A RESOLUTION OF THE ENERGY REGULATORY COMMISSION -

BIDS AND AWARDS COMMITTEE (ERC- BAC) RECOMMENDING
FOR THE APPROVAL OF THE UPDATED ANNUAL
PROCUREMENT PLAN (APP) FOR THE CALENDAR YEAR 2017

WHEREAS, the 2017 APP was approved per ERC BAC Resolution No.
37, Series of 2016 entitled '~Resolution of the 2016 ERC Bids and Awards
Committee (2016 ERC BAC) Recommending for the Approval of the ERC
Annual Procurement Plan (APP) for the Calendar Year 2017 dated 7
November 2016 (attached as Annex "A");

WHEREAS, the ERC-BAC deemed it necessary to update the ERC's

2017 APP to reflect the revisions in the PPMPs submitted by the end-users.
The new and updated APP shall serve as the basis for the ERC's procurement,
and only those goods, services or projects included therein shall be carried
out for bidding within the calendar year 2017;

WHEREAS, Section 7.2 of the Implementing Rules and Regulations

(IRR) of the Republic Act No. 9184 (Government Procurement Reform Act or
GPRA) states that: "No procurement shall be undertaken unless it is in
accordance with the Approved Annual Procurement Plan (APP) of the
procuring entity. The APP shall bear the approval of the Head of Procuring
Entity or second-ranking official designated by the Head of Procuring
Entity to act on his behalf and must be consistent with its duly approved
yearly budget";

WHEREAS, Section 7-4 of the IRR of the GPRA also provides that
"Updating of the individual Project Procurement Management Plan (PPMP)
and the consolidated APP for each procuring entity shall be undertaken
every six (6) months or as often as may be required by the Head of the

Procuring Entity. The updating of the PPMPs shall be the responsibility of

the respective end-user units of the procuring entities, while the
consolidation of these PPMPs into the APP shall be lodged with the BAC
Secretariat, subject to approval of the Head of the Procuring Entity";

WHEREAS, the members of the ERC- BAC has resolved to use the
term Small Value Procurement (SVP) and Shopping as mode of procurement
in the 2017 APP, instead ofthe previously used term Alternative Method, to
be consistent with Section 53.9 of the Implementing Rules and Regulation
(IRR) of Republic Act No. 9184 (Government Procurement Reform Act or
GPRA). Under the said provision, SVP is defined as "Procurement of Goods,
Infrastructure Projects, and Consulting Services, where the amount
involved does not exceed the threshold prescribed in Annex "H" of this IRR:
Provided, That in case of Goods, the Procurement does not fall under
shopping in Section 52 of this IRR.";

WHEREAS, for National Government Agencies (NGAs),

Governement-owned or Controlled Corporations (GOCCs), Government
Financial Institutions (GFIs), State Universities and Colleges (SUC), and
Autonomous Regional Government, the amount involved for SVP and
Shopping should not exceed One Million Pesos (PhP1,000,000.00), as
specified in Annex H of the GRPA IRR;

NOW, THEREFORE, We, the Members of the Bids and Awards

Committee (BAC), hereby RESOLVE to recommend to the Head of the
Procuring Entity (HoPE), ERC Chairman and Chief Executive Officer
(CEO) JOSE VICENTE B. SALAZAR the approval of the Updated
Annual Procurement Plan (APP) for Calendar Year 2017 which is
made an integral part hereof (attached as Annex "B");

CONCURRING OPINION

BAC MEMBER T.G. ARBALATE:

During the BAC meetings dated 10 February 2017, 13 February

2017, and 22 February 2017, I consistently proposed to include the
"Pres. Rodrigo R. Duterte's VETO Letter on the General
Appropriation Act of FY2017" in the BAC Resolution No. 11, Series of
2017 stating the "veto provision" as follows:

WHEREAS, there is a need for the ERe to disburse its

approved budget in order to avert any devastating effect, as
stated under the President's Veto Message dated 22 December
2016, particularly Sec III A. Availability of Appropriations
thereof, to wit:

"xxx hereby direct all agency heads to ensure

obligation of all programs, activities and projects
funded under this Act not later than December 31,
2017. Failure to do so might have a devastating
effect. This promotes not only good fiscal policy but
more importanly, guarantees that public services are
given to the people the soonest possible time.
(Emphasis supplied)"

And, during the said meetings they did not object with my proposal
but ONLY when it was routed to the BAC members for their
signatures that they suggested the omission of said "veto provision".
BAC Members N.v.Padilia and L.L.Galang (comprised of the majority
votes) informed the BAC Secretariat Member Janice Pendon to
.'
remove said provision since it has nothing to do with the approval of
the Updated 2017 Annual Procurement Plan (APP). Considering the
time to be consumed, I suggested to Ms. Pendon to remove said
provision and I would write a separate opinion clarifying the
importance of it.

Contrary to the opinions of BAC Members Padilla ang Galang, the

inclusion of the above provision in the BAC Resolution is very
important with the following reasons:

1) With this "powerful provision", all end-users should aware

that all projects should be included in their PPMP for
procurement purposes;

2) If we failed to obligate the GAA 2017 funding, our agency

will suffer the consequences or face the "devastating effect"
or the agency's future funding will be in great peril;

3) This provision will serve as a reminder to all BAC members

including TWG and BAC Secretariat to perform their duties
as mandated in Section 14.3 IRR RA9184 of there "jury
duty" which stated as follows:

To expedite the procurement process, the HoPE

shall ensure that the members of the BAC, its
Secretariat and TWG, shall give utmost priority
to BAC assignments over all other duties and
responsibilities, until the requirements for the
said assignments at hand are completed.

4) That all Service Directors or end-users should be informed

to support the BAC in the performance of their functions.

Accordingly, I agree with the issuance of this BAC Resolution No. 11,
Series of 2017 with emphasis on the utilization of funding per
President Duterte's mandate to obligate the 2017 GAA allotted for
ERC until 31 December 2017 ONLY or face the "devastating effect".
