MARK KENTWELL WELCOMES INDEPENDENT REVIEW OF OPERATIONS

Mark Kentwell, founding director of PRD Presence, maintains that all times, his businesses have
complied with the requirements and obligations imposed on licensees in accordance with the
Property and Stock Agents Act 2002 (NSW) (the Act).

To date, Mr Kentwell has not been approached by NSW Fair Trading (OFT) in respect to the
allegations made by both the ABC and the Newcastle Herald. Should OFT approach him, Mr
Kentwell will participate and assist with any review of his business interests, while undertaking
his own internal compliance audit.

In any event, Mr Kentwell has, prior to the respective publications in the media this week, sought
and obtained confirmation from the OFT that his association with Henderson Advocacy is not in
breach of the Act.

All data that is held by and shared with The Growth Centre has been obtained lawfully pursuant
to contractual relationships between the relevant parties. The sharing of the data is adequately
disclosed and consented to and all relevant parties take reasonable steps to protect the integrity
of the data and to avoid unauthorised use or disclosure.

Referrals within all industries, not just real estate, are common and relevant industry
professionals agree that referrals should not be discouraged provided adequate disclosures are
made. Disclosures are made when necessary, such as when the parties enter into an agreement
for the provision of services following a referral.

Mr Kentwell said “PRD and its associated companies represent the interests of our clients to the
highest degree, which is a major reason why they are the market leader with home sellers in the
region.

“We comply with all of the regulations regarding disclosures and acting in the best interests of
clients.

“Each business represents the interests of clients on its side of a transaction and has its own
independent license and licensee. In my capacity as a licensed agent, I am only involved in the
selling side for Kenterprise Pty Ltd which trades as PRD Presence. I am not a shareholder, director,
or licensee of Future Property Co Pty Ltd trading as Henderson Advocacy nor a beneficial owner
of any linked entities.

“We are continuously improving our systems and compliance procedures to ensure we are
exceeding the rules governing the real estate industry and I am confident we will emerge from
any review without fault”, he concluded.
