FACTS OF THE CASE:

That on or about 3 o'clock in the morning of January 29, 2023, this office received
a complaint particularly in Nemis’ residence. Initial investigation was conducted by PO2
Annalyn Ritol, revealed that on above-mentioned time, date and place, while
Christopher Nemis. 25 years old, single, vacationing in his temporary residence at
Navarrete Street, Poblacion, Madalag, Aklan together with his friends Jhon Santos, 25
years old and Ric Smith, 25 years old, temporarily residing at aforementioned address.
Two unidentified malefactors broke into the victim's residence through an unlocked
window and took his laptop, ipad mini and cash of Php 20,000. Upon hearing a noise
outside of his room, Christopher inspected the premises and caught one of the
malefactors clutching his laptop. He yelled for his friends but the two malefactors were
already halfway through the window from which they came in. Christopher tried to
retrieve his laptop but one of the malefactors got the rake from which they use to hold
the window open and beat Christopher’s right leg with it, resulting to slight injury.
Weakened by his injury, the suspects were able to fled away after the incident to an
unidentified direction.

1. On or about October 14, 2023 around 6:20 PM, a shooting incident transpired in front of
Paningayan Elementary School located in Paningayan, Madalag, Aklan. The victim was
identified as one Mauricio Aquero Poblacion, 21 years old, single, a college student of
Aklan State University and a resident of Paningayan, Madalag, Aklan.

2. Initial investigation revealed that the victim was walking along the provincial road when a
lone unidentified gunman aboard a Honda Beat 110, color red, of unknown plate number
suddenly stopped and shot the victim four times in the torso. The unidentified suspect
fled northward towards Jurisdiction, thereafter.

3. The victim Mauricio Aquero Poblacion who sustained multiple gunshot wounds was
rushed to Don Leovigildo N. Diapo Sr. Municipal Hospital but was declared dead upon
arrival.

4. The motive behind the incident is still unknown.

2. DTPO: September 9, 2023, 4:45 in the afternoon at Barangay Pang-itan, Madalag, Aklan.
3. Suspect: RAFAEL AGUINALDO, male, married, 52 years old, DOB: may 10, 1971,
Educational attainment: Elementary graduate, jobless and resident of Barangay Pang-
itan, Madalag, Aklan.
4. Victim: PEDRO CANLAS, male, married, 45 years old, DOB: February 2, 1978, farmer and
resident of Barangay Pang-itan, Madalag, Aklan.
5. Brief Facts of the Incident: At about 5:00 o’clock in the afternoon of September 9, 2023
person of JOSE HERNANDEZ, male, married, 38 years old, (DOB: October 7, 1984 and
resident of Barangay Pang-itan, Madalag, Aklan appeared in this office and reported that
there was a stabbing incident transpired at his place in Barangay Pang-itan, Madalag,
Aklan involving victim identified as PEDRO CANLAS, male,married, 45 years old (DOB:
February 2, 1978), farmer and resident of Barangay Pang-itan of this municipality which
the reportee immediately brought the said victim to Don Leovigildo N Diapo Sr. Hospital,
Madalag, Aklan. Suspect is identified as RAFAEL AGUINALDO, male, married, 52 years old
(DOB: May 10, 1971) born at Madalag, Aklan, jobless, elementary graduate also resident
of barangay Pang-itan, Madalag, Aklan who voluntarily surrendered to Punong Barangay
Juvie Teodosio after the incident and subsequently turned over to this office at about
5:45 in the afternoon of the same date. Investigation disclosed that while the victim and
suspect together with the reportee were having a drinking spree at the latter’s place, the
suspect and the victim had heated discussion regarding their previous issues while they
were still working as cane cutter, later on suspect got irked and stab the victim hitting his
right back thoracic level. Jose tried to pacified them until suspect fled. Victim was further
referred by his attending physician at Dr. Rafael S. Tumbukon Memorial Hospital, Kalibo,
Aklan for medication. Suspect was also brought to Don Leovigildo N. Diapo Sr. Hospital
for physical medical examination and presently under police custody of this office
pending for inquest proceeding. Suspect was also informed of the crime he committed
and appraised of his constitutional rights.

