GREETINGS:

Respectfully transmit to your office herein case of Murder that


transpired on March 01, 2021 at around 12:00 PM at Bgry. Poliwes, Baguio
City, wherein the complainant was identified as Lea Salonga Golem, 36
years old, married, and a resident of #353 Brgy. Lower Balsigan, Baguio City,
while the respondent was identified as Emma Mariang Palad, 22 years old,
single, and a resident of Purok Central, Brgy. San Vicente, Baguio City.

FACTS OF THE CASE:

Nicasio Asiong Salonga, the victim; and Emma Mariang Palad, the
suspect; are known as live-in partners. At that time, the victim headed into
the nearby store while the suspect surreptitiously followed him to carry out
the alleged shooting. Onwards, Nicasio was in front of the store and was
about to buy something when the suspect suddenly shot him once in the
back of his head. The only eye witness, Camille Camelyo, the owner of the
sari-sari store, saw how the suspect shot the victim and escape carrying a
revolver. Witness called the Police Station 8 and they sent officers for
immediate response to the incident nearby the area. Police Officers
immediately arrested the suspect and recovered a revolver firearm bearing
serial no. W197902 with live ammunitions and an empty cartridge shell
attached on its cylinder. The other responding officer on the crime scene
recovered one (1) discharged bullet found lodged on the concrete wall of
the store.

The arrested respondent was detained at Baguio City Jail on the basis of
Preliminary Disposition issued by Prosecutor JOSEPH DELA CRUZ.

On sworn statement of LEA SALONGA GOLEM dated March 02, 2021


corroborated by statements of their witness and referred for Inquest
Proceedings for today at around 12:00 in the afternoon, the respondent,
EMMA MARIANG PALAD, of Murder. The witness reported while she saw
Nicasio in a distance approaching her sari-sari store and about to buy
something and when he was closed enough she ask him first what he was
going to buy when suddenly heard an explosion at the same time Nicasio
suddenly sprawled right in front of the store. Afterwards she saw the suspect
EMMA MARIANG PALAD, 22 yrs. old, single, who immediately ran away from
the scene holding the firearm allegedly used in the incident. Then she saw the
slain victim NICASIO ASIONG SALONGA, 31 yrs. old, single, laborer, was laying
backwards right in front of the store where he exactly fell with bloody pierced
nape. The witness, CAMILLE CAMELYO, 64 yrs. old, married, reported the
incident to Police Station 8 for immediate response of the commission of the
crime at Bgry Poliwes, Baguio City. Police Station 8 sent four (4) officers to
respond in the said and immediately arrested the suspect. Police officers
recovered a ROSSI Revolver made in U.S.A., caliber 38-caliber special, silver
colored and bearing serial no.W197902 with four (4) live ammunitions and one
(1) empty cartridge shell inside its cylinder. In the crime scene Police Officers
recovered one (1) discharged bullet lodged on the concrete wall of the store.

Considering the forgoing, Probable Cause has been sufficiently


established against the respondents to which the responding Information shall
be filed forthwith. In the meantime, the arresting officer is advised to transfer
custody over the respondent to Baguio City Jail.

We, PCPL. MATT M. ATAY JR. and PCPL. SANDY LOUIS E.


TABANGCURA, members of the Philippine National Police, presently
assigned at the Baguio City Police Office (BCPO) and Police Station 8,
having been duly sworn do solemnly state THAT:

01. On March 01, 2021 at around 12:05 PM, we received a call from
an unknown number (09480336699) in our office, stating that an alleged
shooting incident was committed at Bgry. Poliwes, Baguio City. Wherein the
suspect was a female wearing a plain pink t-shirt, blue maong shorts, and
carrying a firearm.

02. That the station commander immediately ordered us to inspect


the said area and investigate the matters subject of the emergency call.

03. That in compliance with the said order, I, along with the three (3)
police officers subsequently responded to such report and immediately went
to the place indicated and upon arriving thereat we were told by the eye
witness that the suspect had run away with a firearm with her.

04. Thereupon, one of the bystanders accompanied us to the


suspects’ house located just near the crime scene at a distance of not less
than 300 meters away while the two (2) officers with us left to be in charge of
the crime scene. Then there we saw on the act the suspect inside the house
sitting on the sofa and hiding something under the pillow by her side at the
moment, and ordered her to stop and at the same time informed said person
of our authority as police officers.

