1. AIMS & OBJECTIVES OF THE COURSE


Constitutional Law has grown to become the most important subject in the Law School
curriculum, as it provides the foundation upon which all other laws derive their legitimacy and
function. In studying the subject, an attempt is made to give some idea of the fundamental and
essential nature of the law that is basic to virtually all countries in the world. We will thus be
concerned with both the substantive content, as well as basic aspects of the law. Furthermore, we
shall explore the relation of Constitutional law to its subsidiary elements (viz., legislation). We
will also examine the link between basic law and the populace at large (i.e. the question of human
freedoms and individual rights), and look at the procedure for the enforcement of human rights.
The main issues examined in the course are the instruments of state governance (the Executive,
Legislature, and Judiciary), the divisions between them, and their relationship to the ordinary
citizenry in the country. Students are thus urged to keep abreast with recent and past
developments in the arena of statehood and political life in Uganda, the sister East African
countries of Kenya, Tanzania (and Zanzibar), and the world at large. There is no set text for this
course. However, it employs a multiplicity of sources. Selected cases and other materials deemed
essential for the course will be availed for photocopying at a cost at the Book Bank machine
(some of these are indicated with a preceding asterisk (*). Every student must have a copy of the
1995 Constitution of the Republic of Uganda (as amended).

2. EXPECTED OUTCOMES
By the end of the course, students will be expected to have grasped the basic elements of
Constitutional Law, to appreciate its over-arching character in relation to ordinary legislation; to
fully comprehend the main principles (Rule of Law, Separation of Powers, and Fundamental
Human Rights) and to be able to apply the key principles of Constitutional Interpretation.

3. COURSE DURATION and OUTLINE OF TOPICS


The course lasts 15 weeks and covers the following seven (7) topics, viz., The Nature of the
Constitution; Classifications of Constitutions; General Principles; Citizenship; Branches of
Government; Constitutional Interpretation; and Human Rights & Freedoms.
