RATIONALE: This PNP MC sets forth the policies and guidelines to be followed by offices/units of the PNP in the implementation of the Peace and Security Framework entitled, “Malasakit, Kaayuean, Kapayapaan tungo sa Kaunlaran” (M+K+K=K), aims to address the intemal and extemal issues of the organization; implement the rule of law; and maintain peace and order, in support to the 8-Point Socioeconomic ‘Agenda of President Ferdinand Romualdez Marcos, Jr. (PFRMUR). 3, SITUATION: Since the inception of the PNP in 1991, the organization has been besieged with several internal and external issues such as police scalawags, organizational dysfunctions, and negative feedbacks from the community. Various programs and interventions have been conceptualized and implemented to address such concems; however, severai of these programs were noi sustained. With the current challenges against illegal drugs, criminality, insurgency, terrorism, and public safety, the PNP must assess and review its policies and ‘strategies to come up with a more responsive and reinvigorated approach in combatting these chalisnges. This MC was formulated to provide clear guidelines in reinforcing laws, existing programs, and policies with the aid of the public sector and the community to improve the quality of police services and to gain public trust and confidence. 4. MISSION: ‘The PNP, concurrent with its mission and functions, shall execute a holistic Peace and Security Framework anchored on M+K+K=K and KASIMBAYANAN (Kapulisan, Simbahan at Pamayanan), a coalition of the PNP, the Religious Sector and the Community to address intemal issues and deliver quality public safety and ‘security services for a peaceful and progressive Philippines. a. Objectives: 1)To enhance the morale and welfare of our personnel by addressing their needs and capacitating them in the performance of their duties; 2) To strengthen the internal cleansing program through the full exercise of disciplinary authority at all levels; ‘Life is Beautful..Kaligtasan Nyo, Sagot Ko. Tulong-tulong Tayo.” Page 2 of 15 3) To reinforce the sense of responsibility of serving and protecting the community by upholding the rule of law without fear or favor and aligning police programs and operations with rights-based policing; 4) To organize and mobilize the community and other stakeholders as peace advocates and counselors in the campaign against criminality, illegal drugs, and terrorism; 5) To sustain the gains achieved by the National Task Force to End Local Communist Armed Conflict (NTF ELCAC); and 6)To support the implementation of the localized peace agreements between the government and rebel groups. 5. DEFINITION OF TERMS: Kaayusan (Order) — refers to the promotion and upholding of the rule of law, maintenance of peace and order, and prevention of criminal activities in the community; Kapayapaan (Peace) — refers to the state of achieving freedom from armed conflicts, disturbance, and rampant criminality. The PNP shall ensure that peace and security programs will not only reach urbanized areas but will be felt down to rural and barangay areas as well; . KASIMBAYANAN (KApulisan, SIMBAhan, PamaYANAN) — refers to the collaboration among the police, church, and the community, which aims to bring holistic transformation in the PNP organization and to effect change in the community; |. Kaunlaran (Progress) — refers to the end-result of all the programs implemented to attain unhampered progress and development in the community; and . Miaiasakit (Care) — refers to the aspirations of the PNP to provide spiritual and logistical support to all of its personnel and to address both intemal and external issues of the organization thereby improving the quality of police services. “Life is Beautitul...Kaligtasen Nyo, Sagot Ko. Concept of Operations: unnarran 6 [Pas Feces cu IN COMMUNITY, Glass a (0) Cine BAYANAN Figure 1. “Phases of implementation” efi eet The PNP Peace and Security Framework is a holistic approach anchored on the MKK=K, which comprises of three main pillars representing the program components — Malasakit (Care), Kaaayusan (Order) at Kapayapaan (Peace) — with the end view of attaining Kaunlaran (Progress) in the community in line with the 8-Point Socioeconomic Agenda of PFRMJR. The MKK=K is complemented by the KASIMBAYANAN Program, which basically refers to the frontline actors comprising of the PNP, the Church (Religious Sector), and the Community together with its supporting actors from National Government Agencies (NGAs), Local Government Units (LGUs) and Security Sector coming from the Armed Forces of the Philippines (AFP) and other Law Enforcement Agencies (LEAS). b. Phases of Implementation: Phase 1: Organization For unity of command and direction in the implementation of the Peace and Security Framework (MKK=K and KASIMBAYANAN). the PNP shall craft the organizational structure (Fig. 2) to delineate its functions down to the lowest units in the PNP. “Life is Beauttul...Kaligtasan Nyo, Sagot Ko. Tulong-tulong Tayo.” Page 5 of 15, The Chief, PNP (CPNP) shall be the Program Director with The Deputy Chief, PNP for Administration (TDCA) as the Chairman of the Oversight Committee. The Deputy Chief, PNP for Operations (TDCO} is designated as Program Manager who shalt be assisted by ‘The Chief of Directorial Staff (TCDS). The Chief, Law Enforcement Division, Directorate for Operations (LED, DO) shall serve as the Secretariat. The 11 Directorial Staff are the Program Supervisors of their respective Directorates. The five Area Police Commands shall oversee the different Police Regional Offices (PROs) under their respective areas of responsibilty. The Regional Directors of the 17 PROs and Directors of 26 National Support Units (NSUs) shall be designated as the Program implementers of this plan. Thereafter, it shall be launched and cascaded down to the barangay level with the proactive support of the KASIMBAYANAN main actors coming from the PNP, Religious Sector (Church) and the Community (Public, Advocacy Support Groups and Force Multipliers) and other sectors from the NGAs, LGUs, AFP, LEAs and NGOs. This phase also covers the mentoring and capacity building of all main actors including advocacy support groups and force multipliers, and forging of community partnerships though Memorandums of Agreement/Understanding (MOA/U). Phase 2: Mobilization This phase involves the actual execution of activities and programs relevant to the Peace and Security Framework through the mobilization of all actors in the MKK=K and KASIMBAYANAN. Phase 3: Monitoring and Evaluation A PNP Oversight Committee at the national and regional levels shall be created and convened monthly to evaluate, assess and measure the progress of all PROs, collate, study, and analyze gaps, and formulate directives to guide the Program Implementers. The implementation of all the programs under this campaign plan shall be properly monitored and evaluated to keep track of the progress, gains, and accomplishments as well as the issues and challenges encountered. ‘The composition of the National Oversight Committee shall be the following: Chairperson : TOCA Co-Chairperson : TDCO Vice-Chairperson : TCDS “Life is Beautful...Kaligtasan Nyo, Sagot Ko. TOL D, CHS: TDPCR DLS ToC [D, HS The composition of the National Oversight Committee shall be replicated in the Regional Oversight Committee. The Commander, APC shall be represented in the regional level by the Provincial/City Directors. b. Strategic Program Components: 1) The “MALASAKIT” component shall address the intemal and extemal issues of the organization. On the intemal aspect, the human resource growth and organizational development shali be addressed by implementing responsive programs to strengthen counter-intelligence efforts; reinforce the leadership and disciplinary authority of key officers at all levels of command; intensify intemal cleansing mechanisms through preventive, restorative, and punitive approach: ‘and boost the morate and welfare of the PNP personnel. Medium and fong-term programs focused on training and education, fiscal reforms, logistics capability enhancement, doctrine and research development, and continuing development of a lean and mean organization (right-sizing) shall be established. It shall also address the external aspect to satisfy the expectations of the community on the peace and security concems and nurture a harmonious relationship with various stakeholders and the general populace by effecting genuine efforts on crime prevention, intelligence and case build-up, case resolution, community awareness, organization and mobilization, and digitization of frontline services that must be delivered and be felt by the community. 