Larrazbal, Naval, Biliran

II. MATTERS TO BE INVESTIGATED:

3. To determine the facts and circumstances surrounding the cause of

motor vehicle accident of Mr. Paul Paña, 30 years old, live in, Brgy.
Capul-an, Capoocan, Leyte and Mr. Joemarie C. Deizmo 45 years old
Alemria, Biliran
4. To determine other relevant matters that would require further police
actions.

III. FACTS OF THE CASE:

 5. On or about 3:00 P.M more or less of May 3 2022, an incident of motor
vehicle accident transpired at , Grandstand, Brgy. Larrazbal, Naval,
Biliran wherein the victim was one Mr Paul Paña, 30 years old, a native
of leyte, single and Mr. Joemarie C. Deizmo of Brgy. Look Almeria,
Biliran, married to Mrs. Mabelle Arcenal.
6. According to the witness, Ms. Meljoy Abrigo around 3:00 P.M more or
less she was only five meters away more or less when he saw the
collision of Mr. Paul Paña and Mr Joemarie C. Deizmo and call the
authority.
7. Responding Policemen,Patrol Man Alex Masibag, Patrol Man James
Mathew Sabenorio. recovered a (1) sling bag, black (2) cellphones (1)
oppo (1) realme and (4) front and middle cover of motorcycle.
8. Victim Joemarie who Crossing the intersection with high speed
encounter Victim Paul Paña with with minimum speed causing both
tumble to the ground both unconscious until first responder apply
immediate first aid after arriving at the incident.

IV. INVESTIGATION/ FINDINGS:

9. Initial investigation conducted disclosed that Joemarie C. Diezmo was

the cause of incident over speeding in the intersection used both lane
while not overseeing any other motorist. While Paul Paña did not see
incoming Victim Joemarie cause collisions resulting to damge to
property and physical injury both victims.

V. CONCLUSION:

10. After the investigation conducted, it is hereby concluded that the cause
of collision of Joemarie Diezmo and Paul Paña, Joemarie was at fault
because he used the other lane which is intended for vehicles moving to
opposite dírection and do left turn without seeing the incoming motorist
and violate the right of way of Paña.
 VI. RECOMMENDATION:

11. It is hereby recommended that the case be dropped and closed.

AFFIDAVIT OF WITNESS

I, Meljoy Abrigo, 20 years of age, single, resident of Brgy. Capiñahan, Naval,

Biliran, after having sworn in accordance with law, do hereby and state:
 1. That I was present and personally saw that victim, Joemarie C. Deizmo
and Paul Paña,the collision at Grandstand Brgy. Larrazbal Naval,
Biliran.
2. That around 3:00 P.M more or less, I saw Joemarie Diezmo over
speeding while crossing the intersection.
3. That I tried to contact the police authority after the incident.

I executed this affidavit to attest the truthfulness of the forgoing facts and to
support the filling of motor vehicle accident against Joemarie Deizmo negligence and
improdence resulting to damge of property with physical injury.
