MEMORANDUM OF AGREEMENT

This Agreement made and entered into this 22nd day of August 2022 in the City of
Masbate, Philippines, by and between:

The AROROY NATIONAL HIGH SCHOOL under the SCHOOLS DIVISION

OF MASBATE PROVINCE, DEPARTMENT OF EDUCATION, an agency of the
national government of the Republic of the Philippines, created by virtue of Batas Pambansa
(B.P.) No. 232 or the “The Education Act of 1982” as amended by Republic Act (R.A.) No.
9155 otherwise known as “Governance of Basic Education Act of 2001”, with principal
office address at Ambolong, Aroroy, Masbate, represented by its School Principal, ROSA
MYRA T. FRANCO, herein referred to as “FIRST PARTY”;

-and-

HRPTA Officers (Homeroom Parents and Teachers Association) of Aroroy

National High School an association with the address at Ambolong, Aroroy, Masbate,
Philippines, herein represented by its HRPTA President, Mr./Ms. RYAN SABALVARO of
Grade 11 - Amorsolo, hereinafter referred to as the “STAKEHOLDERS”,

WITNESSETH:

WHEREAS, Republic Act 8525, otherwise known as “An Act Establishing the
Adopt-A-School Program and Providing Incentives Therefore and for Other Purposes”, was
enacted to encourage private companies to assist in the delivery of better quality education to
public schools in the country, particularly in the poverty-stricken provinces;

WHEREAS, the Department of Education issued DepEd Order No. 24, s. 2018 titled
Institutionalization of the Brigada Eskwela Program or the National Schools Maintenance
Week (NSMW) institutionalized the conduct of Brigada Eskwela Program in all schools
nationwide to engage all education stakeholders to contribute their time, efforts and resources
in ensuring that public schools are all set for the opening of classes;

WHEREAS, the Department of Education issued Memorandum No. 062, s. 2022 or

the 2022 Brigada Eskwela Implementing Guidelines mandating all public schools to conduct
Brigada Eskwela (BE) Program in time for the preparation for the opening of classes for
School Year (SY) 2022-2023 to strengthened partnership engagements with partners and

stakeholders that complement the Department of Education efforts to ensure quality basic
education;

WHEREAS, the FIRST PARTY believes that one of the best ways to complement
the department’s efforts to ensure quality basic education for learners is to strengthen the
implementation of Home Learning Space, it aims to bring together education partners and
stakeholders to help the learners and their families create a quality and conducive learning
space at home to answer the challenges imposed in implementing the Basic Education
Learning Continuity Plan (BE-LCP). This activity shall continue as a year-round initiative
under the Brigada Eskwela Plus consistent with relevant provisions under DepEd Order No.
100, s. 2009 or the Launching Brigada Eskwela Plus and Directing Selected Public Schools to
Volunteer in this Community Involvement in Education Initiative;

WHEREAS, the FIRST PARTY commits to the achievement of significant goals

which shall contribute to increase students’ participation rate, reduce drop-outs and help
improve learning for both learners and community under Brigada Pagbasa Plus;

WHEREAS, the FIRST PARTY shall create a network of community-based

organizations and projects including the Brigada Pagbasa which is partnership initiative in
response to Hamon: Bawat Bata Bumabasa;

WHERAS, the FIRST PARTY shall strengthen the implementation of Home

Learning Space in response to the challenges imposed in implementing the Basic Education
Learning Continuity Plan (BE-LCP).

WHEREAS, the STAKEHOLDERS has been very supportive of the conduct of

Brigada Eskwela and has been one of the major partners of the FIRST PARTY in the
conduct such program related activities in the entire Schools Division Office which greatly
helped the schools in terms of manpower to prepare the physical facilities of schools to
ensure that learners are safe and achieve a conducive learning environment come the opening
of classes;
WHEREAS, the STAKEHOLDERS has voluntarily support the “FIRST PARTY”
in the implementation of Home Learning Space by providing their learners the necessary
materials and space needed in making the said project;

WHEREAS, the STAKEHOLDERS supported and initiated in helping the “FIRST

PARTY” in the dissemination of information with regards to the importance of Home
Learning Space to the members/parents of each learners;

WHEREAS, the STAKEHOLDERS has extended its full support and agreed to the
goals and objectives of Brigada Eskwela and assist the FIRST PARTY in the
implementation of the program by taking active participation and involvement in the
activities as stipulated in this Memorandum of Agreement.

