LESSON 1.

Charter: Law (RA) on the creation of Samal as a City; Political Structure of


Samal (LGU); Government Agencies

Learning Objectives:
1. Know the creation of the City of Samal.
2. Discuss the requirements of the creation of a city as provided in the Local
Government Code of 1992

Republic Act No. 8471


Created the City of Samal on January 30, 1998.
This act paved the way for the dissolution and merger of the three former municipalities
of Samal, Babak, and Kaputian into one local government unit by turning then into districts,
now officially named as IGaCoS, the Island Garden City of Samal.

This Act shall be known as the Charter of the Island Garden City of Samal.

Corporate Powers of the City


The City constitutes a political body corporate and, as such, is endowed with the
attributes of perpetual succession and possession of the powers which pertain to a municipal
corporation to be exercised in conformity with the provisions of this Charter. The City shall have
the following corporate powers:

1. To have continuous succession in its corporate name;


2. To sue and be used;
3. To have and use a corporate seal;
4. To acquire and convey real or personal property;
5. To enter into contracts; and
6. To exercise such other powers as are granted to corporations, subject to the
limitations provided in this Act and other laws.
General Powers of the City
The City shall have a common seal and may alter the same at pleasure. It shall exercise
the powers to levy taxes, close and open roads, streets, alleys, parks or squares subject to the
provisions of the Constitution and existing laws. It may take, purchase, receive, hold, lease,
convey, and dispose of real and personal property for the general interest of the City, condemn
private property for public use, contract and be contracted with, sue and be sued, prosecute
and defend to final judgment and execution suits wherein said City is a party, and exercise all
the powers as are granted to corporations and/or hereinafter conferred.

Jurisdiction of the City

The jurisdiction of the Island Garden City of Samal, for police purposes only, shall be
coextensive with its territorial jurisdiction which includes all marine territories covered by the
City’s municipal waters. For the purpose of protecting and ensuring the purity of the water
supply of the City, such police jurisdiction shall also cover the territories within the drainage
areas of such water supply, or within one hundred (100) meters of any reservoir, conduit, canal,
aqueduct, or pumping station used in connection with the city water service.

The city court of the City shall have concurrent jurisdiction with the city or municipal
courts of the cities and municipalities along Davao Gulf to try crimes and misdemeanors
committed at the seas within Davao Gulf. The court first taking cognizance of such an offense,
shall have jurisdiction to try said cases to the exclusion of others.

City Elective Offices

There shall be established in the city government of the Island Garden City of Samal the
following offices for its elective officials:
1. Office of the city mayor
2. Office of the vice mayor
3. Office of the twelve (12) members of the Sangguniang Panglungsod
City Mayor and Vice Mayor

City Mayor
(a) The city mayor shall be the chief executive of the City. He shall he elected at large by
qualified voters of the City.
(b) The city mayor, as the chief executive of the city government, shall exercise such powers
and perform such duties and functions as provided herein:
(1) Exercise those powers expressly granted to him by law, those necessarily implied
therefrom, as well as powers necessary, appropriate or incidental to the efficient and
effective governance of the City and those which are essential to the promotion of
the general welfare.
(2) Enforce all laws and ordinances relative to the governance of the City and in the
exercise of its appropriate corporate powers as well as its power to implement all
approved policies, programs, projects, services, and activities of the City:
(3) Initiate and maximize the generation of resources and revenues and apply the same
in the implementation of development plans, program objectives and priorities,
particularly those resources and revenues programmed for agro-industrial
development and countryside growth and progress
(4) Ensure the delivery of basic services and the provisions of adequate facilities
(5) Perform such other duties and functions and exercise such other powers as provided
for under Republic Act No. 7160, otherwise known as the Local Government Code
of 1991, and those that are prescribed by law or ordinance.

Vice Mayor
(a) There shall be a city vice mayor who shall be elected in the same manner as the city
mayor and shall, at the time of his election, possess the same qualifications as the
city mayor. He shall hold office for three (3) years, unless sooner removed, and shall
receive a monthly compensation corresponding to Salary Grade Twenty-Six (26) as
prescribed under Republic Act No. 6758 and the implementing guidelines issued
pursuant thereto.
(b) The city vice mayor shall:
1. Act as presiding officer of the sangguniang panlungsod and sign all warrants
drawn on the city treasury for all expenditures appropriate for the operation of the
sangguniang panlungsod.
2. Subject to civil service law, rules and regulations, appoint all officials and
employees of the sangguiang panlungsod, except those whose manner of
appointment is specifically provided for under existing laws.
3. Assume the office of the city mayor for the unexpired term of the latter in the event
of permanent vacancy
4. Exercise the powers and perform the duties and functions of the city in cases of
temporary vacancy and
5. Perform such other duties and functions and exercise such other powers as
provided for under RA 7160, otherwise known as the Local Government Code of
1991, and those that are prescribed by law or ordinance.

