 R 3 : These Regulation shall apply to all places of


work.
 The compliance with these Regulation shall be
deemed to have complied with the provisions of:
 Section 32 of OSHA 1994
 Section 31 and 32 of FMA 1967
 Regulation 13 of Petroleum (Safety Measures)
(Transportation of Petroleum by Pipelines) Regulations
1985
 Regulation 23 of CIMAH Regulations 1996

Section 32(1) OSHA 1994 requires employer to notify


the nearest OSH office if any of the following has
occurred or is likely to occur:-
 accident
 dangerous occurrence
 occupational poisoning
 occupational disease

 Regulation 23. Notification of major accident.


 Where a major accident occurs on a site a manufacturer shall
notify the occupational safety and health office of the accident
by the quickest means available and provide-
 (a) the following information relating to the accident as soon
as it becomes available:
i. the circumstances of the accident;
ii. the hazardous substances involved;
iii.the date available for assessing the effects of the accident on persons
and the environment; and
iv. the emergency measures taken; and
 (b) steps envisaged to alleviate medium or long term effects
of the accidents, and prevent the recurrence

Section 31 FMA 1967requires occupier to report by


quickest means to the nearest inspector the
occurrence of any accident which:-
 cause death
 cause bodily injury that prevent a person from doing his normal work
for more than 3 clear days
 causes serious damage to property or machinery
 any dangerous occurrence

 with the least possible delay submit a written report


in prescribed form

 Duty of registered medical practitioner


 Section 32 requires every registered medical practitioner
attending on a patient he believes to be suffering from
any of the diseases named in the 3rd Schedule and
contracted in a factory to send a notice to the Chief
Inspector, giving all the particulars of the patient and his
employment, and a copy to his last employer
 Penalty under Section 51(2) : RM 50,000 or 1 year
imprisonment or both

Transportation of Petroleum by Pipeline, Regulation 13(1):


The owner, operator or contractor of a pipeline shall immediately notify
the Approving Authority of -
a) any dangerous occurrence which may affect the safety of any pipeline
while it is being installed or operated; and
b)any gas leak which-
i. causes death or personal injury requiring hospitalisation of any person;
ii. requires the taking of any segment of a pipeline our of service;
iii. results in gas ignition; or
iv. represents an existing or probable hazard to persons or property.

 Reporting of any death, injury or condition of a person


shall not apply to a patient when undergoing treatment
or surgery by a doctor or dentist.

 Whenever any accident arising out of or in connection with


work which caused:
◦ Death; or
◦ Serious bodily injury (First Schedule) which prevents the
person from following his normal occupation for more than
4 calendar days; or
◦ When a dangerous occurrence (Second Schedule) takes place
(includes CIMAH & Petroleum Safety)
The employer shall notify the nearest DOSH by the quickest
means available, and within 7 days send a report in an
approved form (JKKP 6)

 When an employee, as a result of an accident arising out


of or in connection with work suffers an injury which
causes death within 1 year of the date of the
accident the employer shall inform the Director
General in writing of the death as soon as it comes to his
knowledge whether or not the accident has been reported
earlier.

 Self-employed person who is injured at his own


premise is exempted from reporting by the
quickest means but still need to make arrangements
for the report (JKKP 6) to be sent to DOSH by
other person

Sila huraikan apa yang berlaku sebelum, semasa dan selepas kejadian.
THE ACCIDENT VICTIM WAS AN ASSISTANT TO THE TRUCK DRIVER
THE VICTIM WAS OPENING THE SIDE GATE OF THE TRUCK.
THE ROLLS WHICH WERE NOT TIED DOWN PROPERLY, CAME TUMBLING DOWN, CRUSHING THE VICTIM
THE FORKLIFT DRIVER CALLED FOR HELP AND THE VICTIM WAS REMOVED FROM THE SCENE AND SENT TO
HOSPITAL. HE WAS PRONOUNCED DEAD ON ARRIVAL.

 When a person at work suffers or likely to suffer


from one of the occupational poisonings or
occupational diseases listed in Third Schedule :

 Self-employed suffering from occupational


poisoning or disease listed in Third Schedule can

 At scene of accident that causes death, serious bodily


injury, serious damage to property and dangerous to
plant, - no person shall remove or in any way interfere with
or disturb anything related to the incident, unless
authorised to do so.
 But he can do the necessary action such as:
◦ To save life , prevent injury or relieve suffering
◦ Maintain access of general public to essential services
◦ Prevent further damage or serious loss of property or
impact to environment

 Every employer shall maintain record of all accidents,


dangerous occurrences, occupational poisonings and
occupational diseases that had occurred related to work
under his control whether or not the incident had been
reported, in a register in an approved form – JKKP 8
 The extract from the registry for a period of 12 months
ending 31 December of each year to be sent to the
Director General before 31 January of the following
year
 The record shall be kept at the place of work or business
for at least 5 years.

 The Director General may require persons to


furnish further information with regards to the
accident, dangerous occurrence, occupational
poisoning and occupational disease reported.

 NADOPOD is made under S 66 OSHA, and therefore


penalty = S 51 General Penalty OSHA : RM 10K or 1
year imprisonment or both

 Penalty for not reporting accidents or damage to


machinery under revised FMA S 31: RM 100K
or 2 years imprisonment, or both

 Regulation 16 Transportation of Petroleum by


Pipeline Regulations : RM 20K, and in the case of
continuing offence, RM 5K per day.
