CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This agreement made by and between the Department of Agrarian Reform, a

government agency created under R.A. 6388 and Executive Order No. 347 Series of 1971,
represented by its Provincial Agrarian Reform Program Officer II, RIZZEL B. VILLANUEVA,
CESO VI, Filipino, of legal age, married, and a resident of Sicayab, Dipolog City, Zamboanga
del Norte, herein after referred to as FIRST PARTY;

And

GIERELLE B. DIAZ, single, of legal age, and a resident of Bantilan Residence Purok
Bayugo, Tabuk Tulay, Dicayas, Dipolog City, herein after referred to as the SECOND PARTY.

WITNESSETH:

WHEREAS, the FIRST PARTY is undertaking the Support to Parcelization of Lands for
Individual Titling (SPLIT) Project for the entire Province of Zamboanga del Norte. To execute
the said project, the FIRST PARTY intends to hire personnel with required skills and knowledge
for purposes of project implementation;

WHEREAS, the SECOND PARTY possesses such desired qualifications needed by the
First Party and is thus willing to execute said project and other activities assigned by First Party
under such conditions acceptable by both parties;

WHEREFORE, the parties hereby agree and covenant among themselves to the
following terms and conditions:

1. That the Second Party shall perform tasks and responsibilities of a TECHNICAL
SUPPORT STAFF (PPMO), to include, but not restricted, to the following:

A. Generation of lists of CCLOAS subject of requests to the LRA for

certified/PHILARIS copies of titles and to the DENR for projection;

B. Prepares drafts of communications and reports for finalization and signature of

concerned officials;

C. Coordinate and closely work with LRA and DENR on the preparation and securing
supporting documents, issuance of titles, and projections, among others;

D. Preparation of reports on the status of requests submitted to the LRA and DENR;

E. Maintains systematic filing of records (specify) and other confidential documents

(specify) for easier retrieval;

F. Assist in the preparation/submission of accomplishments reports etc. in

connection with the above activities to RPMO/CPMO;

G. Performs liasoning job as the need arise or as directed;

 H. Perform other tasks that maybe assigned from time to time.

2. That it is mutually understood that there is no existing employer-employee relationship

between herein contracting parties, that the terms and conditions stipulated in this
contract are not covered under existing Civil Service Law, Rules and Regulations; and
that the services of the Second Party is not entitled to PERA, ACA, and such other
allowances and benefits as mid-year bonus, productivity incentives, cash gifts, service
leave and the like;

3. That the FIRST PARTY in consideration of the foregoing agrees to pay the said SECOND
PARTY the amount of Twenty Five Thousand Pesos (Php. 25,000.00), subject to
withholding taxes, as service fee for the duration of the contract period of One Month
beginning 01 OCTOBER 2022 until 31 OCTOBER 2022;

4. That the FIRST PARTY shall pay the SECOND PARTY for this contract period, while
performing activities that would orient and prepare him/her to undertake and deliver the
aforesaid tasks and responsibilities under Project SPLIT;

5. That in the event the SECOND PARTY will have to travel in relation to his/her function
or/by a written Office Order of the FIRST PARTY, the SECOND PARTY may be allowed to
claim travelling expenses in accordance with existing rules and regulations of the
Commission on Audit and in accordance with the budget thresholds agreed with the
FIRST PARTY;

6. That in case the SECOND PARTY fails to deliver the monthly target without valid reason,
EXCEPT on instances due to fortuitous event, the FIRST PARTY may terminate the
contract;

7. That any form of Grievance arising out of this contract shall be under the jurisdiction of
the DAR Regional Adjudicator for proper resolution and disposition in accordance with
existing rules and regulations;

8. That the SECOND PARTY must observe policies, ordinances, and regulations in the
locality where he may be assigned.
