1. INTRODUCTON

1.1. Back ground of the study


The concept of good governance emerged the end of 1980 at the time of unprecedented
political change, (Aminuzzaman, 2007). The collapse of the berlin wall on 19 th November
1989 set of disintegration of the Soviet Union which was consequence of thereof lead to the
decay of the political and economic alliance of the easterly this political change created the
bleeding group and gave way for serious dissection on good governance, (World bank,
1992).

Good governance was further develop in the bank so world bank in 1992 publication
<<governance and development >> in this governance was defined as the manner in which
power is exercised in the management of a countries economic and social resource for
development governance is also optimized by predicable open and enlightened policy
making that is transparent process with a professional ethic an executive arms of
government accountable for its action and strong civil society participating in publicity and
behaving under <<rule of law>>,(World bank,1992).

Good governance refers to a public service that efficient a judicial system that is reliable
and an administration that is accountable to its encompass full respect of human right, rule
of law, effective participation, partnership, political pluralism and attitude and value that
foster responsibility, solidarity, tolerance, and good governance is facilitate sustainable
development by including above elements, (Warsaw,2006).

According to Michael Johnston defines good governance the legitimate, accountable and
effective way of obtaining and using public power and resource in the pursuit of wider
accepted social goals, the accountability, transparency, efficiency in how the public sector,
rule of law and order interaction in politics as the key components of good governance,
(Grindle,2010).

The researcher wants to investigate internal and external challenges of good governance.
Internal challenges are absence of accountability, injustice and gender inequality may
access good governance practice in the case of Arbaminch town first instance court.

1.2 statement of the problem


Good governance refers to competent management of a country resource and affairs in
open, accountable, equitable and responsive it implies ability to perform efficiency,
effectively and responsible guided by principle that are feasible and desirable at all of the
society,(King Bedouin foundation,2007).

The challenges of good governance is lack of adequate awareness about human right
among the institution, lack of accountability, lack of participation, injustice, and lack of
gender equality (Rahmato bantirqu endeshaw, 2008).

However a number of institutions are established to promote justice to protect citizen’s


right and to promote good governance in their service delivery. Court is one among the
government institution that has assign create to agreement of the place and multifaceted
role in the process of establish good governance.

Arbaminch town first instance court institutions related with their problems in the study
area are the following problems. Customers are not to use service on time and response
give do not on time this research would be examine way the customers do not get efficient
service on time.
1.3. Objective of the study

1.3.1 General objective of the study


The overall objective of this research is to assess challenges of good governance in the
case of Arbaminch town first instance court.

1.3.2. Specific objective of the study


 To identify challenges of good governance in Arbaminch first instance court
 To assess the effectiveness of service delivery in Arbaminch first instance court

 To assess opportunities for the enhancement of good governance in Arbaminch first


instance court

1.4. Research question


 What are the challenges that hinder the enhancement of good governance in
Arbaminch first instance court?
 How far the service delivery is effective in the institution
 What are the opportunities to promote good governance in Arbaminch first instance
court?

1.5. Significance of the study


This study would provide some advantage, first and for most this research it creates
awareness to the people about the contributing of the institution especially court I good
governance and its service delivery and secondly, it identify problem in the institution and
it gives response or solution as recommendation and to the on concerned body about the
administration system of the court as wall as it services as a base for other research who
are interest to work in this area and issue.
1.6. Scope of the study
The study would be delaminating to Arbaminch first instance court with a specific
intention to the assess challenges of good governance and hence it would not include all
Arbaminch town.

1.7. Limitation of the study


The research would face some obstacle in the process of conducting of valuable study
including the reluctance of respondents to give information, lack of money and shortage of
time specification. However using different method such as telling the purpose of study and
awarding the research would be valuable study.

1.8. Organization of the study


The study use organizes in the following way four chapters. The first chapter including
introduction, back ground of the study, statement of the problem, objectives of the study,
research questions, significance of the study, research methodology, limitation of the study,
and organization of the study. Chapter two studies to review related literature on good
governance, chapter three studies the analysis of the data, finally chapter four draws the
conclusion and recommendation.

