First of all, we wish to emphasise that based on our current spreading rate of pandemic Covid-19 throughout entire Sabah State since September 2020 and now whole Malaysia, it had seriously affected the entire construction industry and a lot of restriction of crossing district at initial stage then follow with the rule and regulation limiting the fifty percent (50%) manpower in rotation basis and also limitation of working hours (up to 6pm only) for daily operation until todate January 2021. The CMCO for entire Sabah had begun since 9" October 2020. With our current financial progress 29.86% and physical progress 26.38% up to period ‘ending 25" December 2020, we would like to serve our notice and apply for 2nd Extension of Time with the following factors and justification which physically delaying the site progress. 1. Delay due to Outstanding and New Land Acquisition + Refer to all site progress meeting and updated by Excel Consult Mr. Alberto Brawijaya and consultants, since the commencement of this project, there are additional land acquisitions required especially for the sections from Benoni Interchange CH105+800 - CH107+300 and also Bongawan Bridge CH85+125 - CH85+600 which seriously affecting the relocation progress of existing utilities line and also long section from CH93+825 — CH94#175 beside the others pockets land not mentioned but still pending for acquire and compensation which delaying the handing over for site possession as per attached report and record. (Please refer the updated Additional Land Acquisition Drawings issued by by Consultant Engineer, Perunding Puncak Anugerah dated on 4" January 2021 which it covered 66 pcs new land acquisition prepared by Mr. Alberto Brawijaya and original 18 pes land acquisition highlighted during our progress meeting.) Our Ref. Delay in Demolition of Existing Structure Refer to our earlier letter ref : PKM/PBJKR 85-28/1/1/1.2 (410) Vol.4 dated on 12nd November 2020 highlighted the existing remaining structures which are still delaying the handing over for site possession and also affecting the continuity of work in progress. In our record, there are 160 structures either predominant or non-predominant with current progress with 100 demolished and remaining 60 structure to be resolved. 3. Delay due to Inclement Weather Refer to our earlier letter ref : PKM/PBJKR 85-28/1/1/1.2 (361) Vol.3 dated on 15" September 2020 highlighted the inclement weather condition. As explained in our earlier letter, the number of raining days from June to August 2020 just after 3months MCO (March - May 2020) recorded 63 raining days among 3 months period (average 21 raining days per month). Now we wish to update the raining days from September to December 2020 with total raining day showing 87 raining days based on Jabatan Methorologi Malaysia (Sept-Nov 2020 61 raining days) and Daily Weather Record verified by SOR representative (Dec 2020-26 raining days) among 4 months period (average 21.75 raining days per month). Based on our monthly interim claim, the earthwork achievement between June — August 2020 was 219,481 m3 as reported. Worst then for month September — December 2020 with comparable average 21 raining days per month, the achievement of earthwork is only 243,105 m3 [Sept — Dec 2020]. Todate we still having outstanding earthwork of 1,026,589 m3 from total earthwork quantity of 4,239,029 m3 covered replacement, embankment and surcharge fill, to complete based on contract BQ provision. For record purpose, during the mentioned periods of June ~ Dec 2020, we have maintained our original resources with full set of heavy machineries, manpowers and dump truck lorries on site (Please refer to our submitted monthly progress report June — Dec 2020 for further detail information) 4. Delay in relocation of existing utilities (SESB, Jabatan Air, Telekom, Celcom & Petronas) Refer to our earlier letter ref : PKM/PBJKR 85-28/1/1/1.2 (397) Vol.3 dated on 13!" October 2020 highlighted the delays in relocation of existing utilities due to the above mentioned issues under Item 1 # Delay due to Outstanding and New Land Acquisition and also item 2 # Delay in Demolition of Existing Structure 21 Our Ref PKM/ PB/JKR 85-28/1/1/1.2 (529) Vol. 5 Date 28th January 2021 PROJECT : PELAKSANAAN PROJEK LEBUHRAYA PAN BORNEO SABAH - WP04 : Menaiktaraf Jalan Dari Bongawan Ke Papar CONTRACT No : KKR/BPP/24/2019 SUBJECT EXTENSION OF TIME (2%°) * Another issue is causing the delay due to the additional work required which included in our submitted Variation Order works as recorded in our earlier correspondences letter ref PK/PB/JKR/85-28/1/1/1.2 (140) Vol. 1 dated on 31.03.2020 for VO 2 and letter ref PK/PB/JKR/85-28/1/1/1.2 (402) Vol. 4 dated on 