2) The “KAAYUSAN” component promotes and upholds the rule of law to maintain peace and order and reduce criminal activities down to the barangay level through interplaying of Quad Concept operations spectfically on intelligence and counter-intelligence, crime prevention, case resolution, and civil affairs development. This concept shall be incorporated to the localized peace and security plan in coordination with all the sectors of the society to make it more responsive and adaptive to the peculiarities of every locality to address root causes of crimes and insurgency. The PNP shall strengthen collaboration with the ‘community through Ugnayan sa Barangay and cascade national laws and local ordinances to better inform the citizenry. All focused law enforcement operations, public safety activities, and community “Life Is Beautiul...Kaligtasan Nyo, Sagot Ko, Tulong-tulong Tayo.” Page 7 of 15 organization and mobliization of the frontline police units and national support units shall be directed against all forms of threats to peace and order, and public safety. 3) The ‘“KAPAYAPAAN” component involves the response of the PNP in support to the programs of the national government in the maintenance of peace and security focusing on counter-insurgency, counter- terrorism, legal offensive, and community affairs development. The PNP shall actively engage all its Public Safety Forces (PSFs) and other units in support to Executive Order No. 70 (NTF ELCAC) in defeating the protracted war of the CPP-NPA-NDF against the government. Maintain close coordination with other government agencies and LGUs in implementing strategic communication to stir up awareness to the citizenry, stakeholders, other sectoral groups, organize and mobilize advocacy support groups or force multipliers. Implement PNP responses to mitigate the impact of natural and man-made disasters. 4) The “KAUNLARAN” is the goal of all the components implemented which will lead to achieving a peaceful and secured community living in a progressive and developed country. ‘The M#K+KeK shall be enhanced by the KASIMBAYANAN program (Kapulisan, Simbahan at Pamayanan) which shall be spearheaded by the Directorate for Police Community Relations. This program seeks to envision the all-inclusive synergy of the police, church, and community in upholding public order and safety and peace and security. c. Tasks: cs a) Oversee the implementation of this plan particularly on anti- criminality, ant-llegal drugs operations, intemal security, terrorism, and search and rescue and security during calamities; b) Coordinate closely with respective area commanders of the AFP for the conduct of joint and relentless internal security operations within your AOR; ©) Maximize the utlization of the Regional Mobile Force Battalions (RMFBs) and Provincial Mobile Force Companies (PMFCs), especially on Geographically-Isolated and Disadvantaged Areas (GIDAs)barangays to ensure implementation of Barangay Development Programs; ) Oversee the deployment of RMFBs in support to NTF ELCAC; €) Oversee the conduct of border control operations; and f) Perform other tasks as directed. “Life is Beautiful...Kaligtasan Nyo, Sagot Ko. Tulong-tulong Tayo.” Page 8 of 15 2) TOPRM a) Designated as Program Supervisor for Morale and Welfare, and Internal Discipline; b) Ensure the implementation of programs and projects that shall boost the morale and welfare of uniformed and non-uniformed personnel; ©) Strengthen the implementation of PNP Disciplinary System through the stringent implementation of Intemal Cleansing Program, Comprehensive Internal Disciplinary Machinery, and the resolution of administrative cases of PNP personnel; d) Review policies and processes of personne! placement and promotion; and e) Perform other tasks as directed. 3) TDI a) Designated as Program Supervisor for Intelligence and Counter- Intelligence; b) Reinvigorate Counter-Intelligence (C!) efforts through the conduct ‘of Complete Background Investigation on PNP personnel and extemal stakeholders, validation/adjudication of derogatory information and Cl Awareness Seminar in support to the internal cleansing program of the PNP; c) Convene intelligence fusion center during major and special events; d) Provide periodic threats and security assessments; €) Develop targets for focused intelligence-driven law enforcement operations; f) Assist DIDM in analyzing crime data and identifying the two main products of crime analysis, all the hotspots, and all crime patterns in the AOR; g) Provide updated target lists relative to suspected crime groups involved in robbery/hold-up and other organized criminal activities; h) Validate and adjudicate watch-listed drug personalities; and i) Perform other tasks as directed. “Life is Beautiful...Kaligtasan Nyo, Sagot Ko. Tulong-tulong Tayo.” Page 9 of 15 4) TOO a) Shall serve as the Office Primary Responsible (OPR) in the implementation of this MC; b) Designated as the Program Supervisor for Crime Prevention, Law Enforcement, Public Safety and Intemal Security; ¢) Supervise and monitor the war on Drugs in coordination with Philippine Drug Enforcement Agency and other government agencies; d) Coordinate and collaborate with other government agencies, in ‘support to the NTF ELCAC; @) Designate Chief, LED as Head Secretariat of PNP Peace and Security Campaign Plan; and f) Perform other tasks as directed. 