QUESTION 1

Usul al-fiqh plays a crucial role in the development of Islamic law. Its contribution is very crucial
particularly in solving current issues faced by Muslim jurists. Based on the above statement,
answer all of the following:

a. Elaborate two (2) approaches of learning usul-fiqh adopted by previous scholar and
three (3) importance of learning usul-fiqh.
(10 marks)

b. Explain five (5) factors which lead to the compilation of usul al-Fiqh and discuss the
relationship between Usul-fiqh and fiqh
(10 marks)

c. Explain four (4) basis of legislation in fiqh with examples

(10 marks)

d. Elaborate briefly three (3) reasons behind the absence of the documentation of Usul
Fiqh during the period of Prophet Muhammad SAW.

QUESTION 2

a. Explain four (4) guidelines to apply concessionary law (rukhsah) in our daily life and
provide two (2) examples of rukhsah for ibadah and two (2) examples for muamalat.

b. Explain five (5) types of al-hukm al-taklifi with examples.

(10 marks)

c. Differentiate between wajib aini and wajib kafa’i and support your answer with
examples.
(8 marks)

QUESTION 3

a. Explain three (3) pillars of qiyas, with two (2) conditions for each pillar.
(10 marks)

b. Explain four (4) conditions of nasakh (abrogation) and state the arguments from
scholars who against nasakh.