2. REVIEW OF RELATED LITERATURE

2.1. CONCEPT OF GOOD GOVERNANCE

Governance means process of decision making and the way or the process by which
decision are implemented or not implemented and at the same time good governance is the
process where by public institution conduct public affairs is manage public resource and
guarantee the realization of human right in a manner essentially free of abuse and
corrupting and with due regard for the rule of law. Good governance is perhaps the single
most important factor in eradication and promotes development. Good governance is a
term that has become a part of the vernacular of a large of the development institution and
other actors with in the international area, (Gisselquisf, 2012).

The concept of on the responsibility of government and governing bodies to meet the need
to the masses as opposed to select groups in society, because the government treat on the
contemporary world as most, success fully are often liberal democratic states institution.
When talking about governance because the term good governance can be focused on any
on form of governance aid organization and the authority of developed countries often will
focus the meaning of good governance to asset of requirement that conform to the
organization agenda, good governance imply different context, (Polua, eua, rosendahis,
mona,2002).

Good governance is established when public institution act efficiently providing an


enabling environment for economic growth and development. It requires the improvement
of accountability and transparency of public sector agencies with effective fight against
corruption. The effective performance of democratic institution including legislatures is
central element of good governance. The fundamental challenges of developing economies
are ensuring effective governance that provides an enabling environment that insures
social and economic prosperity, (JOSEPH, 1999).
Bad governance was blamed for failures such as bureaucratic obstruction, weak judiciaries,
and political administrative arbitrariness, absence of rule law, corruption and rent seeking
among governors. It was claimed that good governance would emerge through
prescriptive and institutionalized programs for accountability and transparency,
Predictability and rationality and competency in government. Irrespective of the political,
social and cultural histories of individual nations involved, it is still believe that democratic
institution and market based economies can be success fully transferred from north to
south all most overnight in all circumstance, (World Bank, 2000).

2.2. Characteristics of good governance

Good governance has different features some of these are, accountability, efficiency and
effectiveness, transparency, responsiveness, equality and rule of law.

2.2.1. Accountability

Is the act of making public officials those who are elected by the people answerable for the
decision they pass and action they taken in the name of the people in their success and
failure it is key requirement of good governance. Accountability can be classified in to two;
these are internal and external accountability. Internal accountability is set by government
itself to protect, public interest instituting various system and incentive to govern the
behavior of different agencies. External accountability is the process by which the people at
large are in external to the formal institution of government themselves the government
responsible, (Dluieved quote in join, 2007).

2.2.2. Efficiency and Effectiveness

Good governance means the process in which produce results that meet the need of society
which making the best use of resource at their disposal. The concept of efficiency in the
context of good governance is covers the sustainable use of natural resource and the
protection of environments. Efficiency refers the contest to which a system meets its goals
to maximize the welfare of its citizen’s effectiveness is the ability of a system to deliver it
promote one time and as a described by It members, (UNDP, 1997).
2.2.3. Participation

Is come stone of governance participation could be either directly through legitimate and
intermediate institution or respective participation needs to be informed and organized
civil society on the other hand, (Alamirew, 2005).

All those people who acquire interested in a decision should have the opportunity to
participate in the process for making decision. The participation can be done in a number
of ways as they can actively participate in community meetings, in the meetings people can
be asked for their opinion, given the opportunity to make suggestion, (Mitali Sharma,
2016).

2.2.4. Transparency: Is the decision making process must be followed and made
understood by the people. This means that they will be able to understand see how and
why a decision was made. The requirements are what information, advice and consultation
council considered and which legislative requirements when relevant council followed,
(Mitali Sharma, 2016). Transparency is one of the principles of good governance which
refers to the existence of an open government whose decision making procedures are clear
to everybody who wishes to know about then, (Mohammed Salah, 372).

2.2.5. Responsiveness

Responsibility refers to a duty or obligation that is interested to an individual or group of


people. It is also the duty of not to do something that is not desirable, (Alamirew, 2005).

