The Jackson Hinds Library System in partnership with the City of Jackson is preparing a Congressional directed spending application at the invitation of Mississippi Senator Cindy Hyde-Smith’s Office. Following a Board work session presentation by Cady Cooper from Senator Cindy Hyde-Smith’s Office in Washington DC, the Board leadership is called a critical emergency meeting to prepare to apply for up to $5 Million in THUD funding with the 2024 federal budget process. The Jackson Hinds Library Systems has critical library repairs that need to be made to sustain our system for short and long term. City of Jackson Department of Planning will submit a grant application to the Subcommittee on Transportation, Housing and Urban Development, and related Agencies for the purchase, relocation, renovation and buildout of a new Eudora Welty Library in the City of Jackson ~ in collaboration with Jackson Hinds Library System Your consideration in this matter is appreciated. Chloe Dotson Guidance for THUD CDS by Account For all THUD CDS accounts, Members are required to provide the following information in Legi-Mate: Project Name ~ this should be a unique name of the project meant to easily identify and distinguish the project (e.g. “Electrification of Burlington Bus Route 40”, or “ABC Affordable Housing Development”). Project Purpose ~ this should include the project name and a very short explanation of what the project will do (e.g, “Electrification of Burlington Bus Route 40 to improve transit service along a corridor and reduce carbon emissions”, or “ABC Affordable Housing Development to construct senior housing for the ABC”). Highways (HIP). ‘¢ Members can request CDS within the HIP account for highway projects eligible under title 23, United States Code, including, but not limited to, highway and bridge construction projects, planning, environmental review, design, and right-of-way acquisition. Operational expenses are not eligible. * All highway CDS funds will be provided directly to your State Department of ‘Transportation, «If the local or county level government is requesting the CDS, they will be required to coordinate with the State DOT to receive the funding and ensure a non-Federal match is available. Economic Development Initiatives (EDIs). ° Members can request funding for EDIs within the “Community Development Fund” account for activities eligible under section 5305 of chapter 69 of title 42, United States Code, as well as for affordable housing construction. The Committee encourages Member offices to pursue projects that address affordable housing, community services, and economic development. Examples of eligible EDI projects include, but are not limited to: (© Acquisition of real property (land, water rights, buildings); Construction of new affordable housing; Blight removal or remediation; and, Construction, rehabilitation, and improvements of public facilities (except buildings for general conduct of government), such as neighborhood centers,parks, and shelter for persons having special needs such as survivors of domestic violence and the homeless. EDIs are subject to other Federal requirements including the Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards at 2 CFR. Part 200, the National Environmental Policy Act (NEPA), HUD’s NEPA-implementing regulations at 24 CFR Part 50 or 24 CFR Part 58, and all appropriate Federal environmental and historic preservation laws, regulations, and Executive Orders. Member offices should confirm with organizations requesting EDIs that they will be able to comply with these requirements. Members are required to provide the Project Name, Project Purpose, Project Website (if there is one), Project Detail, Member's Request, Total Cost, Location of the Activity, and. Project Recipient Information. In the Project Website field, Members should provide a link to the project website, if available, or if the project is included in an existing CDBG grantee’s Consolidated Plan or Annual Action Plan, a link to such plan. In the Project Detail field, Members are required to provide at a minimum: ‘© description of the project; © status of the project (planning, design, under construction, etc.) and timeline of its expected completion; ‘© breakdown of how EDI funds would be used; o00 (© description of all other sources of funding contributing to the total cost of the project; and © the status of the environmental review work. In the National Objectives field, which is under Additional Subcommittee Fields, Members should identify which of the three National Objectives of the broader CDBG program the EDI project and its activities meets and include relevant data or a description indicating how it meets such National Objective(s). The three CDBG program National Objectives are: (1) benefit low- and