20.10.2020 for VO 8 related to Jabatan Air Pipeline, follow with the letter ref PK/PB/JKR/85-28/1/1/1.2 (141) Vol. 1 dated on 31.03.2020 for VO 3 and letter ref PK/PB/JKR/85-28/1/1/1.2 (279) Vol. 1 dated on 22.07.2020 for VO 3A related to SESB fiber optic cable and LV cable which are not included in original design. Without relocating the existing services line, it had delayed our earthwork and geotechnical work significantly. * _Itis affecting the continuity of the construction from CH85+125 — CH92+000 and also CH105+800 ~ CH107+720 5, Outstanding Appointment of Petronas Licensed Subcontractors * Refer to your issuance of Construction Drawing Rev 0 and Bill of Quantities ref JKR.PPR:600-31/1/60/UTW/JId.2/4 dated on 10" August 2020. We have not able to obtain the minimum three (3) tenderers as per standard requirement. There is only one (1) tenderer named Sindaya Sdn Bhd submitted their bid on October 2020 but the validity of their Petronas license was expired. * During our November 2020 Utility meeting with all respective utilities vendors chaired by KPP Tuan Mohd Shamsul Nizam Abdul Wahid, we have reported that all the potential local Sabah Petronas Registered Licensed Subcontractors HSAP Sdn Bhd, Hyperwave System Engineering Sdn Bhd, and Strive Force Sdn Bhd shown no interest to participate our tender invitation. (Please see our issuance of invitation letter). We have proposed to publish the tender invitation through the Local Media of Newspaper but asked to hold and wait for the further discussion between JKR and Petronas in finalising both parties’ agreement. We are now seeking JKR direction whether WPC can engage any local civil work contractors for the works. * It affected the handing over for site possession from CH96+100 - CH96+377 to Kimanis Bridge Abutment A due to the require passing through Petronas Pipeline. For record purpose, SESB has just planned to relocate their fiber optic and also Jabatan Air to relocate the pipe bridge at the month end of Jan 2021 after they managed to take the site possession with the DID approval under New Land Acquisition. {As such we plan to continue the remaining Bored Piling on 5 February 2021 instead of 14" October 2020. With the such delay in relocation activities with about 4 months, the completion of Bongawan Bridge now should be 2% Feb 2023 instead of 25" September 2022 Explanatory Note No. 2 Nyaris Nyaris Bridge Original Completion is on 25" September 2022 But due to the delay of relocation of utilities especially SESB For record purpose, SESB has just planned to relocate their fiber optic LHS ONLY at the month end of Jan 2021 ‘As such we plan to continue the remaining Bored Piling on 7 January 2021 instead of 21" October 2020. With the such delay in relocation activities with about 2.5 months, the completion of Nyaris, ‘Nyaris Bridge now should be 8th De¢ 2022 instead of 25" September 2022 Explanatory Note No. 3 Mandahan Bridge Original Completion is on 20" December 2021 But due to the delay of relocation of utilities especially SESB, Telekom, Celcom For record purpose, SESB has just planned to relocate their fiber optic LHS ONLY at the month end of Jan 202 1with Telekom & Celcom on Dec 2020 As such we plan to continue the remaining Bored Piling at LHS on 15" January 2021 instead of 23 November 2020. With the such delay in relocation activities with about 2 months, the completion of ‘Mandahan Bridge now should be 14" February 2022 instead of 20" December 2021. However, it still falls under original completion period before 25th September 2022 under Ist EOT. Explanatory Note No. 4 Kelatuan Bridge Original Completion is on 18" September 2021, But due to the delay of the completion of Pile Embankment due to the existing structure still pending. to demolish and we only able to complete the pile embankment with Nehemiah Reinforced Soil wall with permanent pavement work on 10" March 2022 instead of 18" September 2021, approximately 5.5 months delay. The completion of Kelatuan Bridge now should be 10" March 2022 instead of 18" September 2021. However, it still falls under original completion period before 25" September 2022 under 1* EO APPLICATION OF EOT NO. 2 UP TO 25" AUGUST 2023 [EXPLANATION NOTE] Explanatory Note No. 5 Kimanis Bridge Original Completion is on 25" September 2022 But due to the delay of the site possession until todate, we are only able to plan for Abutment A site Clearing and complete on 3% July 2021 instead of original 19" November 2020 ( Delay about 7.5 months) due to current issue of structure demolition and petronas crossing at CH96+165 ~ CH96+300. Furthermore, we plan to enter for Abutment B Bored Pile work on 8" April 2021 instead of original 26" October 2020 about 5.5 months