MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

MR. MARTIN NIEVERA
Event Manager

5th Year Bachelor of Science in ASAP of the La Salle University - Benilde, located at St.
Columban Drive, Aguada, Ozamiz City, represented by its Event Manager, MR. MARTIN NIEVERA,
hereinafter referred to as the FIRST PARTY.

and

MS. ELHA NYMPHA, the owner of KAON TA DIRI, the official food caterer for the ASAP
Anniversary 2022, of the BS ASAP Class hereinafter referred to as the SECOND PARTY.

MS. ELHA NYMPHA

WHEREAS, the representatives of both parties are duly authorized to enter into this Memorandum of
Food Caterer

Agreement;

WHEREAS, the partnership between the BS ASAP class and the food caterer is essential for the success
of the ASAP Anniversary 2022;

WHEREAS, La Salle University will have the ASAP Anniversary 2022, WHEREAS, KAON TA
DIRI, will be the official food caterer of ASAP Anniversary 2022 on December 19, 2022;

NOW THEREFORE, in consideration of the premises and mutual promises set forth herein, the parties,
intending to be legally bound, hereby agree as follows:

TERM & CONDITION

For the FIRST PARTY:

1. That the FIRST PARTY will hire professionally the SECOND PARTY as the official
food caterer of the BS ASAP Class for the ASAP Anniversary 2022;
2. That the FIRST PARTY will not hire any food caterer for the ASAP Anniversary 2022
other than the SECOND PARTY;

3. That the FIRST PARTY will pay the professional fee, to the SECOND PARTY in the
following amount of PhP 50,000.00;

4. That the FIRST PARTY will be receiving the food package all set on December 19,2022 not
later than 11:00 AM, before lunch of ASAP Anniversary 2022.

For the SECOND PARTY:

1. That the SECOND PARTY will be the official food caterer for BS ASAP Class
for the ASAP Anniversary 2022
2. That the SECOND PARTY is not allowed to accept any food caterer service orsimilar
services on the same day of ASAP Anniversary 2022 other than the FIRST PARTY
3. That the SECOND PARTY will observe the following:
a) Timely schedule of delivering the food package
b) Exact number of 300 plated foods
c) Inform the FIRST PARTY in case of any lapses regarding the food package.
4. That the SECOND PARTY will receive the amount of PhP 50,000.00 on December 15,2022.
5. That the SECOND PARTY will be held legally liable for any incidents that may occur
caused by food or drink poisoning due to the presence of deleterious matter in food or drink

or utensils sold or supplied by the KAON TA DIRI owned by the SECOND PARTY
Food Caterer

6. That the SECOND PARTY will be delivering the food package all set on December 19,2022
not later than 11:0 AM, before lunch of ASAP Anniversary 2022.

This agreement takes effect upon the signing of the officials concerned and be renewed for the same period
upon the mutual consent of the parties.

IN WITNESS WHEREOF, WE have hereunto set our hands this at Ozamiz City, Philippines.