moderate-income persons or communities; (2) prevent or eliminate stums or blight; or (3) address community development needs having a particular urgency because existing conditions pose a serious and immediate threat to the health or welfare of the community for which other funding is not available. ‘The most common CDBG National Objective that EDI projects will meet is the benefit to low- and moderate- income (LMI) persons. ‘©. Earmark funding — officially called “Congressionally Directed Spending” in the Senate and “Community Project Funding” in the House ~ goes directly to the entity designated bby Congress for the specified project (separate from regular federal programs). In the appropriations laws enacted since then, Congress has directed earmarks to more than 100 projects involving libraries, totaling nearly $150 million (see fiscal year 2022 and 2023 lists). For the upcoming appropriations bills (fiscal year 2024), interested libraries may submit project requests to their Members of Congress. Here are some points to consider: ‘When can libraries apply? Most Congressmembers’ application deadlines are in March 2023. ‘What can libraries request funds for? Projects are typically for specific, one-time activities (and do not fund ongoing activities like annual operating expenses). Most library projects in FY22 and FY23 were capital projects, such as building renovation or construction; others included pilot programs or one-time activities related to technology, children and youth, and history. Which types of libraries can apply? Library projects in FY22 and FY23 included projects at school, academic, public, Tribal, state, and special libraries. How much funding can libraries request? The Congressional share of funding for library projects in FY22 and FY23 typically ranged from $50,000 to $2,000,000. How can libraries apply? Requests are submitted to individual Congressmembers’ offices, each of which establishes its own request forms and deadlines. Libraries with a potential project can reach out to their Congressmembers’ offices to discuss the idea and to ask for their form and deadline. Applicants can submit the same request to all the Congressmembers who represent the location of the proposed project (i.e., the Representative for that district and both Senators for that state). Note that some Congressmembers do not accept requests. ‘When would successful requests receive funding? Following the enactment of the FY24 appropriations law, likely late in calendar year 2023 or in calendar year 2024. Te have the supervision, care, custody, nage ment, and control of all property of the JACKSON/HINOS LIBRARY SYSTEM; - To initiate studies, gather data, establish goals, and jake plans for the due and proper operation and adninistedtion of the systes: 4, To make reconmendations fron time to time and as may be apprope eto the Board of Supervisors of Winds County and the City Council of the City of Jackson concerning the operation of the systen; ©. To establish and maintain a liaison with the city Council and the Board of Supervisors that each governing au- thocity may cemain appeised of the system and its curcent operations. £. To employ a Libearian, who shall be known, as the Director of the JACKSON/HINDS LIGRARY SYSTEH and to grant to the dicector such authority as shall be appropelate for the orderly dischacge of the duties of auch office, not inconsis~ tent with lav oc this agreement; ‘To employ other persons, including professionals, as shall, in the judgment of the Administcative poacd, be Recessacy and appropciate for the orderly adwinistcation and operation of the system: ee h. To.grant present employees of the Jackson Metro- politen Libcary System a preference for exploynent with the JACRSON/IIINOS LIBRARY SYSTEM. kk, To submit annually to Winds cyunty ang the City of Jackson, for approval, a budget of anticipated revenues and expenses for the ensving year; 1, To have exclusive control, pucsuant to approval Of {ts annual budget, of the Einances and receipt and expen Gleuce of funds of the system: Rm. To accept gifts of money or property for ilbeacy purposes as the Administrative Board shall deem in the best intecest of the system, subject to cules and regulations pro- mulgated by the City Council of the Clty of Jackson and the Board of Supervisors of Hinds County, A. To authorize purchase, upon recommendation of the @irector, and in accordance with rules and regulations estab- lished by the Aduinistrative Board, books, periodicals, maps and other other appropriate materials and supplies for the systea; To conteact with the board of trustees of any established library syste: for (1) providing services to that Libeacy system or (2) recelving services from that bcary system, in accordance with the annual budget previously ap- peoved; Pe