Freedom of Speech Give People the Right to Use

Hate Speech

Along with the development of technology, freedom of expression has begun to change,
especially with the rise of social media. The public's euphoria in welcoming the existence of
social media as a means of expression and opinion turns out to cause problems when it is
contrary to legal teachings and is not accompanied by responsibility for the use of social media.
In the name of freedom of expression, everyone feels that his opinion must be respected and
respected in whatever form it takes. Even though living in a democracy does not mean being free
without rules and being able to break the rules easily. Acts or crimes that need serious attention
at this time, namely hate speech.
Generally, Hate Speech can take the form of campaign speeches, rallies, demonstrations,
and fierce debates. What generally dominates are groups who are arrogant, feel strong, have
protection, have influence, have large masses, and so on, but it is possible and has also happened
where minority groups have triggered hate speech and bullying.
Hate speech is regulated in Article 28 paragraph (2) of the ITE Law, "Every person
intentionally and without rights disseminates information aimed at causing feelings of hatred or
hostility towards certain individuals and/or community groups based on ethnicity, religion, race,
and inter-groups." SARA)." Practically, this rule plays an important role in maintaining the
harmony of a very plural Indonesian society. As we know, the boundaries between groups,
religions, and ethnic groups in Indonesia have become increasingly tense in recent years. if
speech it can inspire people others to commit violence, or hurt another person or group then the
hate speech works done. (Anam and Hafiz, 2015)
Several international instruments relating to hate speech, such as the 1948 UN
Declaration of Human Rights, the International Convention on the Elimination of All Forms of
Racial Discrimination (CERD), and the International Covenant on Civil and Political Rights
(international Covenant). on Civil and Political Rights (ICCPR). One of the cases in Indonesia
regarding hate speech is that an account named Muslim_Cyber1 was arrested for uploading a
screenshot of a fake conversation between the National Police Chief Gen. Tito Karnavian and the
Head of Public Relations of the Metro Jaya Police, Kombes Argo Yuwono. The contents of the
conversation discussed the case of the leader of the Islamic Defenders Front (FPI) Habib Rizieq
Shihab. In the snippet of the message, it was as if Tito and Argo were planning to fabricate a
case to bring Rizieq down. HP is not only making hoax conversations between Tito and Argo.
The @muslim_cyber1 account also contains uploads containing SARA, slander, and hate speech
(Leni Syafyahya, 2009)
In conclusion, in the current situation, social media has a very important role in human
life, including in Indonesia. In Indonesia, social media has become one of the basic needs of
human life. Almost everyone has social media. Social media can and is often used to express
opinions and other things, but some people voice their opinions in a bad way. Indonesia has a
rate of Hate Speech cases that continues to increase every year. Only by having an opinion that is
too free, we can cause a lot of problems for other people, even though there is already a law that
regulates it. So it all goes back to each individual who has his mind and thoughts. Are we going
to keep leaving comments that are just blasphemous and will not build others up on social media,
or are we going to start trying to give criticism and suggestions more humanely and politely.