Responsiveness is refers to effective planning evaluation with regard to particular action as


well as the conduct of regular review process to ensure that programs reflect the needs and
preference of stake holders, (Nguyen and wescott,2008).

2.2.6. Consensus oriented

There are several actors and as many viewpoints in a given society. Good governance
requires mediation of the different interest in society to reach a brood consensus in society
on what is in the best inters the whole community and how this can be achieved. It also
requires a broad and long term perspective on what is needed for sustainable human
development and how to achieve the goal of such development. This can only result from
an understanding of the historical, cultural and social context of a given society or
community,(UNEESCO,2005).

2.2.7. Equity and inclusiveness

Equity is the sharing of power leads to equity in the access to and use of resource women
and men must participate as equal in all decision making priority setting and resource a
location process, includes is every one where the poor young or older persons, religious
and ethnic minorities or the hand capped are included,(Aere,2000).

2.2.8. Rule of law

Good governance requires fair legal frame works that are enforced importantly. It also
requires full protection of human right particularly those of minorities. The practice or rule
law ensures that everybody and all decision and action are run according to it,(Jion,2007).

2.3. Benefits of good governance


The flourishing o good governance provide different advantages such as primarily, it
promotes community confidence is people more likely to have confidence in their local
government if decision are made in a transparent and accountable way and it also
encourage local governments to remember that they are accurate on behalf of their
community and help to understand the importance of having open and ethical process
which adhere to the law and stand up to, secondly, it encourage elected members and
council officers to be confident that means elected and council officers will feel better about
their involvement in local governmental when good governance is practiced and officers
will feel more confident in providing frank and fairness advise which acknowledge and
respect councilors. Thirdly it leads to better decisions that are informed by good
information and data by stake holder reviews and by open and honest debate will generally
reflect the broad interest of the community; fourthly, it helps local governments meet its
legislative responsibilities. If decision making is open and able to follow by observers it is
more likely that local governments with comply with the relevant legal requirements. And
lastly, it support ethical decision making good governance create an environments where
elected members and council officers ask themselves what the right thing to do is, when
making decision,(Joseph Rowntree,2004).

2.4. Condition to promote good governance


The promoting of good governance needs different preconditions the first one is, technical
and managerial competence of civil servants is an obvious factor of good governance. They
may be less of a constraint than it used to be as access to education has improved, but rapid
changes requires on going developments of skills. At the same time organizational capacity
is needed on this rather than simply relying only on political will, personal will of strong
leader and state power which may not be sustainable over the long term, (NUDP, 1997).

Having skilled staff is not sufficient is the governmental organization doing not have the
capacity to make good use of these skills. The other one is reliability, predictability and rule
of law it means that decision taken by governmental must be founded in law and that
private firms and individuals are protected from arbitrary decision and reliability retires
governances that is free from distortionary incentives through corruption patronage or
capture by narrow private inters groups and accountability it is a key way to ensure that
power is used appropriately and in according with the public interest and it requires clarity
about who is accountable for their decision and performance. In addition to the above,
transparency and open information system are the other conditions. it is an important
aspect of good governance and transparent decision making is crucial for public sector to
make sound decision and the last but not least participation it involutes consultation in in
the development of politics and decision making, election another democratic process
general three institutions can be reformed to promote good governance namely the state
the private sector and civil society, (UNECAP, 2009).
2.5. Challenges of good governance
The obstacle for the performing of good governance so the impediments we can
categorized in to two, external and internal challenges of good governance

1. External challenges for promoting good governance


*Weak enabling environmental at the country level it means the need to implement
mechanism in difficult environmental with very little political buy in from
government.
*Donor harmonization lack of harmony in door strategic vision and activities.
*Weak capacity and credibility of national or engage in demand for good governance
mechanism.
*Dependency on donor support in terms of both funds and man power risk of
politicization elite capture and frauds, (Indian corrupt, 2005).

2. Internal challenges for promoting good governance

*The absence of accountability and rule law: is the major challenge to promote good
governance in the institution that shows lack of freedom to people to do the government
officials sometimes put themselves above the rule of law.