2. BACKGROUND:

This pertains to the information received by this Office regarding the


alleged destruction of properties of Sumitumo Fruit (SUMIFRU) Company Incorporated,
a banana plantation located at Barangay Ma. Cristina, Madalag, Aklan at about 180545H
July 2023, perpetrated allegedly by Criminal Gang known as “Geng Group”.

3. ACTION TAKEN:

Upon receipt of the information through a radio call from Barangay


Captain of Ma. Cristina, Madalag, Aklan, regarding the cutting of some banana hills of
SUMIFRU plantation, and the burning of one (1) unit SK024 small backhoe, personnel
from Madalag Municipal Police Station led by SPO3 Gilbert G Giniseran, immediately
responded/proceeded to Barangay Ma. Cristina, Madalag, Aklan and conducted ocular
inspection/investigation thereat.
This office immediately disseminated said information to all police stations for
their appropriate action and further directed them to be on alert and extra vigilant,
intensify intelligence build-up and monitoring to preempt possible diversionary attack or
hostile action of the enemy to other vital installations, police stations, and other
government troops. COPs of CPS/MPS were also directed to inform/advise the
owners/management on all vital installations, key economic establishments and other
companies who are vulnerable/potential targets of the enemy, to strengthen also the
security of their establishments, respectively.

4. RESULT OF ACTION:

Investigation disclosed that Seven Hundred Thirty-Nine (739) banana hills of


more or less eight (8) months old with an estimated amount of Two Hundred Ten
Thousand Six Hundred Fifteen Pesos (P210, 615.00), owned by SUMIFRU Company
were cut with the use of bolo. One (1) unit of SK024 small backhoe owned by
Benjamin Tan of Davao City was partially burned by the said group. The destruction
of properties was discovered by Kim Sailog and Rex Delos Santos, the farm workers
of said company assigned in the area at about 0545H of same date, who immediately
reported the incident to Mr. Lourence, a company production supervisor.

The incident was accordingly transpired OOA 180200H July 2023 as


determined on the newly grown shoot of banana hills that have been cut. The incident
believed to be perpetrated by the bandits under Dario Acuman and Ramil Bahian,
who were seen roaming and passing at the incident area a day prior to the incident.

Dario Acuman was involved in cattle rustling, highway robbery and illegal
drugs activities. He allegedly handed the extortion letter address to SUMIFRU
company dated March 3, 2023, signed by Alias Aguela, containing the demand in the
amount of Three Hundred Thousand Pesos (P300,000.00), including one (1) M16
rifle with 7 magazines and 200 rounds ammunition; one (1) 45 caliber pistol and 4
magazines.

Appropriate case against the suspects is being prepared by Madalag MPS


in coordination with SUMIFRU management for filing in court.

5. CONCLUSION

The group of Ramil Bahian was reportedly monitored to have been


merging on the group of Acuman to strengthen and to make their new group capable to
perform illegal activities. That due to the denial of the bandits’ demand from SUMIFRU
company through an extortion letter dated March 3, 2023, the said group showed to the
said company that their new group is capable enough to launch hostile actions.

The involvement of NPA on this incident is discounted, considering that in


the Palletizing compound more or less 500 meters away from the crime scene there
were security guards on duty and several heavy equipment were parked, and the group
was not even bothered to destruct and attack the same. Unlike the NPA their usual
modus operandi is to disarm security guard/s and launch burning on heavy equipment,
to cause big damage/impact to malign the government.

6. RECOMMENDATIONS:

This office recommends that an enhanced target hardening measures must


be properly observed by all C/MPS in anticipation of enemy hostile actions and attacks.