delay, providing crossing issue of Petronas Pipeline at CH96+300 and Demolition of existing structure can be resolved on time. The completion of Kimanis Bridge now should be 13% May 2023 instead of 25" September 2022 Explanatory Note No. 6 Benoni Bridge Original Completion is on 18" November 2021 But due to the recent CMCO starting 9" October 2021 until todate with earlier limitation of working hours and 50% workforces as per SOP, we have rescheduled the completion date to 29" November 2021 instead of 18" November 2021. However, it still falls under original completion period before 25!" September 2022 under 1* EOT. Explanatory Note No. 7 Kimanis Interchanges Original Completion is on 8" October 2021 But due to the recent CMCO starting 9" October 2021 until todate with earlier limitation of working hours and 50% workforces as ner SOP, we have rescheduled the completion date to 8" February 2022 instead of 8" October 2021 with four (4) months delay. However, it stil falls under original completion period before 25" September 2022 under 1" EOT. Explanatory Note No. 8 Benoni Interchanges Original Completion is on 25" September 2022 But due to pending the finalization of new land acquisition and relocation of existing utilities services line which affecting the bored pile construction and also temporary traffic diversion, we have rescheduled the commencement date on 22" April 2021 for Bored Test Pile instead of original 16 October 2020 and at same time getting the final approval in Traffic Control Plan as soon as possible. ‘As such the revised completion date now to be 24" December 2022 instead of 25'" September 2022 with two and half (2-1/2) months delay since we have ready all 14 pcs Post Tension Beam at our fabrication yard. APPLICATION OF EOT NO. 2 UP TO 25" AUGUST 2023 [EXPLANATION NOTE] Explanatory Note No. 9 Pedestrian Bridge Original Completion is on 13" November 2021 But since this pedestrian bridge is located at the roadwork section 11 with geotechnical work of PVD Drain and Surcharge, without completion of both geotechnical work at this widening section after the resting period, we would not able to start the construction. Since the surcharge for section 11 will only complete 17" November 2021 or earlier, therefore we plan to start the construction of pedestrian bridge on 18" November 2021 and complete within ‘S8months period on 11" July 2022. However, it still falls under original completion period before 25th September 2022 under 1st EOT. For information, the current roadwork section 11 are still affected by the relocation of existing utilities and also new land acquisition pending finalization APPLICATION OF EOT NO. 2 UP TO 25™ AUGUST 2023 [EXPLANATION NOTE] Explanatory Note No. 10 Roadwork Section 1 CH85+125 — CH86+526 Original Completion is on 25" September 2022 But due to the delay of relocation of all existing utilities (SESB, TM, CTSB, JA Pipeline), new land acquisition and delay in demolition of existing structure along this section, it had seriously affected the sequence of work and work planning. From CH85+450— CH85+700 with PVD drain, although it was partially completed at Year 2019 but we are not able to fully complete due to existing overhead cable and underground pipeline which affected by the new land acquisition at CH85+125 ~ CH85+675 RHS/LHS and also existing structure. Todate, there are still overhead cable 11kV and 33KV with Fiber Optic from CH85+125 ~ CH86+800 RHS affecting our earthwork and geotechnical work. At LHS from CH85+125 - CH86+526, it still pending the relocation of Jabatan Air pipeline at month January 2021 and outstanding demolition of existing structure at CH86+225 (RI7A Car wash and R17 restaurant) which affecting our earthwork and geotechnical work beside the earlier delay in relocation of TM, CTSB and SESB fiber optic. Without completing the widening section for traffic diversion, we would not able to divert the traffic into the new alignment and start to upgrade the existing pavement with major culvert crossing AAs such we assume that all the utilities and outstanding structure can be resolved on or before 30" April 2021, then we should able to resume and continue the remaining remove and replace (Act ID 368) under geotechnical work on 3rd May 2021 and complete on 25' June 2021 instead of 22" August 2020 (10 months delay) prior PVD drain and also surcharge especially CH85+450 ~ CH85+750 RHS and CH86+225 LHS start progressively. We are only able to fully complete the widening section for the above mentioned roadwork section 1 on 19th December 2022 (Act ID 384) after considering the 6 month resting period from last surcharge 24" December 2021 (Act 1D 372) prior resting period and also culvert construction