5) TOL a) Designated as Program Supervisor for Optimization and Sound Utilization of Logistical Resources; b) Provide appropriate logistical support for the implementation of this MC; and c) Perform other tasks as directed. 6) TDOPCR a) Designated as Program Supervisor for KASIMBAYANAN; b) Orchestrate a wide public information campaign through TRIMP (Television, Radio, Internet, Messaging, Print) in order to raise public awareness and engender community support to the intensified campaign against all forms of criminality, c) Develop a Strategic Communication (STRATCOM) and COMPLAN in support to the PNP Peace and Security Campaign Plan; 4) Organize and mobilize force multipliers for patrol and information gathering; €) Promote cooperation and participation of the people in crime prevention and solution; ) Intensify crime prevention efforts through collaboration with other agencies concerned and partnership with different advocacy groups; and “Life is Beauttul...Kaligtasan Nyo, Sagot Ko. Tulong-tuiong Tayo.” Page 10 of 15 g) Perform other tasks as directed. 7) Toc a) Designated as Program Supervisor for Financial Management; b) Provide funds necessary for the implementation of this MC; and c) Perform other tasks as directed. 8) TDIDM a) Designated as Program Supervisor for Legal Offensive; b) Provide support for the speedy investigation, filing of appropriate charges, and effective prosecution of all criminal cases to attain a high conviction rate: ) Supervise the generation of accurate and reliable crime data; d) Monitor the status of cases filed in court against criminals, CTGs and local threat groups up to its final disposition; e) Strengthen the legal offensives, in support to NTF ELCAC; ) Utilize the Next Generation Investigation Solution (NGIS) for ‘Crime Solution; g) Monitor the automatic review of dismissed drug cases and other heinous/sensational cases; h) Conduct inventory of cases filed in court that were dismissed due to non-appearance of PNP witnesses; i) Coordinate and cooperate with other pillars of the Criminal Justice ‘System for the speedy resolution of cases; and |). Perform other tasks as directed. 9) TOHRDD a) Designated as Program Supervisor for the conduct of all training and education programs; b) Facilitate the review of doctrines and policies of all Directorial Staff and Units to be aligned with the Peace and Security Framework; ©) Review the Program of instructions (POIs) of all mandatory and specialized courses; d) Review the PNPA Cadet Curriculum; “Life is Boautiful...Kaligtasan Nyo, Segot Ko. Tulong-tulong Tayo.” Page 11 of 15 ) Monitor the capacity building and training of Police Investigators under the new PO! with components of the QUAD concept; f) Monitor the implementation of the Modified Handgun Marksmanship Training designed to enhance the individual skills ‘on shooting and defense tactics of all personnel; g) Monitor the Best Practices of all Units in relation to KASIMBAYANAN; h) Facilitate the implementation of foundation training (SAF Commando, Scout Ranger, Special Forces, or Force Reconnaissance) for the new PNPA graduates; and i) Perform other tasks as directed. 10) TOPL a) Designated as Program Supervisor for the formulation of organizational development projects, collation and drafting of legislative proposals, program thrusts, and PNP Medium-Term Development Plan; b) Review, evaluate, and recommend necessary amendments to the Organizational Structure and Staffing Pattern (OSSP) of all PNP offices (administrative, technical and line offices) towards the attainment of a streamlined organization and rationalized distribution of uniformed personnel to strengthen the manpower of the line units specially the police stations nationwide; c) Endorse to the Senate/Congress the 12 PNP priority bills; and d) Perform other tasks as directed. 