WARRANTY TERMS AND CONDITIONS
1. This warranty covers product replacement costs on a square meter basis of the portion of the installed
Product/s proven to be defective due to manufacturing defects up to the original purchase price of the Mapei
Products calculated on a square meter basis.

2. MAPEI assumes no responsibility for any failure resulting from the following causes:
a) non-compliance with guidelines regarding application and storage of the MAPEI Products and not using
the Product/s within its specified shelf life;
b) application under ambient conditions which are not in accordance with product data sheet advice
including weather, temperature, humidity and dew point limitations, as well as incorrect application
methods including surface preparation, mixing, curing, etc., by a third party applicator, whether or not in
the presence of Mapei personnel;
c) alterations or additions or repairs to the said Mapei Products;
d) structural defects, substrate movement and/or substrate quality not meeting the requirements as set
forth by Mapei, including but not limited to disintegration of the substrate, faulty design or quality of
the construction on which the Mapei Products are applied;
e) leakages from expansion joints unless these joints are waterproofed with Mapeband TPE;
f) external factors such as acts by third parties or acts of nature such as flood, fire, lightning, earthquake,
etc., or structural settlement or movement;
g) exposure of the Mapei Products to contact with incompatible substances or materials;
h) wear and tear, including aesthetical changes in the Mapei Product/s;
i) placement, erection and or construction of any form of installation onto or through the Product/s after
the application of the Product/s is completed;
j) poor or negligent maintenance and/or housekeeping;
k) accidental or intentional misuse and/or abuse of the installations for the products described in this
warranty;
l) changes to intended service conditions.

3. Colour or shade variations of the Product/s are not covered under this warranty.

4. There are no warranties, conditions, terms or representations expressed or implied offered by MAPEI
covering the said Product/s which are binding on the parties other than the present warranty contained and
described herein.

5. This Warranty represents the full and complete agreement between the Beneficiary and Mapei in respect of
Mapei’s liabilities arising out of defects in the Product/s for which Mapei is responsible, and over-rides any
other provision in any other agreement, oral or written, between the Beneficiary and Mapei.

6. This warranty does not cover any loss of income, loss of actual or anticipated profits, loss of business, loss of
contracts, loss of goodwill or reputation or any consequential loss of any kind howsoever arising.

7. This warranty becomes null, void and of no effect if MAPEI is not notified in writing within 3 (three) working
days of the discovery of any alleged manufacturing defects and/or if Mapei is not provided reasonable access
to inspect the alleged defects. The notification to Mapei shall include:
a. location/s of Mapei Product/s;
b. type/s of failure;
c. batch number/s of the Mapei Product/s;
d. a copy of this product warranty.

8. No repair measures shall be carried out without the express consent and prior written approval from MAPEI
and all reasonable measures to limit existing damage or prevent imminent damage shall have been taken.

9. This Warranty shall apply only to Mapei Product/s applied for the Project.

10. This warranty shall only become effective upon MAPEI having received full payment for all the Products
covered under this warranty.

11. This Warranty is governed by the material laws of Malaysia and the parties submit to the exclusive
jurisdiction of the Malaysian courts to resolve any disputes arising out of or in connection with this Warranty.