To co-operate with and seek guidance from the Mississippi Libcary Commission in the management, operation and contro of the library syste 2 To do all other acts necessary and proper for the orderly and efficient managenent, operation and control of the JACKSON/ILNOS LIBRARY SYSTEM not inconsistent vith its by- lave, this agceenent of the lavs of the State of Mississippi. SECTION 9. No libcaries shall be added to the system o closed except upon the concurcence, by proper cesolution, of che Governing aucherities of both Hinds County and the City of Jackson. In the event there 1s a concurrence on the aédition of a libeary facility which requires the construction of @ building, fe shalt be the responsiblity of that govecnaent desiring co construct and ovn the sane to provide the funds therefor including adequate physical equipment. Upon con- struction of the facility and its aédition to the system, the expense of operation thereof as» pact of the JACKSON/HINDS LIBRARY SYSTEM shall be borne by the system. SECTION 10, The Elseal year of the JACKSON/HINOS LIBRARY SYSTEM shall commence October first (1st) end extend through September thirtieth (30th) of the following year. SECTION 11, The budget, as herein before provided, of anticipated cevenves and expenditures submitted annually to the City Council and Board of Supecvisers shall be subject to approval by the City Council and Boacd of Supervisors which shall, within thelr discretion, according to law and in ac- cocdance with Section 6 of this agreement, appropriate funds for the operation of the libracy systen hereby created, SecrioN 12, Title to all property which Ls vested in the City of Jackson or in Hinds County as of the effective date of this agreement, will remain so vested, and shall not, by virtue heceot, becos Jointly owned nor shall property rights accrue a5 a result of the consent, ratification, approval and con- {irsation of this agreement. SECTION 13. Property purchased for the aysten ducing the Lite of this agreement shall, upon dissolution of the system, become vested in the Clty of Jackson and Hinds County equally. SECTION 14. The SACKSON/HINDS LIBRARY S¥STER is created tn perpetuity, provided however, either party can dissolve the systen on September thictteth (30) of any yeok upon sixty (60) days written notice to the other party: SECTION 15. ALL public buildings and other facilities housing the JACKSON/HINDS LIBRARY SYSTEM shall be under the cace, custody and contcol of the Administrative Board vho shall be responsible for the operation, proper care, and main~ tenance thereof, including but not Limited to utilities, tele phone, yard and grounds Antenance, cepairs, replacements, janitocial, and secucity services. Each aunicipality owning a building in which @ branch Libcacy is noused shell nave the option of maintaining its buitding in lieu of that responsibility being assuned by the Adainistcative Board, Notice of the exercise of this option shall de given the Administrative Board no later than June 1 of each year for the ensuing fiscal year. Annual budgets shall inolw those suns of roney cequiced for such opecation, cace, and maintenance and shall plainly denominate ali funds to be so spent ducing the ensuing year. SECTION 16, The Administeative goard shall, at the close of cach year, make a ceport to the City Council and Board of Supervisors depicting the condition of the JACKSON/HINDS LI- BRARY SYSTEM ducing the year, the suns of money ceceived Eco taxes and other sources, the sums of money expended and the pucposes of all expenditures, an {nventory of books and peri- edicals, including additions, vithéravals, and those loaned out ducing the year, and such other statistics, information and suggestions as the Administrative Board shall deen of public interest or as directed by the City Council or the Boacd of Supervisors. A copy Of the report shall be filed with the Mississippi Library Comatssion. Secrion 17. This agreement may be amended fron tine to time as may be expedient or needful. Such amendment shall be submitted to the City Council and Board of Supervisors for consent, ratification and approval and shall become effective upon the due and proper adoption of an appropriate resolution by both governing authorities incorporating such amendment. SECTION 19. This AGREEMENT FOR THE CREATION, MAINTENANCE AND SUPPORT OF THE JACKSON/HINDS LIBRARY SYSTEM shall becone effective upon the consent, ratification, approval ané confic- nation of both the CITY COUNCIL OF THE CITY OF JACKSON, MIS- SISSIPPI and the BOARD OF SUPERVISORS OF HINOS COUNTY, MIS- SISSIPPE by appropeiate resolution duly adopted and evidenced by the due execution hereof by the Mayor of the City of gack- son, Hississipp! and the President of the soacd of Supervisors of Hinds county, Mississippi.