11) TORD a) Designated as Program Supervisor for Research, Development, Test and Evaluation of Materials, Uniforms, Insignias and Accoutrements of the PNP; b) Monitor, consolidate, and report offices/units activities related to “LOI Tamang Bihis”; ¢) Designate DRD personnel to act as Secretariat of the Uniforms and Equipment Specifications Board with TDRD as Chairman and Deputy DO as the Vice-Chairman, among others; d) Designate DRD personnel to act as Secretariat of the Task Force “Bantay Bihis” with Deputy, DRD as TF Commander at the NHQ while the DRDAs/DPDAs/ DCDAs/ COPs are the field TF ‘Commanders of the same in their respective offices/units; and “Life is Beautful...Kaligtasan Nyo, Sagot Ko. This time, on a wider and inclusive perspective, the organization has to ‘extend the implementation, requiring the need to involve the engagement of the ‘community, recognizing the valuable contribution of the religious sector. The maintenance of peace and order is always a shared responsibility between the people and the police. To mention an instance, PRO CALABARZON crafted a plan to combat the menace of crime and illegal drugs and to ensure public safety at the local level by utilizing some concepts in “Aisa Masa” of Davao City and in “Masa Masid” of DILG. Through this public safety program, citizens will be empowered to participate at the barangay level by helping the police gather inteligence information and conduct necessary community interventions. Thus, it asserts that community mobilization is important because each member is ultimately responsible for and affected by situations of safety and security. Conversely, if the community is not mobilized, the ideas and initiatives put forward by the police and other line agencies will not prosper. Moreover, the expected gains of transformation will not be sustained and will ot be effective without the involvement of the general public wherein the mindset has also to be influenced/swayed through the implementation of PNP KASIMBAYANAN. It is through this situation that the PNP, with the valuable support of the feligious sector, intends to reach out to the different communities to inform them of the following: that crimes committed by the citizens are not only violation of local ordinances but in reality, violation of God's commandments; that Intemal Cleansing in the PNP requires the active participation of the community by their faithful ‘observance of the existing laws; and that crime prevention is a duty of every citizen to his/her country and ultimately to Gad. Therefore, the role of the religious leaders is significant in this program. 4. PURPOSE: The PNP, with the support of the religious sector, aims to strengthen its partnership with the general public and bring awareness to the various communities that PNP personnel and the people they serve have a vital rote in contributing peace, order, progress and even holistic transformation of the society. Further, the full ‘support of all unit commanders to this program i¢ necessary so that transformation is ensured within the PNP organization and in the communities they serve and protect. 5. DEFINITION OF TERMS: @. Assessment Committee and Board - is a group led by the PNP and DILG responsible in assessing and implementing the program together with different program partners. iia ae Page 2 of 10 = . Barangay Defense System - a group of people who live in a neighbourhood who develop tactical ways to protect its locality from lawlessness and criminality. BPATs — means Barangay Peacekeeping Action Teams whose functions are law enforcement, conflict resolutions, disaster preparedness and response, environmental protection, people's organization and speakers bureau. Speakers’ Bureau - is a group of people composed of uniformed personne! or civilian volunteers that provides information to the public. u. Stakeholders - individuals or group of individuals who have invested their time and resources in developing an environment that is economically, socially, and physically healthy for everyone to reside, visit and work. v. Vigilantism — is the quality or state of being alertly watchful and carefully noticing problems or signs of danger to avoid it. . GUIDELINES: a. General Guidelines: The valuable partnership between the PNP and the general public is considered the building block of this mobilization program. The primary players of this program are the PNP, religious leaders, Local Chief Executives from the province down to the barangay level while other parties ‘shall provide necessary support and assistance in mobilizing the citizen in crime prevention and public safety activities. Participation by the religious teaders representing all affiliations shall be ensured as they will play a significant role in the implementation of this program. b. Specific