Reports and photos were received on the 31st of January 2023, indicating what
appears to be the start of illegal deforestation and road construction upland of Tamarindo
Beach, Reserva Natural Canal de Luis Peña, Culebra, Puerto Rico. On Feb 1st, video and still
photos were received of works done west of the road near the historic cattle weigh station
possibly in or bordering the public's domain of the shore. The receiving waters enjoy multiple
federal critical habitat listings and have multiple endangered corals, and coral nurseries, with
two species of endangered sea turtles frequenting shallows and sightings of WI Manatee. The
area is critical to local eco-tour businesses as well. No permit signs are posted at the site to
date, and no permits were found through the Planning Board database online. Lot Num:

Onsite reports from the 31st of January indicated chain saw continued into the
afternoon, with an orange machine arriving on February 1st. The unique colored machine and
white Tacoma, plate number 909-716, are associated with Windmar Energy and/or Puerto Rico
Land and Fruit, S.E. These entities have moved multiple unpermitted road projects on Culebra
in sensitive areas that have seriously impacted the coastal water quality of Flamenco Bay and
have been associated with wetland lls near Flamenco Lagoon and Playa Datiles as well as
impacts in Guayanilla. On multiple occasions, they have attempted to privatize access to NE
side of Flamenco Beach (El Muellecito). As a matter of public record, PR Land and Fruit has
abused the courts to do this, launching multiple cases they ultimately lost against over a dozen
locals, as they alleged the historic access road was private among other allegations. They
made a sealed "deal" through the US Federal District Court with a past (unelected) mayor that
had been appointed by a Governor of the same party. The deal was since unsealed by the
courts through an intervention by CORALations, and revealed tax breaks. The CRIM data
below indicates the lot still belongs to Rafael Diaz Romero. No permits were applied for
according to the Planning Board MIPR GIS permitting maps for this lot.
