BAIL BOND

WHEREAS, a Complaint or Information has been filed in the

above-entitled case, charging the above-named accused with the
offense of Violation of CA 142 as amended by R.A. No. 6085.

WHEREAS, the bail recommended for the said offense is

THIRTY THOUSAND (Php 30,000.00) Pesos and the said amount
has been deposited at Judiciary Electronic Payment Solution
(JEPS), as evidenced by Reference No. MCTC335994406 dated
December 06, 2022, the same to constitute as bail and also to be
applied to the payment of fine and costs the excess, if any , shall be
returned to the bondsman;

NOW, THEREFORE I, Vicente Banaag Tarnate bondsman,

with the express conformity of the accused, hereby undertakes to
abide by the following conditions of the bail as specified under Rule
114, Section 2 of the Rules of Court (Rules):

(a) This undertaking shall be effective upon approval,

and unless cancelled, shall remain in force at all
stages of the case until promulgation of the
judgment;

(b) The accused shall appear before the proper court

whenever required by the court of these Rules;
 (c) The failure of the accused to appear at the trial
without justification and despite due notice shall be
deemed a waiver of his right to be present thereat.
In such case, the trial may proceed in absentia; and

(d) The bondsman shall surrender the accused to the

court for execution of the final judgment.

Failure to observe any of the above conditions shall result in the

forfeiture of the amount of the undertaking in favor of the Republic
of the Philippines.

ORDER

After personally evaluating the Resolution of the government prosecutor

and the supporting evidence on record pursuant to Section 5, Rule 112 of the
Revised Rules on Criminal Procedure, the undersigned finds that probable
cause exists to hold the accused for trial in order not to frustrate the ends of
justice.

A C C O R D I N G L Y, considering that the Information in this case was

filed pursuant to Sec. 6, Rule 112 of the Revised Rules on Criminal Procedure
and the accused is already under the custody of the police authorities, let a
Commitment Order be issued directing the Chief, Criminal Investigation &
Detention Group, Pinamalayan, Oriental Mindoro, to take custody of the living
body of accused GLENN SICAD BAÑES as detention prisoner subject to
further Orders from this Court.

The bail for the provisional liberty of accused is set at THIRTY THOUSAND
(P30,000.00) PESOS, taking into account the government prosecutor's
recommendation based on the Bail Bond Guide of the Department of Justice as
well as factors specified in Sec. 9 Rule 114 of the Revised Rules on Criminal
Procedure.