Intensify the conduct of Security Survey and Inspections to all vital


installations, key economic establishments and companies who are vulnerable/potential
targets of the enemy.

Security Agencies deployed their security guards in various establishments


must coordinate with the local police units/stations, to establish a sustainable
collaborative effort to defend their employers from hostile actions of the enemy.

1. This has reference to Memorandum Spot Report Re: of stabbing incident that resulted to the
death of Ramon Rodriguez, dated 15 January 2023.

2. On January 15, 2023 at about 8:30 in the evening, a stabbing incident transpired at the
roadside of Poblacion, Madalag, Aklan, wherein the victim is Ramon Rodriguez, 27 yrs. Old,
Married, Accountant, and a resident of Brgy. Panipiason, Madalag, Aklan, was stabbed by the
suspect Pedro Mateo, 38 yrs. Old, Widowed, Construction Worker, and a resident of the same
place.

3. The victim sustained multiple stab wounds in different parts of his body and was rushed to
Don Leovigildo N. Diapo Sr. Municipal Hospital for medical treatment but was pronounced dead
on arrival by the attending physician.

4. The suspect Pedro Mateo, is currently detained at Madalag Police Station and a case of
Homicide in violation of Article 249 of the Revised Penal Code is pending for trial.

5. The case is already raffled at Kalibo Municipal Trial Court.

II. MATTERS INVESTIGATED:

13. To determine the facts and circumstances surrounding the incident that
transpired on or about 12 midnight of June 16, 2023 at Purok 6, Kalibo,
Aklan wherein victim Jasmine Mendoza (NMN), 19 years old, Filipino,
single, nursing student at Aklan State University and presently residing at
Purok 6, Kalibo, Aklan was raped by suspects: John Paul Baluyut, 21
years old, college student, and presently residing at 233 Kalibo, Aklan,
and John Paul Arayat, 34 years old, married, unemployed and a resident
of Lot 1, Blk. 2, Kalibo, Aklan.

III. FACTS OF THE CASE:

14.On June 16, 2023 at around 1:00 a.m., this station received radio
message from PS-4 Mobile Patrol # 143 regarding an alleged rape
incident. Radio message revealed that while conducting mobile patrol
within the area, PCpl Tin and PCpl Birocha was flagged down by Ms.
Marie E Tess seeking assistance to bring her dorm mate to the nearest
hospital. Duty patrollers immediately rushed at the room of the said
dormitory and upon entry they saw Jasmine Mendoza, lying unconsciously
on the floor wearing white T-shirt without panty. Responding policemen
immediately checked the vital signs and confirmed that the woman was
just unconscious. She was then rushed at Provincial Hospital.

15.At 1:30 a.m. PSMS Alad duty investigator, proceeded at Provincial


Hospital, to check the condition of the victim and to provide her statement.
Upon arrival thereat, victim was already conscious thus was able to
provide her statement.

16.She narrated that when these four persons arrived at their dormitory on or
before 11:00 p.m., her roommate, Marie E. Tess was still there, she invited
her to join them in their drinking spree but the latter refused as she
claimed to be meeting another friend nearby. After Marie E. Tess left, she
and four others started to drink Alfonso Brandy. At around 11:30 p.m.,
Yuda Wan and Vincent Zo left also, so only she and two others she
identified as John Paul Baluyut and a certain John Paul Arayat stayed
inside the room and continued drinking. Further inquiry disclosed that she
felt drunk and before losing her consciousness, she remembered John
Paul Baluyut forcing his penis into her mouth. She tried to resist and shout
for help but the two strongly hold her hands and shut her up by putting
their fingers into her mouth. After a while, she became exhausted hence
allowing them to consummate their sexual desires. When she woke up,
she was already in a hospital feeling pain in her vaginal part.

17.Victim was subjected for Genital Examination at Philippine National Police


Crime Laboratory Office Camp.

18.Follow-up operation was conducted by the elements of this station.


