- AGREEMENT OF LEASE –

THIS INDENTURE OF AGREEMENT OF LEASE IS MADE AND


ENTERED INTO AT VAPI ON THIS 12th DAY OF DECEMBER 2022
BETWEEN:

MRS. CHANDNI MAHENDRA GARG, age 55 years, Occupation:


Housewife, residing at: Chandralok Complex, Vapi – Silvassa Main Road,
Chanod, Via: Vapi, Taluka: Vapi, District: Valsad, State – Gujarat, India
(hereinafter called as “THE FIRST PART” or “THE LESSOR” which
expression shall unless it be repugnant to the context or meaning thereof shall be
deemed to mean and include his legal heirs, successors, executors, administrators,
and assignees).

AND

M/S. SHREE OM PACKERS, Proprietor, Mr. VINOD KUMAR SWAMI, age


50 years, Occupation: Business, residing at: Row House No. F-37,
Manibhadra Dharshan Row House, Near Shivalik Apartment, Swaminarayan
Gurukul Road, Chala, Vapi, Taluka: Vapi, District: Valsad, State: Gujarat,
India (hereinafter called as “THE SECOND PART” or “THE LESSE” which
expression shall unless it be repugnant to the context or meaning thereof shall be
deemed to mean and include his legal heirs, successors, executors, administrators,
and assignees).

WHEREAS the first part is lawful sole owner, occupier, and possessor of an Office
No. M-1, admeasuring about 250.00 square feet’s, i.e., 23.23 square meters,
situated on First Floor of the building known as “CHANDRALOK COMPLEX”,
situated at Vapi – Silvassa Main Road, Chanod, Taluka – Vapi, District –
Valsad, State – Gujarat, India (hereinafter called as “THE SAID
PROPERTY”).

AND WHEREAS the second part requested first part to lease the said property for
a period of 5 (FIVE) YEARS and the request of second part is granted by first part
and have desirous to give the said property on lease basis to the second part and for
that certain terms and conditions have been fixed between the parties which are
appearing as under: -

-: TERMS AND CONDITIONS: -

1. The first part has agreed to give on lease basis the said property more
particularly described in the schedule hereunder written to the second part
for a period of 5 (FIVE) YEARS calculating from 1st May 2019 to 30th
April 2024.
2. This lease agreement shall be effective from 01 st day of May 2019 and it
expires on 20th April 2024.

3. The second part hereby agrees to pay monthly lease consideration of amount
Rs. 4,500/- (Rupees Four Thousand Five Hundred Only) per month being
utilization charges of the said property to the first part regularly on 1 st to 10th
day of commencing month.

4. The second part has also paid security deposit of Rs. 5,000/- (Rupees Five
Thousand Only) being security deposit from the first part by cash / cheque
and after expired of the said agreement the said agreement the said security
deposit shall be refundable without carrying interest to the second part.

5. That the second part agrees to pay Electricity Bills, Maintenance Charges,
etc., as may be applicable and are payable from time to time on actual basis
during the tenure of this agreement.

6. That the second part covenants with the first part that will keep the property
in good condition and shall not make any material charges in the said
property without written consent of the first part.

7. On the expiry of this agreement, the second part shall either hand over a
peaceful and vacant possession of the above said property to the first part in
reasonably good condition, or shall renew the agreement, as per mutual
decision, between the party of the first part and the second part.

8. That the second part is not entitled to transfer / sublet the said property to
any person without written consent of the first part.

9. That the second part further covenants with the first part that he will now use
the property for any trade or business or for any illegal purpose and shall not
store any unauthorized or prohibited or hazardous goods in the said property.

10.The second part shall use the said property for his business purpose only,
and during the period of this agreement in the above said property, the
second part shall be responsible for the Civil, Criminal, Social, Government
and Semi – Government Departments liability and in any case the first part
shall not be held responsible for the duration of this agreement.

11.That the second part will not act in any manner, which will create nuisance
or disturbance to other property holders of the building.

12.That the agreement shall come to an end on the expiry of 5 (FIVE) YEARS
unless renewed for a further period.
13.That this agreement can be renewed on the mutually agreed terms for a
further period of 5 (FIVE) YEARS.

14.That, if any party desires to vacate the said premises, in such case, the
concerned part shall give 1 (ONE) MONTH prior notice to the other part in
writing.

-: SCHEDULE OF THE PROPERTY: -

All that piece and parcel of an Office No. M-1, admeasuring about 250.00 square
feet, i.e., 23.23 square meters, situated on First Floor of the building known as
“CHANDRALOK COMPLEX”, situated at Vapi – Silvassa Main Road,
Chanod, Taluka – Vapi, District – Valsad, State – Gujarat, India.

IN WITNESS WHEREOF THE PARTIES HERETO HAVE SET AND


SUBSCRIBED THEIR RESPECTIVE HANDS ON THE DAY AND YEAR
ABOVE WRITTEN.