Guidelines: 1) There shall be a Technical Working Committee (TWC) created for the purpose of this program. The PNP shall initiate to conduct series of consultative meetings with the LGUs and religious leaders prior to its launching. The launching will be highlighted with the signing of Memorandum of Agreement (MOA) with the LGUs through the Department of the Interior and Local Government and the PNP. Further, Covenant Signing will also be incorporated which will be Participated in by representatives from religious sectors, anti-crime ‘groups, academe, and other stakeholders to mark their support to the endeavour. Similarly, this will be replicated in all PNP Police Regional Offices (PROs) nationwide; 2) The key players of this program shall plan out and develop a tailor-fit Barangay Immersion Program as appropriate to the needs of each barangay under the AOR of all PROs, 3) The PNP offices/units, particularly the Chiefs of Police (COPs) and the PCR Sections, have to coordinate with their local religious leaders ‘such as the Parish Priest, Local Pastors, and other Religious Workers Page 4 of 10 for the implementation of this program guided by the Barangay Immersion Program; : 4) The PNP must identify and organize the community of barangay into different sectors (youth sector, transport sector, student sector, business sector, etc.) as a preparation for future information drive, ‘meetings or pulong-pulong sa barangay, seminars, crime prevention education, etc. that will be conducted by PNP personnel (PCR) with the help of the local religious leaders. Community information and ‘education shall be the approaches to be used during this phase: 5) PNP personnel with the help of religious leaders shall reach out to different sectors of the community through drives, meetings or pulong- pulong sa barangay (barangay congress). seminars, crime prevention education and other activities which further strengthen police- community relations. It has failed to show its sincerity and commitment in pursuing genuine and meaningful peace negotiations. These undignified operations and deep-rooted ‘manipulation of the peace process have to end. ‘On November 23, 2017, PRESIDENT RODRIGO ROA DUTERTE signed Proclamation No. 360 entitied, “Declaring the Termination of Peace Negotiations with the NDF-CPP-NPA’, and on December 5, 2017 or 12 days after, subsequently signed Proclamation No. 374 entitled, “Declaring the Communist Party of the Philippines (CPP)-New People’s Amy (NPA) as a Designated, Identified Terrorist Organization under Republic Act (RA) No. 10168" Further, on December 4, 2018, or a year after, the President signed Executive Order (EO) No. 70 (reference 4) with the need fo reframe and refocus government policy for achieving inclusive and sustainable peace, recognizing that insurgencies, intemal disturbances and tensions, and other armed conflicts and threats are NOT ONLY MILITARY AND SECURITY CONCERNS, but are symptomatic of broader social, economic and historical problems such as Poverty, historical injustice, social inequality, and tack of inclusivity, among others. Under Section 3 of the EO, an NTF-ELCAC was created with the President ‘as Chairman, the National Security Adviser as Vice Chairman, and members from different Govemment Agencies and representatives from the Private Sector, providing an efficient mechanism and structure for the implementation of the Whole of Nation Approach (WNA) aimed towards prioritizing and harmonizing the delivery of basic services and social development packages in confict-affected areas and vulnerable communities, and ensuring the active participation of all sectors of society in pursuit of the country’s peace agenda. A National Peace Framework, anchored cn the WNA, was formulated under Section 5 of said EO that shall be responsive to the local needs and sensitive to realities on the ground, and shall include a mechanism for local peace ‘engagements or negotiations and interventions that is nationally orchestrated, directed and supervised, while being locally implemented. Page 2 of 12 This was followed by the issuance of the Guidelines for the Conduct of Local Peace Engagements (LPE) (reference c), to serve as guide to all peace stakeholders on the conduct of nationwide local peace engagements in conflct- affected and conflict-vulnerable communities, through community consultations and problem-solving sessions, and local peace dialogues with Communist Terrorist Group (CTG). 