Suspect John Paul Baluyut who according to the victim, is a student of
Aklan State University wherein she provided personnel of this station
photographs of the said person or suspect from her cellphone served as
basis to positively identified him and effect his arrest in a fast-food store
beside the University campus.

19.Based on the information provided by suspect John Paul Baluyut, suspect


John Paul Arayat was also arrested at his residence located at 111 Alfonso
St., Barangay 141, Kalibo, Aklan with the assistance of barangay officials.

20.Upon arrest, suspects were informed of the offence they allegedly


committed in a Filipino language clearly understood, known and spoken
by both of them. As a standard operating procedure, suspects were
brought at the Ospital ng Kalino for physical examination. Thereafter, they
were brought to this station for disposition.

21.A criminal complaint for rape under Art. 266-A of the Revised Penal Code
as amended by RA 8353 against suspects John Paul Baluyut and John
Paul Arayat was referred at the Office of Provincial Prosecutor for inquest
proceedings.

22.In the afternoon of June 16, 2023, witnesses Marie E. Tess, Yuda Wan,
and Vincent Zo, proceeded to this Station and executed their sworn
affidavits. All of them positively identified the two male persons who were
earlier apprehended by personnel of this Station as John Paul Baluyut and
John Paul Arayat.
23.On June 16, 2023, victim Jasmine Mendoza executed her Complaint-
Affidavit indicting both John Paul Baluyut and John Paul Arayat of the
crime of Rape.

IV. DISCUSSION

24.Based on the facts presented, it appears that both suspects were drunk at
that time they committed the crime. Suspects took advantage of the
weakness of the victim who was also drank at that time in consummating
their lewd designs. As such, although there was resistance on the part of
the victim, however due to the effects of alcohol, she was prevented from
doing so hence the consummation of the offense charged.

V. CONCLUSION:

Based on the foregoing, the positive identification of the victim and as


corroborated by the testimonies of witnesses namely Marie E. Tess,
Yuda Wan and Vincent Zo there exist a probable cause that a crime of
Rape was committed against the victim. Furthermore, result of the
Genital examination conducted by a Government License Physician
being considered as a Public Document affirms that the crime of rape
as defined and penalized under Art. 266 paragraph B as amended by
RA 8353- Anti Rape Law of 1976 was committed.

VI. RECOMMENDATION:

25. WHEREFORE premises considered, undersigned recommends the


referral of the case before the Office of the Provincial Prosecutor for filing
of appropriate charges against suspects John Paul Baluyut and John Paul
Arayat in court.

3. Please be informed that showdown inspection was conducted


initially by this office to Kalibo MPS, QPPSC Headquarters, Tiaong
MPS on firearms and PNP mobility last February 26, 2022.
Succeeding inspection was conducted to Gumaca MPS, QPPSC 4th
Maneuver Platoon and Plaridel MPS on March 11, 2022
respectively. Availability of all PNP personnel with issued firearms
were all accounted to include their on-stock firearms. Personnel
who were on official functions that were not able to show their
firearms for inspection was directed to report to this office for
proper inventory and accounting.

MARPSTA led by SPO2 Jessie R Ligutan conducted Dialogue/Ugnayan with
the residence of Barangay Lablab, Balete, Aklan .Topics discussed on said
activity is the Implementation of LOI “KONTRA BOGA” against loose firearms
and Intensification of the implementation of LOI “SITA”, Operation “BAKAL”,
operations for the Summer Vacation (SUMVAC), Lenten Season, “Intensity
Drive Against Criminality”, “all Forms of Illegal Gambling”, “Fewer Desk
COPS”, “more Patrolmen”, “Gun-Proficient COPS” and other Police security
operations. The said activity ended at 11:00 o’clock same date.

At about 8:30 o’clock in the morning of 27 March 2020, the


undersigned attended the Conference held at PRO2 Conference Hall,
presided by the Regional Director, PCSUPT RODRIGO PURISIMA DE GRACIA
