stated on Sunday, July 29th, 2018 at 0100 hours, called to request


an ambulance because she was sick and having pain in her stomach, and kept
throwing up. has a VP sunt in her head which is because she tends to get
swelling and tumors in her brain and she was also having headaches.
Transcare responded, and took her to Tampa General Hospital. They arrived at
Tampa General at 0215 hours.
When arrived, she was taken into ER room 7 where she came in contact
with Dr.Hill. He was a light skinned black male in his mid thirties. He spoke
with her about her issues, then left the room. When he returned, Hill did an
ultra-sound on her arm because they were having a difficult time getting a
vein to start the IV. Eventually Dr.Hill obtained an IV on her upper left arm.
Dr.Hill started a Pap Smear test without the nurse in the room. When Dr.Hill
started the test, he was not wearing gloves. While performing the test,
felt Hill rub his two fingers on her "clitoris" during the entire exam.
had her eyes closed, but could feel the two fingers. The test lasted
approximately five minutes. After this test, saw Hill once more before he
his shift ended at 0700 hours.

because her eyes where closed. She just knows it did not "feel normal", and
she has had numerous PAP Smears.

On 7-31-18, I was assigned this case for latent investigation. After reviewing the report, I learned on
7-30-18, the victim reported that an ER doctor from Tampa General Hospital inappropriately touched her
vagina during an examination.

On 8-8-18, at approximately 1615 hours, I called the victim and spoke to her briefly over
the telephone to request a meeting. She indicated she was currently at Brandon Regional Hospital and
she stated she would call me back when she had a date and time that she could meet. The victim later
returned my telephone call and stated she would have to meet close to her residence as she currently
does not have transportation and her sister specifically did not want me to come to the residence. I
discussed a time where we could meet and she indicated she has a victim advocate, Katy Micholson
w#727-327-7656 ext. 4168 with Suncoast in Pinellas County for her two other cases and
wanted her to be present for the interview. The victim indicated Katy was available all day on Monday and
Tuesday and Wednesday afternoon and that I could contact her to schedule a time and the victim would
be available. I asked the victim about her two other cases and she stated her case in Pinellas is being
investigated by Det. William Vickers - St. Petersburg Police Department. She provided me a telephone
number for him, but indicated the best way to contact him is via his email:
william.vickers@stpete.org. The second case revolves around an incident that happened after she left a
domestic violence shelter in Hudson. She went to a hotel and was sexually assaulted. She reported it to
the staff and the staff was required to report the incident to the police. The victim thought she contracted
chlamydia as a result of this incident. The victim indicated she lives with her foster sister and we
would not be able to meet at the house because her sister does not want the police there. I asked her if
she spoke to anyone about this case and she indicated she talked to her therapist and case manager.

On 8-8-18, at approximately 2250 hours, I sent an email to Det. Vickers with St. Petersburg Police
Department asking him to call me at his convenience. He called me shortly after and we discussed the
Pinellas case over the phone. He indicated he had sent an sexual assault kit to FDLE and recently
received the results where DNA was found on her person. He indicated that case has been open for 1 1/2
years.

I noted the victim had several other cases -

St Petersburg report 2018020711- Officer responded to Morton Plant Hospital on May, 12, 2018, delayed
report of domestic battery. During the interview, the officer noted the victim indicated she has "been
diagnosed with PTSD, Bipolar, Depression, Borderline Personality Disorder" and there was an open
sexual battery case with Pinellas County Sheriff's Office (SO17-160405)

Pinellas Park Police Department incident: 2015-00077553, 10-19-2015 which was later classified to an
assist other jurisdiction. The victim alleged her neighbor and his friends sexually assaulted her by force or
threat of force. The case was forwarded to the St. Petersburg Police Department.

Clearwater Police Department incident: CW15-60010, reported on 4-28-15 in reference to a false


imprisonment and sexual battery. The victim reported she was drugged, tied down to a bed and sexually
battered by two unknown males. The assigned detective viewed video surveillance of the incident and the
victim is observed punching her friend in the stomach and rubbing the friends bare breasts. There was no
sexual activity directed at or performed on the victim.