after resting period. We should also consider the completion of LHS Bongawan Bridge on 23" Feburary 2022 and LHS Nyaris, Nyaris Bridge on 7" January 2022 ‘As such after fully diverting the traffic to new alignment on earlier January 2023, without consider surcharge at existing highway /existing pavement, we still require 210days to complete the upgrading of existing alignment inclusive of rip off the existing seal pavement, earthwork, culvert construction, pavement work etc in order we can complete the upgrading on 25 August 2023. Explanatory Note No. 11 Roadwork Section 2 CH86+526 — CH88+900 Original Completion is on 17 February 2022 But due to the delay of relocation of all existing utilities (SESB and JA Pipeline which pending VO approval), it had affected the sequence of work and work planning, The existing fiber optic cable and also underground JA pipeline along the existing highway and within limit of work, it affected the construction of new major crossing culvert even until todate. Secondly the delay in demolition of existing structure especially JP1 at CH87+450, we assume that the said structure can be removed on or before 10" May 2021 in order our embankment fll and surcharge fill at this section can fully complete on 16" July 2021 instead of original 21% July 2020 (about 12months delay provided JP1 can be resolved before 10" May 2021) As such, the revised completion date now to be schedule on 2% December 2022 instead of original 17° February 2022. APPLICATION OF EOT NO. 2 UP TO 25™ AUGUST 2023 [EXPLANATION NOTE] Explanatory Note No. 12 Roadwork Section 3 CH88+900 — CH92+000 Original Completion is on 30” June 2022 But due to the delay of relocation of all existing utilities (SESB which pending VO approval and also JA pipeline) although TM/CTSB just managed to settle at the end of December 2022, it had affected the sequence of work and work planning. Secondly the delay in demolition of existing structure especially R54, RS4A-F at CH90+250, RSS at CH90+300, RS7 at CH901575, RSB at CH90+600, RES at CH91+450 beside others still in progress to demolish, we assume that those structure can be removed on or before 25"* May 2021 in order our ‘embankment fill and surcharge fill at this section can fully complete on 9" August 2021 instead of original 19" January 2021 (about 7 months delay provided all mentioned structures can be resolved before 25" May 2021) As such, the revised completion date now to be schedule on 13" January 2023 instead of original 30” June 2022, Explanatory Note No. 13 Roadwork Section 4 CH92+000 — CH94+200 Original Completion is on 25" September 2022 ‘The main delay in this section due to the outstanding Land Acquisition issue for Land No CLO25331604 from CH93+825 — CH94+175 (whole section) to be gazetted as highlighted in our letter PKM/PB/JKR 85-28/1/1/1.2 (023) Vol .1 dated on 26" December 2019. We assume that the said issue can be resolved before we plan to start the construction of PVD drain on 3 March 2021 instead of original 26" October 2020 and surcharge with resting period can be completed on 22th April 2022 instead of original 27" September 2021 (about 7months delay) As such, the revised completion date now to be schedule on 14" April 2023 instead of original 25" September 2022. Explanatory Note No. 14 Roadwork Section 5 CH94+200 — CH95+650 Original Completion is on 28" October 2021 is maintained. Explanatory Note No. 15 Roadwork Section 6 CH95+650 — CH96+347 Original Completion is on 4" January 2022 The main delay in this section due to the access issue with the outstanding Petronas pipeline which still pending the appointment of the qualified subcontractor at CH96+165-CH96+300. Secondly the delay in demolition of existing structures especially R80/A/B/C, R79B, R90/A/B, at CH95#775 and CH96+350 are also contributing the delay. We assume that all above mentioned issues can be resolved before we plan to start the remaining site clearing and earthwork with surcharge on 11° March 2021 and complete with resting period and removal on 18" February 2022 instead of original 13" September 2021 (about Smonths delay) After considering the Petronas pipeline plan to be complete on 7" October 2021 only, the revised completion date for this section now to be schedule on 26 September 2022 instead of original 4 January 2022. APPLICATION OF EOT NO. 2 UP TO 25" AUGUST 2023 [EXPLANATION NOTE] Explanatory Note No. 16 Roadwork Section 7 CH96+347 — CH97+250 Original Completion is on 17" August 2021 The main delay in this section due to the new Land Acquisition before finalizing the design of Kimanis Bridge and also outstanding structure to be demolished especially R93, ULS1, R98 at CH96+500 and CH96+625 and also existing utilities relocation. We