ASSAULT (intentional tort)
-puts the victim in fear but no direct contact -for an assault to be justified, it has to happen almost immediately (imminent) BATTERY -MUST be a direct contact/force against the victim’s will -actionable per se even when NO real harm is caused tapi ada intention to harm tu -just a slight touch without any pain is still considered battery DEFENCES TO ASSAULT AND BATTERY -self defence -parental punishment and other authority (police) -judicial authority -consent -provocation -necessity *Do not use greater degree of physical contact than it is necessary in the circumstances for that purpose.
