SUBJECT INVESTIGATION REPORT Re: Road accident involving
cruiser rider and a person on foot causing lethal
wounds.

III. FACTS OF THE CASE

7. On a fine morning around 10:00 am of January 4, 2022, two Brgy. Tanods of Talisay
Sorsogon City detailed an occurrence seeking for police assistance on the affirmed
vehicular accident at Rompeolas Coastal Road. PO3 Peter Renegardo was consigned
and returned to the station together with the alleged involved parties.
Upon confrontation at SCPS-CPAC 2 office, Franco Velarde y Quizon, 35 years
old, single, and a resident of Sorsogon City residing at Pangpang Village requested to
put into record that while he was on his way home, he crossed the coastal road at
Rompeolas for he was waiting for a tricycle to go home sooner when a motorcycle
rider using his phone while driving bumped him causing him to fall off the ground
earning fatal wounds and injury on his knees and head.
On the other hand, the rider of the motorcycle Aurelio John Hugo y Garcia,
33 years of age, single, and a resident of Brgy. Sampaloc didn`t escape the scene and
instantly brought the victim to the nearest hospital right after the Brgy. Tanods
obtained their personal information.

8. In the investigation conducted by the duty traffic investigator in the alleged vehicular
incident disclosed that after verification and ocular inspection to the alleged
damages revealed that Garcia caused Quizon injuries at the right knee as he earned
fracture and lethal wound over his right cheek as he slumped through the rough
floor of the road when bumped into the motorcycle. The front side of the motor was
dented as proof that Garcia`s motorcycle strongly bumped Quizon while he was
distracted by his phone while driving the road.

9. During a follow-up investigation by traffic investigators at the scene of the incident,


especially on the road near the Pili sculpture, they discovered that some of the
victim's personal belongings had been left behind. on the ground (like coins, bread
plastic, and hair) while a small piece of motorcycle glass (for light) falls from the
ground. There weren't many people in the area as it was morning so there were no
other witnesses but only parties and protesters calling for police attention.
Garcia admitted his fault by making a statement on his side at the police station
when he was driving irresponsibly when he collided with a pedestrian.

IV. DISCUSSIONS/FINDINGS

10. In the case currently under investigation, both parties have allegations of compliance
related to the case. According to Quizon's account, he was crossing the street just to
wait for a tricycle to return home when a cyclist hit him, injuring him and severely
injuring him. He told police he crossed the street quickly and expected the engine to
stop, but then it hit him. Then, he found out that the driver was using his phone,
that's why he was blurred while driving. On the other hand, the driver admitted to
his irresponsible driving and told the police that he lost control and concentration
because he was on the phone due to an emergency.

V. CONCLUSION

11. After carefully reading the matter, the two sides reached an agreement. The driver
will bear all the medical expenses of the pedestrian and will compensate him for the
damages he has caused. During this time, the victim will no longer drop charges
against the rider and will focus solely on his or her recovery. The rider apologized to
the victim for his irresponsibility and also thanked him for being deeply concerned
about his situation after what happened. The two sides settled at three o'clock in the
afternoon and signed the agreement.
VI. RECOMMENDATION
12. In the event of this incident, no further investigation will be required as the two
parties have resolved the dispute. The victim has just reminded the rider not to use
any items which can distract him while riding so he can fully focus on the road.
According to him, this is to avoid any accidents like what happened to them.
