MORTGAGE DEED

THIS DEED OF MORTGAGE is made and executed on this 28th Day of January,
2022, by and between:
1) SRI. VALAKONDA RAJESH S/O VALAKONDA VASTHWANATHAM, Age:40 Years,
Occ: Business, R/o H.No.9-46, Near Post Office, Kaverammapeta Village, Jadcherla
Mandal, Mahabubnagar District, Telangana State.
(Aadhar No.7330 7019 9877).
2) SRI. VALAKONDA VENKATESH S/O VALAKONDA VASTHWANATHAM, Age:37
Years, Occ: Business, R/o H.No.9-46, Near Post Office, Kaverammapeta Village,
Jadcherla Mandal, Mahabubnagar District, Telangana State.
(Aadhar No.6439 6256 2484).
(Hereinafter called the "MORTGAGOR's" which term shall mean and include all
their heirs legal representatives, executors, assignees, etc., of the One part).
IN FAVOUR OF
COMMISSIONER OF MUNICIPALITY, JADCHERLA, MAHABUBNAGAR DISTRICT,
TELANGANA.
(Hereinafter called the "MORTGAGEE" which term shall mean and include all its
heirs legal representatives, executors, assignees, etc., of the One part).

Whereas the above said mortgagor is the absolute owner and possesor of
the Plot no. 17 & 19 in Survey No. 307/A, total admeasuring 456.23 sq.yards situated at
Jadcherla Village & Municipality, Jadcherla Mandal, Mahabubnagar District, Telangana.
That the said Mortgagor has purchased the said plot from its earlier owner SMT. R
SHARADA through Registered sale deed document no 5559/2021 in the office of
SRO Jadcherla.
WHEREAS the mortgagor has applied for buildig permission for proposed construction
of Residential Building and Whereas the MUNICIPALITY, JADCHERLA has provisionally
approved the sanctioned plan in respect of proposed construction of Residential
Building STILT + THREE floors on plot no 17 & 19, in Survey No.307/A, total
admeasuring 456.23 sq yards Situated at Jadcherla Village & Municipality, Jadcherla
Mandal, Mahabubnagar District, Telangana State, with a total plinth area of 605.58 sq
meters.
AND WHEREAS THE MORTGAGOR hereby authorizes the COMMISSIONER,
MUNCIPALITY, JADCHERLA to enforce the terms and conditions of G.O.Ms.No.168, M.A.
Dated 07/04/2012, in case of voilation of the terms and conditions of the sanctioned
plan granted/permitted, to initiate summary demolition proceedings in respect of the
violated portion.
AND WHEREAS in compliance to the said G.O . Ms. No. 168, M.A. Dated 07/04/2012,
the MORTGAGORS do here y hand over the 10% of the total built up area, i.e. 60.55 Sq.
Mtrs., in THIRD FLOOR, as shown the plan attached herewith (out of the total
admcasuring area 605.58 Sq. Mtrs.) of the proposed Building on Plot No. 17 & 19,
in Survey No.307/A, total admeasuring 456.23 Square Yards Situated At Jadcherla Village
& Municipality, Jadcherla Mandal, Mahabubnagar District, Telangana State, with a total
proposed built up area 605.58 Sq. Mtrs.., (more fully described in the schedule
hereunder), to the COMMISSIONER, JADCHERLA MUNICIPALITY by way of this
undertaking in case the MORTGAGORS violated the terms and conditions of the
sanctioned.
The MORTGAGORS here by authorize the COMMISSIONER, MUNICIPALITY,
JADCHERlA to 10% of the total Built up area i.e. 60.55 Sq·. Mtrs., more fully described in
Schedule hereunder, as shown in the drawing nclosed by way of sale after duly
removing the violated/deviated portion and if any such action is Initiated by the
COMMISSIONER, MUNICIPALITY, JADCHERlA for the violation committee, the
MORTGAGOR shall have no objection of what so ever nature.
NOW THIS DEED WITNESSETH AS FOLLOWS:-
1) The MORTGAGOR hereby undertakes that as per the sanctioned plan, the
MORTGAGOR will leave the prescribed setbacks or open spaces and the area for the
road widening and in case of falling to comply those conditions, the MORTGAGOR
hereby authorizes the COMMISSIONER, MUNICIPALITY, JADCHERLA to remove at
the cost of the MORTGAGOR.

2) And whereas in compliance of G.O . Ms. No. 168, M.A. Dated: 07/04/2012, the
MORTGAGOR has obtained a comprehensive Building Insurance Policy as stipulated
under the said G.O. and In case of failure in obtaining policy, the COMMISSIONER,
MUNICIPALITY, JADCHERLA Is hereby authorized to initiate appropriate action for the
violation of the said terms and conditions in accordance with the G.O. Ms. No. 168 M.A,
Dated: 07/04/2012.
3) And whereas the MORTGAGOR does hereby undertakes that she will not deliver
thepossession of any part of bulltup area of the proposed building to be constructed
by virtue of the provisional sanctioned plan granted by the COMMISSIONER,
MUNICIPALITY, JADCHERLA at the site by way of sale/lease unless and until the
occupancy certificate action for the violation of said terms and condition in accordance
with the G.O . Ms. 168 M.A. Dated: 07/04/2012.
4) The MORTGAGOR does hereby further undertake that they will comply with all
those terms and conditions imposed by the COMMISSIONER, MUNICIPALITY,
JADCHERLA pursuant to the building application for the proposed sanctioned plan
granted to the MORTGAGOR.
SCHEDULE OF THE PROPERTY
All that the 60.55 Sq. Mtrs., in THIRD FLOOR, as shown the plan attached herewith {out
of the total admeasuring area 605.58 Sq. Mtrs.) of the proposed Building on Plot No.17
& 19, in Survey No. 307/A. total admeasuring 456.23 Square Yards Situated At
Jadcherla.

The MORTGAGOR hereby solemnly affirms and certifies that they has executed
this Mortgage Deed with their free will and consent and without any duress or undue
influenceor coercion on the day, month and year first above mentioned in the presence