*Injustice: injustice injury or wrong governance these nouns do note acts or conditions that
cause people to suffer hard or less undesirably.

*Gender inequality: equality is guaranteed by the constitution of our country 25 of FDRE,


but the gender inequality is in different institution.

*Poverty: poverty is a major challenge to good governance in developing countries like


Ethiopia and this poverty leads civil servants to corruption the high level of corruption has
been widely perceived as a major obstacle in improving of quality of good governance,
(Indian corrupt, 2005).
The general challenges for promoting good governance are
. Lack of resource in the government to full fill its functions
. Lack of equal participation and free and fair election
. Civic neglect on exaggerated desire for easy living can be serious threatens to good
governance
. Economic depression; economic problem are also known in endangering good governance
in a country which the economy is weak. Good governance has the possibility to lose
ground and the last one is bureaucracy in a country which the bureaucracy is tight the
bureaucracy takes too much of the governing. This affects the authority of elected
representative to work their capacity. Thus the challenges of good governance need to be
redressed to ensure sustained democracy public life should be improved people should be
educated so as to cultivate the culture of democracy and good governance, (Kassaye, 2007).

2.6. The role of institution in building and promoting


good governance

In present day political system institution and good governance the two face of same coin.
The same to that of promoting good governance all as pacts of good governance are
facilitated by strong and control of institution with in society. The institution allow for
ongoing check and assessment by public on the activities of the government and assist in
bringing public concerns and choices to be open by providing a plat form for discussion.
This is therefore the concerts link between the function of the institution and good
governance , democratic good governance system heavily reality relies on the institution as
an outside checker and balancer to keep governance to the people for the society to have
god culture of good governance timely and properly administrative system, the democratic
needs ideal of good governance which enacts the will of the people requires an informed
population that can reach good conclusion through open exchange of ideas. This means the
institution is power full linkage between the governing and the governed building an
informed citizen and culture a responsible institution has an important role in upholding
freedom help the popular to practice culture of good governance by giving them the voice
to be heard and headed the information for people to make choices decide rationality and
take the right the right course of action and beneficial to them,(UNESCAP,2009).
To conclude in modern governments to exercise power that is effective hones equitable
transparent and accountable at various levels. Scholar argue that good governance depend
on the ability to power and to make decision over time across spectrum of economic, social,
environmental and other areas this is linked with government capacity for knowledge
mediation, resource allocation implementation and maintenance of key relationships.

exist about the key issue in relation to good governance and this includes technical and
managerial competence, organizational capacity, reliability, predictability, and the rule of
law, accountability also sustainable development is impossible without viable and inclusive
governance system to this end, the government of Ethiopia has built a system where by
democracy and good governance have been gravened for all most two decades,(IMF,2005).

To further facilitate and accelerate the implementation of good governance e the


government has introduced different management tools along with civil service reform.
These tools include business reengineering (BPR) and balanced scorecard (BSC) the tools
help to measure the extent to which service are provide for customer, how the civil servant
perform to deliver the intended service low much the customer are subtitled with the
service among other. However there are still certain loop holes and bottle necks remaining
to be hindering good governance not to prevail on its full sense particularly relation to
provide customers with speedily and equitable various in level or forms, (IMF, 2005).

CHAPTER THREE
3. Research methodology

3.1. Description of the study area


Arba Minch town is located in gamo gofa zone of the south nations, nationalities and
people’s regional states, 505km from Addis Ababa. The town’s location can be expressed as
geographical as six degree, thirty minutes east latitude. The town has been established in
the 1955 Ethiopian calendar as capital city of gamo gofa province and it is now the capital
of gamo gofa zone. The total area of the town is 2184 hectare. The town is with in greatest
in African rift valley as the result of this; it has relatively hot (kola) climate conditions. The
average annual rainfall and temperature of the town are 800-1000mm and 29 degree
centigrade respectively. Topographically, the town has attractive land scape and the
altitude of the town 1200-1400m above sea level. The Lake Abaya and chamo. The Kulfo
River and numerous springs are important water recourse of the town. Natural gift such as
Nachsar national park, the famous crocodile ranch, lake chamo, Lake Abaya, God bridges,
natural forest and forty springs and the side wall of the great African valley are around the
town. The presences of these natural gifts and attractive topographic landscape would
make town tourist center, (Arba Minch city administration, 2009).

