MOTION TO ADJUST HEARING

AND TO POST COURT ORDER
PETITIONER, by counsel, unto this Honorable Court most
respectfully avers: THAT---

1. On 13 November 2014, the Honorable Court issued an Order

resetting the hearing on 5 February 2015, to enable the OIC Clerk of
Court to comply with the posting of the Order of the Court setting the
initial hearing of this case.

2. On 5 February 2015, the Honorable Court issued an Order

which the petitioner received on 6 March 2015, resetting the hearing
on 30 April 2015.

3. On 30 April 2015, petitioner was informed that this case was

heard on 23 April 2015, only to be reset again to 23 July 2015.

4. However, petitioner’s counsel has a pre-scheduled out-of-

town hearing of another case on July 23, 2015, and hereby requests
for the adjustment of this scheduled hearing.

5. The court interpreter suggested Thursday, 13 August 2015

as the preferred date in the court’s calendar in lieu of 23 July 2015.

6. Moreover, per inquiry with the OIC Clerk of Court, she was
not aware of the 13 November 2014 Order to comply with the posting
of the Order of the Court setting the initial hearing of this case.

7. This motion is not designed to delay the proceedings of this

case but is based on valid and reasonable ground.

WHEREFORE, premises considered, it is respectfully prayed of

this Honorable Court to adjust the hearing of this case from 23 July
2015 to August 13, 2015 at 8:30 o’clock in the morning, and for the
OIC-Clerk of Court to comply with the 13 November 2014 Order,
which directs her to post the Order of the Court setting the initial
hearing of this case.
