against that
person.

5. Also, the name of the complainant did not appear in the third paragraph where the
words “entitled” and “biatch” were mentioned.

6. As to the word “entitled’, the same is not defamatory in nature because the plain
meaning of this word is merely “having a right to certain benefits of privileges”, which will not, in
any way, tend to cause dishonor or discredit to a person because anybody can safely describe
that a person has a right to certain benefits or privileges without committing the crime of cyber
libel.

7. Lastly, as regards the word “biatch”, the word is commonly used as a term of
endearment to another person and should not be interpreted as a derogatory remark.
Therefore, a person’s reputation cannot be damaged or tarnished by this word because the
same is not commonly used to dishonor or discredit a person.