The Sangguniang Panlungsod


(a) There shall be three (3) sanggunian districts comprising the Island Garden City of
Samal, namely: Babak (District I), Peñaplata (District II) and Kaputian (District III).
Each sanggunian district shall elect four (4) regular representatives to the
sangguniang panlungsod. The sangguniang panlungsod, the legislative body of the
City, shall be composed of the city vice mayor as presiding officer, the twelve (12)
regular sanggunian members representing the three (3) sanggunian districts of the
City, the president of the city chapter of the liga ng mga barangay, the president of
the panlungsod na pederasyon ng mga sangguniang kabataan and the sectoral
representatives, as members.

(b) In addition thereto, there shall be three (3) sectoral representatives: one (1) from the
women; and, as shall be determined by the sangguniang panlungsod within ninety
(90) days prior to the holding of the local elections, one (1) from the agricultural or
industrial workers and one (1) from the other sectors, including the urban poor,
indigenous cultural communities or disabled persons.
(c) The regular members of the sangguniang panlungsod and the sectoral
representatives shall be elected in the manner as may be provided by law. The
elective members of the sangguniang panlungsod shall possess the same
qualifications as that of the city mayor and the city vice mayor, except that candidates
for said positions must be at least eighteen (18) years of age on election day.

(d) They shall receive such compensation, emoluments and allowances as may be
determined by law.

(e) The sangguniang panlungsod shall:

(1) Approve ordinances and pass resolutions necessary for an efficient and
effective city government
(2) Generate and maximize the use of resources and revenues for the
development plans, program objectives and priorities of the City, with
particular attention to agro-industrial development and city-wide growth and
progress
(3) Subject to the provisions of the Local Government Code of 1991, enact
ordinances granting franchises and authorizing the issuance of permits and
licenses upon such conditions and for such purposes intended to promote the
general welfare of the inhabitants of the City and, pursuant to this legislative
authority
(4) Regulate activities relative to the use of the land, buildings and structures
within the City in order to promote the general welfare
(5) Approve ordinances which shall ensure the efficient and effective delivery of
the basic services and facilities as provided for under the Local Government
Code, and in addition to said services and facilities
(6) Perform such other duties and functions and exercise such other powers as
provided for under Republic Act No. 7160, otherwise known as the Local
Government Code of 1991, and those that are prescribed by law or ordinance.

Samal

• A coastal paradise at the heart of Davao Gulf with 118 kilometers of coastlines.
• Has a cluster of 9 Islets.
• An urbanizing center within a rural setting, it is a component city of Davao del
Norte created by virtue of R.A. 8471. Considered the first amalgamation in the
country, the city’s creation was ratified by its residents on March 7, 1998.

Samal As an Island

• it has several commercial resorts and private beaches spread along the 118-
kilometer stretch white sand.
• One of the attractions is the Sanipaan Shoal, aptly called Vanishing Island
because half of the 80-hectare shoal emerges as a sand bar during low tide but
vanishes during high tide creating the illusion of vacationing in the open seas.
• Most-visited destination is the 224-hectare mariculture park which is a showcase
of new fisheries development strategy that puts premium on transforming coastal
communities into centers of growth and prosperity.
• For scuba-diving buffs, Talikud and Ligid Islands are excellent dive spots where
a dive into the depths will reveal colorful underwater vistas with jaw-dropping
tropical marine life. A 150-hectare Coral Garden & Marine Reservation Park
located in Talikud and the Aundanao Fish Sanctuary offer another treat to diving
and snorkeling enthusiasts.
• Aside from its underwater garden, Samal also has a botanical garden and
nature’s park. Located in barangay Bandera, this 11.5 hectare government-
owned park with over a hundred species of trees and flower gardens is envisioned
to be the sanctuary of nature lovers.

Samal is also home to Mindanao’s First Magrovetum that serves as a laboratory for
dendrological, educational, eco-tourism and phonological and other studies on the mangrove
ecosystem. Also, an indication of Samal’s sound ecological system is the bat sanctuary (cave)
that hosts gazillions of fruit bats.

Adventurers can also commune with nature by climbing Mount Puting Bato, rapel at Bito
Depression, mountain-bike and camp out in the midst of lush vegetation or maybe beside the
rustling waters of Hagimit Falls or Tagbaobo Falls. For the spelunkers, exploring Balete,
Magongawong, Tamburong, and Baga caves, among about 70 caves in the island will surely
offer thrill and excitement.

Festivities in the Island abound. Each of the three districts celebrate their own festival - -
Kabasan for Babak, Hugyaw Madyaw for Samal, and White Nights for Kaputian. As a whole,
the city celebrates its Founding Anniversary on the 7th of March and the a-la-mardi gras
Caracoles Festival on the last Saturday of April. Street-dancing, fluvial parade, sand sculpture,
banca race, street party, are just a few of the many exhilarating and colorful activities during
these festivals.

Samal As a City

It is known to be an urbanizing center within a rural setting. Putting in place urban amenities
with great approbation for its natural endowments, it aims to be the information technology hub
of Southern Philippines. With its strategic location, typhoon-free climate, stable peace and
order, supportive local government unit and community, Samal is an ideal location for
investments.

