SUBJECT : CLARIFICATION ON THE GRANT OF BONUSES AND
OTHER INCENTIVES/BENEFITS TO LECTURERS.

‘The University has received an anonymous complaint, coursed through the 8888
Citizens’ Complaint Center, dated 1 December 2020, regarding the alleged non-grant of
13th month pay to our lecturers,
Please be advised that as emphasized during the orientation program for lecturers
conducted every start of the semester, lecturers are engaged through Contract of Services
as provided under the Commission on Audit (COA) and Department of Budget and
Management (DBM) Joint Circular (JC) No. 2, s. 2020.! Hence, as regards the grant of
bonuses and other incentives/benefits given to regular personnel:
7.5, The services of the COS and JO workers are not covered by Civil Service laws, rules,
and regulations, thus, not creditable as government service. They do not enjoy the
benefits being received by government employees, such as leave, Personnel Economic
Relief Allowance, Representation and Transportation Allowances, and other bonuses and
incentives. (emphasis added)
Inasmuch as the University wants to grant 13th month pay to all our personnel, we are
precluded by existing rules and regulations to do the same. In fact, the DBM Budget
Circular (BC) No. 2017-2 Re: Rules and Regulations on the Grant of Mid-Year Bonus
provides that:
" Updated Rules and Regulations Governing Contract of Service (COS) and Job Order (JO) Workers in the
Government* 3.0 Exclusions
‘The following are excluded from the coverage of this Circular:
3.3 Those hired without mployer_relationships and funded from non-
Personnel Services appropriations/budget, as follows:
3.3.4 Individuals and groups of people whose services are engaged through job orders,
contract of service, or others similarly situated. (emphasis added)
Lastly, during said orientation program, the HRMO also discussed the terms and conditions
of the COS, specifically:
“7. That, the SECOND PARTY shall not be entitled to any benefits pertaining to a
regular employee of BatStateU.” (emphasis added)