4, MISSION: The PNP, concurrent with its mission and functions, in coordination with the Armed Forces of the Philippines (AFP), the LPE cluster and other concerned ‘clusters of the NTF-ELCAC, shall provide the necessary support during the conduct of LPE in target areas, starting with the pre-determined Barangays nationwide identified as priority. 5. EXECUTION: a. Concept of Operations: The PNP shall actively render assistance during the holding and carrying out of the following Local Peace Engagement (LPE) activities in pursuing the localization efforts: 1)Track 1: Community Consultations and Problem-Solving Sessions ‘These serve as the government's platform to ensure people's participation in the peace process. It is a secured democratic space for continuing dialogues between the RTFs-ELCACILTFs-ELCAC (PICIW/B) and community stakeholders to surface, discuss, and Clarify issues and concems that are at the root of, resulting from or affecting the peace process. It also aims to gather recommendations and strategies to address the concems. ‘This track includes existing programs like Payapa at Masaganang Pamayanan (PAMANA), and other convergence efforts at the regional, provincial, municipal, and barangay levels. The target is the mass base and underground movements including supporters, family members, and other political infrastructures, which comprise 85% of the guerilla fronts. The issues, concems, and recommendations raised shall then be considered in the formulation of the local peace agenda where appropriate levels of response shalll also be identified. 2) Track 2: Local Peace Dialogues with the Communist Terrorist Group (CTG) These refer to the dialogues conducted between the local mechanisms and the leaders and/or members of the CTG. Page 3 of 12 ‘These may be undertaken either openly or discreetly, with or without intermediaries, with those who are willing to engage with the government, which will result in local-level peace agreements and their availment of peace and development programs. This track may also include peace dialogues with armed members of the group who will avail of the E-CLIP without the benefit of Local-Level Peace ‘Agreement (LLPA). These two tracks can be undertaken simultaneously as an integrated whole package, or independently of each other, depending on the situation prevailing in the locality. They are intended to be flexible, adaptable and broad range, in order to cater to any modality that the CTGs may avail of. ‘The Programs, Projects and Activities (PPAs) under the two-tracks of the LPE concept should coincide with or interface with the PPAS of other concemed Clusters of the NTF-ELCAC, in order to: a) Ensure convergence of efforts at the community level (such as delivery of basic services and socio-economic packages); b) Ensure complementation of programs and services provided to the individual former rebels (FRs), their families, and ‘communities; ©) Establish and/or strengthen culture, values, gender and conflict sensitive peace dialogues/iocal peace agenda-identification by region and province; and ¢) Strengthen local capacities for confict prevention, resolution, and management. b, Mechanics for Localization under the Two-Track Approach: 1)Track 1: Community Consultations and Problem Solving Sessions to be conducted by the Regional Task Forces (RTFs)ELCAC and Local Task Forces (LTFs)}-ELCAC Provincial/City/Municipality/Barangay (P/CIM/B) a) Pre-Localization Phase (1) Request from the Retooled Community Support Program (RCSP) operators the result of their area study to separate the insurgents from the peace-loving people and identify the needs of the people in the ground, (2) The Peace, Law Enforcement and Development Support (PLEDS) Cluster, through the RCSP, will conduct Local Conflict Analysis (LCA) which will include the following: (a) Assessment of Area Profile (areas, issues, and context); (0) Identifications of Actors (causes and dynamics); and Page 4 of 12 (©) Prioritization of Issues. (3) Social Preparation will be led_by DSWD and DILG in ‘ground/community coordination. This will include information dissemination, community education, and advocacy. The ‘Strategic Communications (StratCom) Cluster will be in charge of the IEC materials. (4) Coordinate with other agencies to join the Local Peace Engagement Team (LPET) that will conduct the community problem-solving sessions to validate the needs and problems noted by the RCSP operators. The proposed members of the LPET are as follows: (@) Administrator, (b) Engineering Officer; (©) Social Welfare and Development Officer, (@) Agricutture Officer; (@) Chief