MINUTES OF MEETING

EPC CONTRACTOR COMMITMENT ON


SKILLED MANPOWER & EQUIPEMENT MOBILIZATION
FOR THE ACHIEVEMENT OF THE COD

Venue/Date: PSG Office, Vientiane, 04 September 2020

Objectives of the Meeting:


• Report on delay of the works
• Reach a mutual agreement on EPC Contractor’s commitment on mobilization of skilled manpower
and equipment to catch-up delay and to achieve the COD.

1. Works Delay As of today, the construction works are delayed by lack of skilled
manpower/ equipment mobilization by the Contractor

In summary the overall progress (S-Curve) is 5 months behind


the revised schedule of October 2019. The current rate of
progress is less than 50% of the planned progress. If the
Contractor keeps this rate, it will take almost 1 year to get to
where they should be today.

2. Construction The Contractor has revised the Construction (Attachment No.1).


Schedule
The schedule needs to be revised by the Contractor to include: 11 Sep. 20

- BALINO Schedule (Manufacturing, Delivery, Erection and


Commissioning) to be linked to powerhouse civil works
activities

The Contractor guarantees a COD on 31 October 2021 instead


of 30 June 2021 (+ 4 months) and a completion of civil and
hydromechanical works on 30 June 2021.

The Owner and Consultant do not agree and request the 15 Sep. 20
Contractor to keep a COD on 30 June 2021 and to submit a
Mitigation Plan.

3. Concreting The Contractor to prepare a daily/weekly/monthly concreting


programme in respect with the Construction Schedule.
Programme
The concreting programme to be submitted for Consultant 07 Sep. 20
approval.

4. Earthworks The Contractor to prepare a daily/weekly/monthly earthworks


(excavation + backfilling) programme in respect with the

Construction Schedule.

The earthworks programme to be submitted for Consultant 07 Sep. 20


approval.

5. Skilled The Contractor to mobilize skilled manpower on site in respect


with the agreed construction schedule (Attachment No.1).
Manpower
Mobilization This mobilization plan to be revised after the submission and As per
approval by the Consultant of the construction method Attachment
statements (Attachment No.4). No.4

The Contractor to provide, for Owner/Consultant review,


updated organization chart showing teams allocated for each
construction area and supporting teams (Design team, 11 Sep 20
geologist/geotechnical engineer, scheduler, QA/QC engineer,
QS engineer, procurement manager, warehouse manager, etc..)

The Contractor to provide CVs of Key Personnel with good


experience in hydropower construction management and good 11 Sep 20
communication skills in English.

6. Equipment The Contractor to mobilize skilled manpower on site in respect


with the agreed programme (Attachment No.3).
Mobilization
This mobilization plan to be revised after the submission and As per
approval by the Consultant of the construction method Attachment
statements (Attachment No.4). No.4

7. Detailed The Contractor to complete remaining detailed design as per the


Consultant comment sheets on:
Design
1- Auxiliary Dam typical cross section
2- Surge tank height increase
3- Penstock steel grade, thickness increase and foundations
4- Powerhouse EM Auxiliaries.

design/construction interfaces coordination with BALINO to
avoid design/construction delays.

8. Construction A list of required construction method statements has been


prepared by the Consultant (Attachment No.4).
Method
Statements The Contractor to update the list and submit to the Consultant 07 Sep 20
for approval.

9. Conclusion The Owner acknowledges the EPC Contractor’s commitment on


mobilization of skilled manpower and equipment to catch-up
on EPC
delay and to achieve the COD (30 June 2021).
Contractor
Commitment The mobilization must be effective on 01 October 2020.

The Owner will keep monitoring the progress of the mobilization


during the month of September 2020.

If by 16 October 2020, the EPC Contractor fails to meet his


commitment then:
1. The Owner will issue last warning letter to the EPC
Contractor and terminate the EPC contract,

2. The EPC Contractor may continue with the project


construction activities however the owner may revoke
part of the contracted works and outsource them to a
qualified Contractor such as water way, surge tank and
other works which in the opinion of the owner the EPC
Contractor is being delayed or has delayed. In case of
outsourcing, the unit price will be based on local market
price or as defined by ministry of public works and
transport and being in use. The payment of outsourcing
work will be deducted from EPC contract value.