assume that all above mentioned issues can be resolved before we plan to start the remaining site clearing and earthwork on 1" March 2021 and complete with pavement work on 18" April 2022 instead of original 14" August 2021 (about 8 months delay) after considering the relocation of existing utilities services and additional work required. {As such, the revised completion date for this section now to be schedule on 19" July 2022 instead of original 17 August 2021. However, it still falls under original completion period before 25" September 2022 under 1® EOT. Explanatory Note No. 17 Roadwork Section 8 CH97+250 — CH100+005 Original Completion is on 8" March 2022 The main delay in this section due to the outstanding structure to be demolished especially R122, R123A/B at CH98+800 - CH98+875. ‘We assume that all above mentioned issues can be resolved before we plan to start the remaining site clearing and earthwork on 1" March 2021 and complete with pavement work on 15" July 2022 instead, of original 8 March 2022 (about 4 months delay). [As such, the revised completion date for this section now to be schedule on 25'*July 2022 instead of original 8 March 2022. We assume that all above mentioned issues can be resolved before we plan to start the remaining site clearing and earthwork on 1* March 2021 and complete with surcharge work with resting period on 1" July 2022 instead of original 30" October 2021 (about 8 months delay). ‘As such, the revised completion date for this section now to be schedule on 30" November 2022 instead of original 31 March 2022. As such, the revised completion date for this section now to be schedule on 23" November 2022 instead of original 25” September 2022. Explanatory Note No. 20 Roadwork Section 11 CH105+800 — CH107+720 Original Completion is on 25" September 2022. One of the Main Critical Section of this project. As we highlighted, due to insufficient of Utilities Corridor from CH106+625 - CH107+300 RHS. As such, additional new Land Acquisition is required and now still in process to be gazetted as informed. Due to all these outstanding land matter and outstanding utilities corridor for the relocation of existing utilities line (SESB, TM, CTSB, JA Pipeline} until to date, the earthwork and geotechnical work activities are seriously affected and only able to carry out piece by piece. From CH106+100 ~ CH107+025 both widening section, we can't fully complete the PVD drain installation due to existing underground pipeline LHS, TM fiber optic cable RHS and SESB 33kV & 11kV overhead cable bothside due to earlier delay of structure demolition and insufficient utilities platform pending new Land Acquisition. It also affected the pile embankment slab between CH107+025 — CH107+650 and the construction of Benoni interchanges. Without completing the PVD drain on we can’t proceed next stage of earthwork with embankment fill and surcharge prior resting period. Especially at SESB existing 11KV overhead crossing cable supply to individual lots were not included in the original design and now pending VO approval. They required 4months for ordering and delivery the additional cable and LBS to Kota Kinabalu prior installation on site and relocate to new utilities corridor. Without completing the widening section for traffic diversion, we would not able to divert the traffic into the new alignment and start to upgrade the existing pavement with major culvert crossing, As such we assume that all outstanding existing utilities can be relocated with earlier VO approval and also resolve all land matters with new Land Acquisition or Encroachment issue on or before 26" June 2021 in order we can proceed the remaining PVD drain and complete the surcharge on 17" November 2021 instead of original 22" March 2021 (8 months delay) We are only able to fully complete the widening section for the above-mentioned roadwork section 11 on 19th December 2022 (Act ID 647) after considering the 6 month resting period from last surcharge 17" December 2021 (Act ID 635) prior resting period and also culvert construction after resting period. We should also consider the completion of Benoni interchanges with Pile Embankment Slab and Nehemiah Wall on 24" December 2022 in order we can proceed the pavement work accordingly. APPLICATION OF EOT NO. 2 UP TO 25" AUGUST 2023 [EXPLANATION NOTE] As such after fully diverting the traffic to new alignment on earlier January 2023, without consider surcharge at existing highway /existing pavement, we still require 210days to complete the upgrading of existing alignment inclusive of rip off the existing seal pavement, earthwork, culvert construction, Pavement work etc in order we can complete the upgrading on 25" August 2023.
