AFFIDAVIT OF DESISTANCE
  
I, CHERYL M. DIMAYMAY, of legal age, single/live in, and a resident of
Sitio Saceda Compound 23-A. Lopez St., Brgy. Calamba, Cebu City, after having
duly sworn to in accordance with law hereby depose and state:
 
1. That I am the complaining witness and private victim for violation of R.A.
9262 (VAW-C) Physical Abuse against Rena Bejasa Lopez, entitled
"CHERYL M. DIMAYMAY versus RENAN B. LOPEZ", NPS DOC. NO. VII-
09-INV-18H-02178, pending at the Office of the City Prosecutor, Cebu
City.

2. That after my sober and soul searching assessment and analysis of the
incident, and since the accused sought forgiveness with me for the charges
I have filed, it is my unconditional desire to have the COMPLAINT
dismissed because I have already forgiven the accused.

3. That in the spirit of reconciliation with the accused and for his show of
sincerity and humility towards me, I am permanently withdrawing my
complaint against him. I clear him of whatever responsibility or liability to
me.

4. That I hereby inform the City Prosecutor of Cebu City that I am

withdrawing my complaint for violation of R.A. 9262 (VAW-C)
Physical Abuse against Renan B. Lopez.

5. I likewise request the City Prosecutor of Cebu City to dismiss with

prejudice the said criminal COMPLAINT, and I am no longer interested to
testify and prosecute the accused.

6. I am executing this affidavit voluntarily, without any force or intimidation

from any person including the accused.