05. We then approached her and looked at what she had hidden
under the pillow and discovered it was a firearm. The firearm was confiscated
from her. After duly marking the confiscated firearm, live ammunitions, and a
cartridge case we brought the suspect to the Police Station 8 of Baguio City.
06. That this affidavit is executed to attest to the truth of all the
foregoing and to support the filing of a formal charge/s in court against said
person.

I, CAMILLE CAMELYO, 64 years old, married, currently residing at #434


Brgy. Poliwes, Baguio City, after having sworn in accordance with law, do
hereby depose and state THAT:

That on March 01, 2021 at around 12:00 PM, I was in-charge of my own
sari-sari store for selling that time. In the distance I saw Nicasio approaching
my store as an obvious buyer. When he was closed I asked first what he was
going to buy. He was just about to speak when I suddenly heard something
exploded at the same time Nicasio suddenly sprawled right in front of my
store. The incident happened right across my store so I can’t be wrong that
the one who shot him in the back was his own live-in partner who immediately
ran away holding the shiny gun used in the incident. Afterwards I saw that
Nicasio was laying backwards right in front of my store where he exactly fell
with bloody pierced nape. There weren’t many people at that time so maybe
his live-in partner was so brave to carry out her evil plan. I have known this live-
in partner for a long time because they often drink at the same time here in
my store.

Thereafter, I reported the incident to the police officers and provided


the identity of both victim and suspect. Thanks for the quick response of police
officers and the said suspect were caught and has been arrested;

I executed this affidavit to attest the truthfulness of the forgoing facts


and support the filing of criminal case against the suspect.

I, LEA SALONGA GOLEM, 36 years old, married, Filipino citizen, and


presently residing at #353 Brgy. Lower Balsigan, Baguio City, after being duly
sworn to in accordance in law, do hereby depose and state THAT:

1. I am the sister of the victim, Nicasio Asiong Salonga who was killed at
Camelyo’s Sari-sari store at Brgy. Poliwes, Baguio City.

2. On March 01 at around 01:45 in the afternoon, I was at my store in


Hilltop Market selling vegetables at that time. I was about to eat lunch
when suddenly someone called my phone. She is none other than
Mrs. Camille Camelyo who used to be my Filipino teacher when I was
still in secondary school and the owner of Camelyo’s sari-sari store.
She immediately directed me to what happened to my brother that
he was shot in the head by her own live-in partner in front of the said
sari-sari store.

3. I immediately left my shop here in Hilltop Market with my eldest


daughter and quickly looked for a ride to the scene.

4. If I am not mistaken, it was exactly 2 PM when I arrived at the scene


and noticed a cordon protecting the scene that the police obviously
put it up. At the moment, I immediately identified the corpse that it
was my brother because of wearing that black t-shirt and slippers that
I gave him as a Christmas present.

5. And there I also saw the caller on my phone, none other than Mrs. Camille
Camelyo, the owner of Camelyo's sari-sari, and my former teacher;

6. She narrated the whole incident which was only according to what
she saw and I thank her because she volunteered to be a witness to
the case.
7. In the middle of the conversation, Police officer approached me and
said that the suspect is in their custody. I immediately came to the
police office and saw Emma Mariang Palad, female, 22 years old and
a resident of Purok Central, Brgy. San Vicente, Baguio City;

8. I am executing this complainant-affidavit to attest the truthfulness of


foregoing.

BAGUIO CITY POLICE OFFICE THIS 2ND day of MARCH 2021 ON OR ABOUT 8:05 IN
THE MORNING. HER STATEMENT WAS PROPOUNDED IN ENGLISH WHICH SHE
FULLY UNDERSTANDS.

1. Q: What brought your presence inside this office at this moment?


A: I came here to report about the incident where my brother was murdered.

2. Q: I want to inform that your statement will be under oath.


Are you willing to tell the truth but nothing but the truth in this investigation?
A: Yes Sir.

A: Yes Sir.

4. Q: What is your full name?


A: I am Lea Salonga Golem sir.

A: I am 36 years of age sir.

A: I am residing at #353 Brgy. Lower Balsigan, Baguio City.

