Decommissioning Deadlines

Stipulation established a “No-Shutdown” clause if aggregate in-city generation


fell below 80% of the total in-city peak demand

February 1, 2008 - based on a NYISO June 1, 2006 ruling


February 1, 2009 - based on a NYISO June 1, 2007 ruling
January 31, 2010 - No mechanism for NYPA or a subsequent owner
to generate from the Poletti Plant past 1/31/10

Operation Restrictions
After CO of 500MW : Poletti restricted to 30% annual capacity factor
Fuel oil restricted to 20-33% of heat input 2006/2007
Generation beyond 2008: Fuel oil restricted to 10%