On 8-11-18, at approximately 1425 hours, I called Katy (victim advocate) and left her a voicemail
message. At 1530 hours, I called the victim who indicated she would meet for an interview without the
victim advocate. At 1615 hours, I called #727-847-8102 which is the main number for the Pasco County
Board of County Commissioners Consolidated Communications Center. The call taker was unable to
provide me with a direct telephone number for Det. Janet Gardner or an email address. She relayed there
is no police/sheriff station that has a deputy working during non-business hours. She provided me
#727-847-5878 and I unable to leave a message as the voicemail indicated the office was closed during
non-business hours and to call back during normal hours.

At approximately 2115 hours, I spoke to the victim and she indicated I could come to her residence for the
interview. I responded to the residence at and conducted a recorded interview with the
victim. She said on 7-29-18 at approximately 1 am, she called 911 for an ambulance as she was throwing
up and experiencing pain with her VP shunt that goes from her brain to her abdomen. A smaller
ambulance arrived and she asked the ambulance to take her to Tampa General as the hospital knew her
records from prior surgeries. She had her two nieces with her, 8 years old and 7 years old.
As they both needed seat belts, a second ambulance arrived to take the other child. They went to TGH's
emergency room and the victim's treatment started. She indicated she has had the VP shunt since 2016
due to a psuedotumor cerebri (fluid and swelling in the brain). The two girls were in the room with her and
the nurse came in first. She does not remember the nurse's name and described her as a W/F in her early
30's, 5'6"/140 pounds, brown hair in a ponytail, wearing dark blue scrubs and was possibly pregnant. The
doctor ordered some medication and Dr. Hill came into the room. He told the girls they were pretty and
asked what they were. They told him they were black and white and he said "me too!" and gave them a
high five. The nurse tried to start an IV on her and the victim explained due to her medical conditions they
would have difficulty with a traditional IV. She could not remember if the nurse was wearing gloves at that
time. Dr. Hill asked the victim if she had ever had an IV in her neck and she stated no, but she had one
before in her foot. He then used an ultrasound machine on her and was able to start an IV in her upper
arm. He was not wearing gloves during this time. She told Dr. Hill about being sexually assaulted in New
Port Richey and the St. Pete case. Dr. Hill told her he had to check her down there and she asked her
nieces to wait behind the curtain and to not look. He said he was going to give her a pap smear. She was
sitting on a normal hospital ER bed and it did not have the straps for your feet or a portion of the bed that
would fold down. Dr. Hill provided her with a fushia/pink colored plastic container that people normally
urinate in. The container was covered by a towel or pillow case and he put it under her bottom (butt). He
did not have on gloves nor did he wait for the nurse to come back into the room. Her niece was standing
there and she told them to go behind the curtain. The doctor then did a pap smear and started to use his

index finger and middle finger to play with her clitoris. He stuck the "pap smear thing" in her and told her
that it was going to hurt. He continued to play with her clitoris and the nurse came back into the room. She
handed him the swabs and started to type on the computer. She was not paying attention to what was
going on and the doctor continued to play with her clitoris. Dr. Hill told her that he was going to treat her for
everything and wanted her to know that he saw a little bit of white stuff coming out. She did not know what
he meant by white stuff but stated her mind did not want what he was doing but she could not control the
reaction from her body.

The victim indicated she thought she could possibly have a STD from the New Port Richey case or from a
sexual relationship she had with someone named Justin. Her period was not late at that time, but it is late
now. She did not go to the crisis center for a rape kit for the case in New Port Richey. That day, she had
two pap smears performed on her. Dr. Hill performed the first one and Dr. Allison DeRespino performed
the second one. The second one was done very differently and that's how she knew what happened
during Dr. Hill's was not right. The victim was discharged from the hospital and called her foster sister
and Detective Vickers to ask him about the incident. The victim indicated she knows it was Dr.
Hill because on 7-7-18, she went to TGH for an issue with her shunt. At that time, she was in a room that
had cameras due to her seizures. Dr. Pearce was one of her doctors during that time and the other two
doctors that treated her were females. The victim did not have any further information to provide and the
interview was concluded.