7. Q: Do you know the person who killed your brother, Mr. Nicasio Asiong Salonga?
A: Yes Sir.

8. Q: Where were you when the commission of the crime happened?


A: I was at my store in Hilltop Market selling vegetables at that time.
9. Q: Can you tell how the incident happened?
A: On 1st day of March 2021 at around quarter to 02:00 in the afternoon I was at my
store in Hilltop Market selling vegetables at that time. I was about to eat lunch at that
time when suddenly someone called my phone. She is none other than Mrs. Camille
Camelyo who used to be my Filipino teacher when I was still in secondary school and
the owner of Camelyo’s sari-sari store. She immediately directed me to what happened
to my brother that he was shot in the head by her own live-in partner in front of the said
sari-sari store.

10. Q: What did you do when you heard the incident from the phone call?
A: At first I still couldn’t believe it because maybe it was just a prank and I even
asked her where did she got my number and she said that in my Profile Information on
Facebook.

11. Q: What happened next?


A: I immediately realized that why would my former teacher waste time just looking
for my number for a prank so I immediately left my shop here in Hilltop Market with my
eldest daughter and quickly looked for a ride to the scene.

12. Q: What time did you arrive at the said place of the incident and who were those
people you saw there?
A: If I am not mistaken, it was exactly 2 PM when I arrived at the scene. I noticed a
cordon protecting the scene that the police obviously put up and so many people
there seemed to be looking at me and whispering. I suddenly started to cry when I saw
the corpse that was lying on the ground was my own brother.

13. Q: How did you recognize that the one laying lifeless there was your brother?
A: The slippers and black t-shirt he was wearing in the scene were gifts I gave him last
Christmas. I can’t be wrong.

14. Q: Did you see at the scene the person who called you on the phone?
A: Yes sir.

15. Q: What did she tell you?


A: We had a long conversation at that time. To make the long story short, she
volunteered to be a witness to the incident because she saw the incident right across
from her sari-sari store.

I, EMMA MARIANG PALAD, 22 years old, single, and a resident

THAT:

1. I am the respondent in the criminal case NPS DOCKET No. 210301 for the
crime of murder under article 248 of the Revised Penal Code.

2. I am executing this counter affidavit as a reply and comment to the


complaint affidavit of LEA SALONGA GOLEM, and affidavit of witness,
MRS. CAMILLE CAMELYO, who are under investigation by this Honorable
Office in connection with the death of MR. Nicasio Asiong Salonga after
being shot on March 01, 2021.

3. On March 01, 2021 at around 12:00 PM, I was in our house where I
currently residing with my live-in partner at Purok Central, Brgy. San
Vicente, Baguio City nearby Camelyo’s Sari-sari store.

4. At around 12:00 PM, we argued with my live-in partner and then he


walked out of the house. I surreptitiously followed him because I
suspected it might have another woman to meet outside. When we got
close to the nearby store I saw him still walking straight to the store and it
was obvious that he just had something to buy. Because of that I was no
longer suspicious so I went back home. Just a few minutes ago, there
were Police officers who came here to the house to arrest me. The
arresting officers informed me the reason for my arrest that they had
received a report that someone had seen me that I had shot a man in
front of a nearby store. Me, being shocked on the allegations, I could do
nothing but to comply with them. About the firearm that they were saying
it was mine; it was owned by none other than my live-in partner.
5. While I was handcuffed, the police officers keep telling me that I shot Mr.
Nicasio Asiong Salonga, my beloved one.

6. I deny having shot and killed Mr. Nicasio Asiong Salonga.

SUBJECT : Spot Report on Shooting Incident resulted to the death of


Mr. Nicasio Asiong Salonga

DATE : MARCH 01, 2021

1. On March 01, 2021 at about 12:00 o’clock in the afternoon. An


alleged shooting incident transpired at Bgry. Poliwes, Baguio
City. Wherein the victim was Nicasio Asiong Salonga, 31 years
old, single, and a resident Purok Central, Brgy. San Vicente,
Baguio City, was shot by suspect Emma Mariang Palad, 22 years
old, single, a native and presently residing at Purok Central, Bgry.
San Vicente, Baguio City. As a result, thereof, the victim
sustained one (1) gunshot on the nape and was found dead on
the spot upon the arrival of first responders. The suspect was
arrested immediately during hot-pursuit operation conducted,
the weapon used in the commission of the crime and other
evidences were recovered, 1) ROSSI revolver w/ bearing serial
no. W197902 marked as “MMA-01-03-21-01”, 2) Four (4) pieces of
38-caliber special live ammunitions marked as“MMA-01-03-21-03,
MMA-01-03-21-04, MMA-01-03-21-05, MMA-01-06-21-06”, 3) One
(1) empty cartridge case marked as “MMA-01-03-21-08”, 4) One
(1) discharged bullet marked as “MKU-01-03-21-02”, 5) One (1)
Fingerprint specimen marked as “MMA-01-03-21-07”, 6) One (1)
Gunshot residue marked as “MKU-01-03-21-01”.