3.2. Research design


The research designed to identify problems related assess challenges of good governance
in the case of Arbaminch first instance court. The research design of this study would be
descriptive research design. Descriptive research design is attempts describe
systematically a situation, problem, phenomenon, service or Program or provides
information about say living condition of a community or describe attitudes towards on
issue. The research method that researcher would use in this study both qualitative and
quantitative method of research design. In this study the researcher also would use data
gathering tools such as questionnaires and interview in order to prepare accurate data
from respondents.
3.2.1. Source of data

3.2.1.1. Primary data source


For the purpose of this study the primary data are important which would be obtained
from primary data source through interview and questionnaires. Form of interview is to
ask face to face interview the employers and customers and questionnaires is open ended
and close ended questionnaires.

3.2.1.2. Secondary data source


Like as primary data, secondary data are also important for the purpose of the research.
The important and relevant data would be obtained from different written materials such
as, journal, internet access and together from books are proposed as a secondary data
source of this study.

3.3. Sample size


The researcher would select 50 customers respondent as the sample size out of 6890 total
population of Arbaminch first instance court to customers. The researcher would select this
sample is that are sample size increase it difficult to manage data collection from customer
and during data collection to consume time and money. The researcher select in the

3.4. Sample technique
The sample technique would be both random sample and purposive sample technique to
select respondents. The researcher would be select the respondents three key informants
would be selected by purposive sample technique because the researcher believe that
relevant information would be obtained and the researcher would select 50 respondent
select by using random sampling technique select to represents customers. This is because
to get adequate and clear information, the issue concerning challenges of good governance
in Arbaminch town first instance court.

3.5. Data collection instruments


The study would be using various data gathering methods. There are many data collection
techniques, but interview and questionnaires would be data collection method for this
research purpose.

Questionnaires: for this study self-administered questionnaires would be used to collect


relevant information from customers. The questionnaires would have both close ended and
open ended questions to collect data from concerned respondents. Close ended means
question to answer only yes or no answers and open ended is question to answer yes or
answers to explanation and to put reasons. That means questionnaires are data collection
tool in which written form.

Interview: is a data collection technique that interview oral questioning of respondent


either individual or as group. This are discussion usually one on one between an interview
and individual, meant together information on specific set of topics, it can be conducted in
person or over phone.

3.6. Method of data analysis


The researcher would collect all necessary data from the key informants through
questionnaires and interview would be analysis by both qualitative and quantitative
method of data analysis. The researcher collect data from the respondent through
questionnaires are analysis by using quantitative method such as percentage and table
form. The researcher select table and percentage to analyze quantitative data for the fact
using table and percentage simply for easy of comprehension so as to make the reader to
understand the meaning of the data easily. The collect through interview would be analysis
through qualitative method by explanatory method or to clarify why and how there is a
relation between two or more aspect of situation or phenomenon. Hence, this study would
be analysis and interpret by using the data gathering instruments such as questionnaires
and interview.

CHAPTER FOUR
4. DATA ANALYSIS AND INTERPRITATION

In this chapter the researcher reports presents both quantitative and qualitative data
analysis in the form of table and clarify the questions. With frequency and percentage
followed by their interpretation. It deals with data gathered through the questionnaires
’and interview is presented and analyzed. In addition to this the questionnaires were
distributed to so customers by using random sample techniques and simply interview also
gathered for three servants in the institution. Therefore the result and the analysis of the
finding data presented as follow.

3.1. Back ground of respondents

In this part the back ground of respondents is presented in the form of sex, age, and
educational level.