NOW THEREFORE, for and in consideration of the foregoing premises and the
terms and conditions herein set forth, the parties hereby agree as follows:

Section 1 Description of the Project

The project shall be known as “Project ATM (Aralan sa Tahanan Mo) 2.0”.
The project aims to bring together education partners and stakeholders to help
the learners and their families create a quality and conducive learning space at
home to answer the challenges imposed in implementing the Basic Education
Learning Continuity Plan (BE-LCP) in preparation for the conduct of face-to-
face classes for School Year 2022 – 2023.

Section 2 Rights and Obligations of the Concerned Parties

2.1 The “FIRST PARTY” shall:

2.1.1 Provide policy guidance and directions to ensure the proper

implementation and completion of the various activities as planned
and agreed by both parties;

2.1.2 Coordinate with the schools as to schedule and preparation in

receiving the STAKEHOLDERS through issuance of School
Memorandum or communication letter to the School Brigada
Eskwela Coordinator;

2.1.3 Assist in the implementation and in monitoring the progress of the

activities or projects to be undertaken by the STAKEHOLDERS
by ensuring the cooperation of the beneficiary;

2.1.4 Facilitate the signing of Memorandum of Agreement (MOA)

through a formal gathering, meeting, kick-off ceremony and
execute Deed of Acceptance (DOA) as a way of recognizing and
acknowledging the support or donation if applicable;

2.1.5 Ensure proper booking-up of donations through coordination with

the school’s property custodian or division’s supply officer if there
are materials or cash donations;

2.1.6 Conduct appreciation activity to formally acknowledge and

appreciate the contributions of the STAKEHOLDERS in the
Brigada Eskwela implementation in the Schools Division of
Masbate for SY 2022 – 2023 to be held in the third or fourth
quarter of the year.

2.2 The “STAKEHOLDERS” shall:

2.2.1 Give suggestions or recommendations to improve the policy

guidance and directions set by DepEd to ensure the proper
implementation and completion of the various Brigada Eskwela
activities;

2.2.2 Assist the FIRST PARTY in the implementation of Home

Learning Space by providing their learners a quality and conducive
learning space at home;

2.2.3 Help the FIRST PARTY in the dissemination of information with

regards to the importance of having a home learning space to the
learners and parents;

2.2.4 Execute a Deed of Donation in favor of DepED for the the

donations given to schools if applicable;

2.2.5 Participate in the appreciation activity to be conducted by the

FIRST PARTY which shall be attended by the provincial head or
his/her duly authorized representative;

Section 3 Scope of the Project Beneficiaries

The project beneficiaries of PROJECT ATM 2.0 shall be the Learners, Parents
of Aroroy National High School which shall be communicated through official
letter.

Section 4 Project Cost

The equivalent in peso of the volunteer man hours which is the time spend by
the STAKEHOLDERS in performing Brigada Eskwela activities and the
amount of donations to be donated by the STAKEHOLDERS if there are
shall be determined upon execution of the Deed of Donation as applicable.

Section 5 Project Effectivity

This Memorandum of Agreement shall take effect upon its signing and shall
remain in full force and effect for a duration of three School years starting SY
2022 – 2023 to SY 2024 – 2025.

Section 6 Capacity and Authorization. The parties herein warrant that they have the
capacity, power and requisite authorization to enter into this Agreement.

Section 7 Separability Clause. Should any part of this Agreement be judicially declared
null and void, such nullity shall not affect the validity of the remaining
provisions hereof.

Section 8 Breach of Contract. The violation or omission of any of the provisions of this
Agreement shall be ground for the cancellation or rescission of the same
without need for legal or court action.

Section 9 Amendments

This Agreement may be revised, amended or modified only through a written

instrument duly executed and signed by all parties.