2. The suspect is now under the custody of this station for the
Investigation and proper disposition. The Cadaver of the victim
was moved to Crime Laboratory Office, 105 Kayang Street,
Baguio City for Autopsy Examination;

3. The motive of incident is undetermined and the case is still under


Investigation;

1. Reference:

b. Incident report dated March 01, 2021 on a case of
shooting incident resulted to death of Mr. Nicasio Asiong
Salonga.

2. Progress report on a case of shooting incident that transpired on


March 01, 2021, at Brgy. Poliwes, Baguio City. Wherein the victim is Mr.
Nicasio Asiong Salonga, 31 years old, single, and a resident of Purok,
Central, Brgy. San Vicente, Baguio City.

3. The Investigation was conducted by personnel of BCPO Station 8,


who has the jurisdiction over the area and immediately conducted a
roadblock. Investigators receive a call from Mrs. Camille Camelyo that
the suspect was running away from the crime scene. Supposedly, the
suspect trying to escape but one of the bystanders instructed and
accompanied the responding police officers to the suspect’s house so
that she could be immediately arrested by virtue of warrantless arrest.
The investigators were informed of the rights of the suspect in a dialect
they fully speak and understand.

4. Suspect identified as Emma Mariang Palad, 22 years old, single, a


native and presently residing at Purok Central, Brgy. San Vicente,
Baguio City and recovered within her dwelling a firearm that was used
in the commission of the crime and other evidences such as , 1) ROSSI
revolver w/ bearing serial no. W197902 marked as “MMA-01-03-21-01”,
2) Four (4) pieces of 38-caliber special live ammunitions marked
as“MMA-01-03-21-03, MMA-01-03-21-04, MMA-01-03-21-05, MMA-01-06-
21-06”, 3) One (1) empty cartridge case marked as “MMA-01-03-21-08”,
4) One (1) discharged bullet marked as “MKU-01-03-21-02”, 5) One (1)
Fingerprint specimen marked as “MMA-01-03-21-07”, 6) One (1)
Gunshot residue marked as “MKU-01-03-21-01”.

5. Suspect is under the custody of the Station for Investigation and


proper disposition.

6. Cases of murder are being prepared against the suspect.

7. The one (1) empty cartridge recovered within the cylinder of the
forearm and one (1) discharged bullet that were recovered from the
Crime Scene and was brought to the Crime Laboratory for Comparison
Examination as to determine what was being used by the suspect.

8. The one (1) Fingerprint specimen that was recovered from the grip
panel of the firearm and was brought to the Crime Laboratory for
Comparison Examination as to determine the possible link of the
suspect to the crime.

2. MATTERS INVESTIGATED:
4. A case of murder transpired at Brgy. Poliwes, Baguio City, where in
the victim was killed;

5. To determine the circumstances of the case and give justice to the


Victim’s family;

3. FACTS ON THE CASE

On March 01, 2021 at around 12:00 PM. An alleged shooting incident


occurred at Brgy. Poliwes, Baguio City. The witness, who reported the case
is Mrs. Camille Camelyo, 64 years old, stated that she was in-charge of her
own sari-sari store for selling at that time. She saw Mr. Nicasio Asiong
Salonga at a distance coming closer to her shop and asked what he is
going to buy then suddenly heard an explosion. At the same time, the
victim suddenly prostrated in front of the store. Afterwards she saw Mrs.
Emma Mariang Palad who allegedly shot the victim and escape carrying
a revolver. Police stations 8 immediately sent officers from their office for
appropriate response to the said area. Upon arrival of the police officers in
the area, one of the bystanders pointed the suspect’s residence and
accompanied them to get there. The arresting officers politely arrested
the suspect with virtue of warrantless arrest and seized the revolver firearm
and brought to the station. The other police officers responded to the
Camelyo’s Sari-Sari store and saw Mr. Nicasio Asiong Salonga laying
backward on the ground with one piercing behind his head,

4. DISCUSSION
The suspect who is responsible for the death of Mr. Nicasio Asiong
Salonga that transpired at Brgy. Poliwes, Baguio City will be facing a case
filed against him;

5. CONCLUSION
The case was still under the Branch 23 Hall of Justice, Baguio City
Regional Trial Court as the victims continue to fight justice;

6. RECOMMENDATION
It is recommended that the people responsible for the death of Mr.
Nicasio Asiong Salonga will be prosecuted for the crime.