According to table 1, among the respondents the research selected in Arba Minch town first
instance court the sex respondents 33(66%) of male respondents and other side 17(34%)
of female respondents these shows that, the number of male in the institution are more
than female and the condition of male participation is good when it saw relatively with the
number of female respondent s then the institution were lack of equality and lack of good
participation
With regard to age of the respondent many of them are between 26-33 were the data
indicated. This means more than the other age respondents are matured and through this
age is important to promote good governance this age of respondents to assess the
challenges of good governance this institution.
With regard to educational level of respondents indicates half of the respondent are degree
level means 25(50%) of degree respondents, 15(30%) of diploma and 10(20%) of
certificate respondents based on this many of customer of the degree to response the
question. Because of their education level was easy to understanding the good governance
rather than other respondent but not all.

According to the above table, most of respondent 36(72%) of low respondent said that
good governance in the institution is at low position or not good. But the institution today
giving service is very low means the customers or between the servants of the employers in
the institution is not to protect the time of customer; employers are less respect to the
customers and strengthening of the decision.
On the other hand 8(16%) of medium respondent, because the employers are less
transparent and employers are not to respect on the time for the customers and not to
response on tome to the customers and other is 6(12%) of very good respondent for the
assessing challenges of good governance in Arba Minch town first instance court.

According to above table 28(56%) of the respondents are dis agree. Because half of the
respondents were the institution has low transparent to the people and legal body’s, this
also indicated that the institution is not fully transparent but employers are not full
transparent to customers and employees. Since transparency is one of the principles of
good governance the institution is currently at bad position. On the other hand 22(44%) of
respondents are justified as the institution is any information it has bad relation with
people and customers for assessing challenges of good governance in Arba Minch town first
instance court.

As shown the above table, the half of the respondents 31(61%) of the replied that Arba
Minch town first instance court is not giving necessary and effective service to its
customers. From this we can conclude that as the Arba Minch town first instance court is
not giving necessary service in an effective way to its customer and in turns this leads to
decrease the trust of public to the government. The Arba Minch town first instance court
civil servants do not perform their work effectively due to the following problems: lack of
transparency, rent seeking, long decision making, lack of good governance and some time
the existence of corruption from the above problem Arba Minch town first instance court
does not give effective and necessary service to the customers. In other case the other
respondents 19(38%) replied that Arba Minch town first instance court giving necessary
and effective to its customers.

According to the above table, 30(60%) of respondents said no. because the responses as
the institution should not provide speedy service for customers on the time and there is no
response on the time, they were not timely respect appointment or strengthening the
appointment employers for the customers responses. The employers were not to give
decision for the customers, because the employer’s interest is to talk the different incomes
but not all employers at that time the response is give on time.
On other hand 20(40%) of respondents said yes. Therefore the Arba Minch town first
instance court should need to reduce such problem which hinder to good governance.

According to the above table, the half of the respondents 33(66%) of them replied that the
customers are not being treated no an equal basis by the employees of the court from this
we can conclude that the civil servants of Arba Minch town first instance court do not treat
the customers equally. This leads the customers to extra challenges, because the
respondents these replied no explained their responses based on what has the civil
servants of Arba Minch town first instance court discriminate the respondents based on the
same relation they have with the customer that includes based no relative or blood
relation, friend ship, rich and poor/personal benefits / and based place back ground and
others. While the remaining 17(34%) of the respondents claimed that the opposite and
hence they concluded that the customers receive an equal treatment by the employees of
the court.

According the above table, the half of the respondents 27(54%) of them claimed that there
is no periodical discussion with different customers in the court. From this we can
understand that as there is no plat from to discuss and there is no communication with the
society or the customers of the court did not get basic information from the court. This
means the courts did not giving information or create awareness to its customers. While
the remaining respondents 23(46%) of them were replied that there is periodical
discussion on in the Arba Minch town first instance court with different customers.
Line with interview for the employers concerning on the officials report their work time,
the respondents replied that yes they report their work timely. They report their works
such as their decision for who accused and accuser, their weekly work efficiently, the
problem for the functioning one to five unities are the works that they report timely for
concerned officials or body.
According to one of civil servants of the court has two parts in their institution registrar
and the main body of the decision makes /chilot/ and there is also higher and low position
starting from president to institution keeper /wordiya/. So the middle employer servants
are report to the higher and strive to promote good governance. Report to the higher and
the higher report to the registrar and registrar also report to the final president decision
maker/chilot/. Therefore the institution is report their work and strives to promote good
governance.
Concluded that customer said that there are challenges for the institution and employers
said that there is no challenge in the institution. Both are not equal understanding about
their institution duty/activities these are also become challenge.