Priority areas for investments are eco-tourism site development, cultural village and
ancestral home development, new and state-of-the-art common carrier (land, water, & air), port
infrastructure, cold storage facilities, warehouse, and ice plants.

Pangapog Festival
One of the biggest and most colorful festivals in the island of Samal. It’s a festival
of thanks giving for a bountiful harvest and overflow of blessings for the island. The festivals
comes alive in Samal during the last week of August and islanders call their festival
“MADAYAW, HUGWAY Festival” of Samal gathering their best harvests for a thanksgiving day,
showing off their best in tribal dances, rituals, harvests, costumes, crafts, food, etc. to tourists
and visitors coming to the island.

IGACOS Samal Festival


To mark the founding of the city which converted the island into a garden city called
“Island Garden City of Samal” (IGACOS) the government here set aside the whole week of
March 1 to 7 for this founding anniversary. This festival showcases the island’s natural
endowments and its people’s culture to remind residents of the island’s great potentials for
growth in the years ahead.

Caracoles Festivals
Sea shells in all their species and varieties are spotlighted in a unique festival called
“Caracoles Festival” held during the last week of April every year in the island of Samal. A
sundown to sunrise all night party celebration, so many drinking, dancing and videoke sessions,
etc. are held by beach resorts by the time the sun goes down right until the sun rises.

Kabasan Festival
Marking the founding anniversary of Babak town, the “KABASAN FESTIVAL” takes
place during the last week of May every year, culminating on May 28, the day Babak was
officially declared a municipality. The word “kabasan” is the native term for “seashells” which
are bountiful in this booming trading town. This festival in Babak is their way of celebrating the
rich and colorful life of marine life, including seashells, in the island. Kabasan Festival is
probably the island’s most colorful and most exciting festival which showcases a-la-Mardi Gras
celebration that features noisy street dancing and beach parties, bikini competition featuring
the island’s sexiest girls, lots of loud and colorful fireworks, and motorcycle races called
“Motocross”. So many visitors and tourists watch for this festival every year.

White Nights Festival


Founding anniversary of Kaputian town in the southern part of Samal Island,
residents here along with their town officials take a lot of efforts showcasing their rich history,
their exotic arts and culture. The word “Kaputian” in the local dialect means “Whiteness”
referring to the whiteness of their beaches and corals that are bountiful in their area. These
festival is marked with beach parties at various resorts, singing contests, dining, drinking
parties, fireworks, etc.

Regatta Festival
A big fluvial parade along the sea coast of Samal, followed by boat races and sailing
competitions among local boatmen using their outriggers (banca) are showcased as big events
of the IGACOS Festivals to mark the founding of the island garden city from March 1 to March
7 every year.

Kaputian Fiesta
Roman Catholic devoutees and residents of Kaputian town always set aside a day
every 3rd of January to honor their patron saint, Senior Santo Nino, starting with an early mass
and capping the day with various activities that include a street procession, family picnics at the
beach, luncheon party for everyone, and evening dinner with dancing and singing.
Holy Week Beach Watch
During the Holy Week every year, the Samal local Government backed up by the
Coast Guard, police, navy, army and life guard units are alerted thru a special “beach watch”
security program to keep everyone safe in the island. Thousands of visitors and tourists usually
pour into the island’s beach resorts to enjoy the sand, sun, and sea during the Holy Week which
is considered the busiest time for the island as sunbathers and swimmers crowd almost all the
beach resorts of Samal.

Babak Fiesta
Aside from the Kabasan Festival in Babak held on the last week of May, there’s
another special Babak event that town residents look forward to their annual parochial fiesta
for Roman Catholic town residents. All-day masses, street processions, charitable and religious
activities are held to honor their patron saint Virgin Dolorosa. Beach resorts in Babak have a
field day as streams of visitors and tourists come for the fiesta and join the local residents in
the religious celebration at the various resorts.

Penaplata Fiesta
The town of island city hall and government offices are located, also celebrate a
religious activity on December 8 every year, a parochial event organized by the Roman Catholic
town church here. Town residents also mark this special day with early morning masses, street
processions, baptism, blessings by the church for families and visitors coming to visit their
relatives.

Kabasan Festival
The founding anniversary of Babak town it takes place during the last week of May
every year, culminating on May 28 the day Babak was officially declared a municipality.
The word “kabasan” is the native term for “seashells” which are bountiful in this
booming trading town. The festival is their way of celebrating the rich and colorful life of marine
life, including seashells, in the island.

This festival is probably the island’s most colorful and most exciting festival which
showcases a-la-Mardi Gras celebration that features noisy street dancing and beach parties,
bikini competition featuring the island’s sexiest girls, lots of loud and colorful fireworks, and
motorcycle races called “MOTOCROSS”.

White night Festival


Marking the founding anniversary of Kaputian town in the southern part of Samal
Island, residents here along with their town officials take a lot efforts showcasing their rich
history, their exotic arts, and culture. The word “KAPUTIAN” in the local dialect means
“Whiteness” referring to the whiteness of their beaches and corals that bountiful in their area.