Lousi E. Tabangcura arrived at the crime scene at around 12:10 PM, and was
able to secure and establish the security cordon at around 12:25 PM on March
01,2021;

b. That the Investigator-on-Case arrived at the crime scene


on/about 12:41 PM and thereafter assumed responsibility over the crime
scene and conducted inquiry on the incident; (see attached Investigation CSI
Form)

c. That members of the SOCO TEAM led by PCpt. BELLA T.


NAMALANSA arrived at the crime scene at around 1:08 PM and conducted
forensic investigation and collected all potential pieces of evidence; and

4. Attached are the FR’s Report, Investigator’s CSI Form and SOCO reports
for your reference which will form as an integral part of the Case Folder of
Murder incident.

4. Investigation disclosed that the victim went out their house to buy
something at Camelyo’s Sari-sari store and Emma Mariang Palad, a
live-in partner, surreptitiously followed him. The suspect closely shot him
once in the nape. Witness called the Police Station 8 and they dispatch
an immediate response nearby the area. Police Officers immediately
arrested the suspect in a hot-pursuit operation inside its residence and
recovered a ROSSI Revolver and bearing serial no. W197902 with four
(4) live ammunitions and a cartridge case attached on its cylinder. On
the other responding officer left on the crime scene recovered a piece
of discharged bullet lodge on the concrete wall of the said store.

5. The purpose of this request is to determine the serviceability of the


subject and to determine if the firearm, bullet, cartridge case, and
ammunition is match on the evidence submitted by the investigator.

cartridge shell marked as “MMA 01-03-21-02”, match with the four (4)
live ammunitions marked “MMA 01-03-21-03”, “MMA 01-03-21-04”,
“MMA 01-03-21-05”, “MMA 01-03-21-06”.
3. To determine whether or not the above-mentioned one (1) piece of
discharged bullet marked “MKU 01-03-21-02”, match with the empty
cartridge shell.
4. To determine whether or not the mentioned 1 cotton swab of Gunshot
Residue marked “MKU 01-03-21-01” was discharged from the suspect’s
firearm.
FINDINGS:

1. Physical examination and actual test firing of ROSSI Revolver


with serial number W197902 marked “MMA 01-03-21-01”
above-mentioned revealed that it fired 38-caliber cartridges.
2. Physical examination and comparison of the above-
mentioned one (1) empty cartridge shell marked as “MMA
01-03-21-02” and the discharged bullet marked “MKU 01-
03-21-02” revealed that the empty cartridge shell
matched with the discharged bullet.
3. Physical examination and comparison of the above-
mentioned one (1) empty cartridge shell marked as “MMA
01-03-21-02” revealed that the empty cartridge shell
matched with the four (4) live ammunitions marked “MMA
01-03-21-03”, “MMA 01-03-21-04”, “MMA 01-03-21-05”,
“MMA 01-03-21-06”.
4. Gunshot Residue Test revealed that the gunshot residue
marked “MKU 01-03-21-01” was discharged from the
suspect’s firearm.

CONCLUSION:

1. The above-mentioned ROSSI Revolver with serial number


W197902 marked “MMA 01-03-21-01” is serviceable.
2. The above-mentioned one “MMA 01-03-21-02” and the
discharged bullet marked “MKU 01-03-21-02” matched.
3. The above-mentioned 1 cotton swab of Gunshot Residue was
discharged from the suspect’s firearm.

Screening and Confirmatory test conducted on the above-stated

Examined a fully developed, fairly nourished, embalmed male cadaver. There
is a permanent cavity in the nape region and shattered bone fragments in the nose
region that caused large permanent cavity due to secondary projectile.

CAUSE OF DEATH IS BRAIN INJURY SECONDARY TO PENETRATING
GUNSHOT WOUND, NAPE