As the above table indicates 26(48%) of the respondents were dis agree. That there are no
opportunities of customer in the institution to flourish good governance this indicates Arba
Minch town first instance court did not considered the customer interact rather the court
considered their own interest this leads to the question of customers about good
governance is service delivery of the court. The court become , lack of giving clear
information about god governance with their actions and decision to its customer, lack of
accountability to its customer, lack of justice which indicates un just action of court. So by
this reason the respondents dis agrees with opportunities of the institutions to flourish
good governance. On the other side 24(48%) of the respondents are agree with
opportunities of the customers in the institutions to flourish good governance.

5. CONCLUSIONE AND RECOMMENDATION

In the above chapter the attempt to analyze this is obtained from the respondent and such
as current condition. The assessing challenges of good governance as well as the role of the
government to support its assessed in the paper. In addition to this, this chapter presents
the conclusion and recommendation parts the research based on the data presented in the
above chapter.

5.1. CONCLUSION
Based on the finding the researches in chapter five of this study the researcher able to
make the following conclusion. With regard to the current condition of the Arba Minch
town first instance court applies different elements of good governance in its day to day
provision of service is lack of efficient and effective service. In addition to the application of
the element of good governance, there are different problems in the court in its current
condition in relation to good governance. About its challenges, the current have both
internal and external challenges of good governance. For instance the internal challenges of
good governance are: absence of accountability, lack of rule of law, injustice, poverty, and
lack of freedom for people to do the above the rule of law and the external challenges of
good governance like, weak enabling environmental at the country level, donor
harmonization lack of harmony in door strategic vision and activities, weak capacity and
credibility of national and dependency on donor support. On the other to solve the problem
with in it because the problems override the challenges. With regard to the challenges,
there are different challenges in the institution for use customers which hinder of good
governance from different perspectives. Such as the institution is for use customers the
response is strengthen decision, the customer’s receive unequal treatment by the
employers of the court, the institution is not giving necessary and effective service to its
customer, lack of transparency, long decision making, court did not giving information or
create awareness to its customer, court did not consider the customer interests rather the
court considered their own interest and finally lack of justice which indicates un just action
of the court. In this way the researchers try to assess the entire general and specific
objective to the research in its conclusion.

5.2. Recommendation
The researcher forwarded the following recommendation based on the finding the chapter
five and the conclusion. The institution should use its opportunities effectively to overcome
problems to reduce through the opportunities are less when I come to the problem in it and
today problems of the institution is the employers are reluctant to participate lower
officials in training transfer of appointment repeatedly to different time should be solved
because this affects the institution negatively. Moreover this, since the customers are not
use service on time and response don’t on time the institution for the customers this is the
major problem of the institution. The institution should recruit the individual servants
based on merit (performance, quality and capacity) then the simple selection criteria:
 The customer /individual servants to done their responsibility based on rule of law
or the law of land and these customer no obedience these principle to stipulate
different sanction.
 The governments are equal provision without discrimination for the institutions
then, to promote good governance or to solve the problem of the institution to give
information for the customer.
 The officials are not work in order to promote and respect principle of ethics such
as, accountability, transparency, honesty and justice etc.
 Finally even though the administration system is not good insuring effective in the
provision of service for the customers, therefore one- to- one organization of official
is also better because it helps the lower official share experience from higher
officials, but the lower officials are not to share experience for the customers, so the
institution should reduce this type of challenges to assess.
 To this end the researcher limited on this area and topic because of different
limitation however it would be better if this topic conducted in deep manner. So as
general recommendation the employers should engage to solve this type of problem
and the area the research should also many areas.