The victim provided paperwork from Tampa General Hospital from the visit. The paperwork was printed by
Joseph Mercado, RN on 7-29-18 at 12:06 pm. There are 9 pages, but the first page is missing. The
second page of the paperwork lists the treatment team of 1. Allison DeRespino, MD 2. Charlotte Derr, MD
3. Josiah David Hill, MD 4. William Pearce, MD. Most of the information is general, generic information
with a patient care sheet for abdominal pain. The paperwork was imaged into the report and the originals
were given back to the victim.

On 8-16-18, at approximately 1520 hours, I spoke to Katy with Suncoast Center #727-327-7656 ext 4168
and she did not have any additional information to provide.

I later met with the victim with a consent to release medical records from Tampa General Hospital. The
victim signed the form which I submitted to Tampa General Hospital on 8-17-18. I asked the victim if she
had talked to her sister about allowing me to interview the two children that were present during this
incident. The victim indicated her sister does not want her children involved. I asked her if I could speak to
her sister and she indicated her sister did not want to talk to the police. I explained the importance of
speaking to the two children that were present and she was aware of the significance and would continue
to talk to her sister about my request.

On 8-20-18, I called the Pasco County Sheriffs Office #727-847-5878 and spoke to Det. J. Gardner over
the telephone about the case she is currently investigating. The victim left a women's shelter with another
resident and ended up going to a motel. She then reported a sexual battery (penis to vagina intercourse)

by a male named "Marcus" (Pasco report #18-26758). There was no video surveillance at the motel and
the witness cannot be located as she left the shelter. The victim called Det. Gardner on 8-1-18 and told her
she went to the emergency room and had a pap smear. The doctor that treated her said she had
chlamydia and he could not say how long she had it. The victim did not mention anything about a possible
sexual battery during their conversation.

On 8-25-18, at approximately 1615 hours, I received a call from the victim. She indicated she has not been
able to discuss with about interviewing the children as works long hours late at night.
She would make an attempt to ask her if I could interview the children tonight. I again stressed the
importance of being able to interview the two other people in the room the day this occurred. I also
informed the victim TGH has 30 days to complete the medical records request and I had not yet received
any medical records.

On 8-29-18, at approximately 2045 hours, I received a call from the victim. She spoke to and
refuses to allow officers to speak to her children.

On 9-4-18, I called Tampa General Hospital Medical Records #813-844-7525 and left a message to check
the status of the medical records request. I received a return telephone call from Ashely indicating they
had received the records request and it was currently processing. She indicated I should have the records
by the end of the week.

When I returned to work on 9-9-18, I had a voicemail message from the victim. I called her back and left a
message.

I received the medical records from Tampa General Hospital. I reviewed the records and learned the victim
responded to the hospital on 7-29-18 with complaints of abdominal pain. Dr. Charlotte Derr added the
following notes - patient laying in bed laughing with nieces at bedside. Genitourinary comments: yellow,
white purulent discharge, significant adnexal tenderness bilaterally, no bleeding, cervix closed, no lesions
noted, no CMT, no uterine or ovarian masses, Chaperoned by RN. A gyncology consult was requested
and Dr. L. Kent added a consult was requested for evaluation of pelvic free fluid seen on imaging. The
patient reported a yellow vaginal discharge, but denied vaginal bleeding. A sterile speculum exam was
performed and it noted an absence of blood, presence of a thin white discharge with normal appearing
cervix without discharge.

At approximately 1445 hours, I responded to Tampa General Hospital and learned that Dr. Hill was not
currently working. Dr. Derr was working in the emergency room. I met Dr. Derr and she stated they do not
perform pap smears in the ER. She vaguely remembered treating the victim and said there was a pelvic
exam completed due to the complaint about abdominal pain. The pelvic exam does use a speculum and
resembles a pap smear. Swabs are collected to rule out bacterial infections. This procedure was
completed by her resident. Dr. Hill. She supervises the activities of her residents and the victim did not

make any statements about being sexually assaulted during their interactions. If she had, the ER does not
perform any pelvic exams and they call their SANE nurse to perform those duties. All pelvic exams are
chaperoned, meaning there is always a second person present in the room to observe. Even as the lead
doctor, Dr. Derr even will have a second person in the room and it does not matter what the sex of the
patient and doctor. After reviewing the victim's medical records. Dr. Derr confirmed a second pelvic exam
was completed by the gynecologist.

The victim later returned my telephone call at approximately 1545 hours and we discussed the status of
her case. She made the comment that she wasn't sure if she wanted to go through with this and said she
should have listened to Det. Vickers. I informed her the hospital did not perform a pap smear that is was
possibly a pelvic exam. She raised her voice and said it was because he was a doctor and he has money.
I explained to her I was just reading what the medical records reflected and asked her if she wanted to
continue with the investigation and she said "I guess."

I spoke to HCSO operator #19 and Sgt. Garfield to inform them I would be responding to an address in the
county to conduct an interview. I responded to , Riverview and met Dr. Josiah Hill at
his residence. I explained why I was there and Dr. Hill indicated he had not talked to any of the hospital
attorneys about this. I stepped outside as Dr. Hill made a telephone call and approximately ten minutes
later, he invited me back inside the residence. He stated he did not have any independent recollection
about the patient and said if there were specific questions, he may not answer them without consulting the
attorney. Dr. Hill explained a portion of the medical records in terms of how the reports are authored and
what notes he would have typed. After reviewing the medical records, he indicated the nurse that would
have been the second person in the room for a pelvic exam would have been either Olivia Bailey and
Stefanie Gonzalez. When I inquired on how a patient's body would be placed for the type of procedure, Dr.
Hill requested the interview stopped for counsel to be present. I provided him with my business card and
contact information. He did not know the name of the attorney and I requested either him or the attorney
contact me when possible.

On 9-11-18, at approximately 2300 hours, I responded to Tampa General Hospital in reference to this
case. I met with the charge nurse to inquire if RN Olivia Bailey or RN Stefanie Gonzalez were working that
evening. Gonzalez was not at work and normally works the 7 pm to 7 am shift. I conducted an interview
with RN Bailey and she did not recall the patient. After reviewing the medical records and a photograph of
the victim, she did not recall the encounter. RN Bailey said a pelvic exam is a very routine and common
procedure and is always performed when a female of child bearing age comes into the emergency room
with stomach pain. During the exam, there is a portion where a doctor inserts two fingers into the vagina
(she described it much like a procedure done during a pap smear at the gynecologist). There is always a
second person in the room and if the doctor is a male, there is a female hospital employee present as well.
If the patient has anyone else in the room, they are asked to step outside during the pelvic exam or if they
prefer to stay in the room, the guest either stands by the patient's head or behind a curtain. There is a
sheet that is placed over the patient's legs during the exam. RN Bailey stated that Dr. Hill was one of the
"good doctors" and she has never heard anyone make any complaints against him. Based on the hospital
procedures and precautions set in place, she did not believe this incident could have happened the way
the victim described and though the victim could have possibly felt the lubricant for the speculum
instrument. She did not have anything further to add at this time.

On 9-12-18, at approximately 1430 hours, I received a telephone call from Attorney Joseph Touger
#813-876-6622. Attorney Touger indicated he would not allow an interview with Dr. Hill, but did provide
some clarification on hospital procedure. When a nurse orders the equipment for an examination, it is
noted in the computer and the nurse will print stickers to put on the equipment. The nurse would scan their
badge and label the equipment. The nurse would then tell the doctor they are ready to move forward with
the examination and the doctor will enter the room. Whatever nurse ordered the equipment would be the
nurse that was present in the room for the examination and this information should be in the internal
hospital records. Attorney Touger did not have any additional information to provide at this time.

When I returned to work on 9-17-18, I had a voicemail message from the victim indicated she no longer
wished to pursue this case as she has to continue to go to Tampa General Hospital to obtain medical
treatment for other issues. She had discussed the decision with her case manager, therapist, and victim
advocate and did not want the investigation to continue.

At approximately 1730 hours, I met the victim at her residence and she signed a complaint withdraw. The
form was later imaged into the report.

As the victim no longer is cooperative with the investigation and the allegation was based on a bona fide
medical purpose, this case will be administratively cleared.