of Police; () AFP Commander, (g) Representative Religious Organization; (f) President Liga ng mga Barangay; ( SK Chairman; @) Disaster Risk Reduction Officer; and (k) Others as necessary. (6) Advocate information drive to the affected barangays and Conduct Putong-Pulong/Summing-Up of RCSP to ensure total participation of the community. b) Localization Phase (1) Conduct community assemblies in the priority areas to inform the public about the RTFsELCAC/Cabinet Officer for Regional Development and Security (CORDS)/LTF (P/CIM/B) Purposes, and to surface issues and recommendations on how they shoutd be addressed so that peace can be realized. (2) Validate the issue as pointed out by the area study. (@) Classify issues and match with doable interventions and the Page 5 of 12 accountable persons and/or agencies. Based on the issues raised and recommendations made at the community assembly, it may analyze whether these require policy, program/project, resources or process interventions. The recommended intervention should be as specific, realistic and doable as possible. (4) Coordinate with concemed NTF-ELCAC Clusters and hold commitment-setting session/s with the appropriate regional and/or provincial agencies for issues that can be addressed locally. it may send official communication to the NTF-ELCAC and to the agencies concemed regarding specific requests for action from the community prior to holding the pledging session, A Memorandum of Agreement (MOA) to implement ‘the doable interventions within a specific period may be forged. Copies of the MOA shall be provided to the NTF- ELCAC and the heads of the agencies, for monitoring purposes. (©) Ensure converged, timely, and efficient implementation of ‘commitments made by concemed agencies and other peace buiiding and development programs, projects and activities. ¢) Post-Localization Phase ‘The Regional/Provincial/MunicipavBarangay LPET will then ‘conduct a feedback assembly with the community to report on the resolution of major issues. Tre RTFs-ELCAC, through the CORDS, will monitor and assess the process/delivery of commitment. This will be reported to the NTF-ELCAG through the CORDS: (1) The RTF-ELCAC, through the CORDS, will recommend action to the NTF-ELCAC for issues that require Presidential intervention or executive, legislative, and judicial action. It may request the NTF- ELCAC's intercession for issues that cannot be addressed locally. The NTF-ELCAC shall immediately deliberate on the same and endorse action documents for the President's approval; (2) The RTFs-ELCAC, through the CORDS, will also hold progress meetings with provincial agencies concemed to check the implementation of agreed programs and projects, and send regular monthly reports to the NTF-ELCAC regarding the status of such programs and projects; (8) The Regional/Provincial/Municipa/Barangay LPET will consolidate unacted problems and issues to be presented to the agencies concemed in the region through the RTF-ELCAC under the supervision of the CORDS. Feedback on the status will be given to the community concemed; and Page 6 of 12 (4) The RTFs-ELCAC, through the CORDS, will monitor and evaluate to ensure that appropriate measures are bein, yrdertaken 1 respond to ‘he sues and conceme raised rein, 2) Track 2: Local Peace Dialogues between the Local Peace Panel (Regional/Provincial/Municipal/Barangay) and the CTG a) Pre-Localization Phase (1) Out of the community problem sessions, feelers or intention to hold local peace dialogues or surrender may appear. (2) The Situation Awareness and Knowledge Management (SAKM) Cluster will verify intentions and identity of the members of the _ CTG through reliable intermediaries/emissaries. This is necessary to validate the legitimacy of the CTG and for the safety of RTF- ELCAC/CORDS (Joint RPOC-RDC and sub level joint councils) members. Once the intent and identity of the members have been verified, then it may proceed. b) Localization Phase ‘There are two options. The leaders and/or members of the CTS may either enter into @ Local-Level Peace Agreement with a Local Peace Panel (LPP) or directly avail of the E-CLIP. (1) Local-Level Peace Agreement Upon the recommendation of the RTF-ELCAC/CORDS, the NTF-ELCAC wil create the LPP (Regional/Provincial/Municipal/Barangay) that will conduct local peace dislogues with the CTG. The proposed Local Peace Panel members are as follows: (@) Local Chief Executive; (©) Local AFP Commanders; (©) Local PNP Commanders; (@) Two accredited Civil Society Organizations; {e) One Religious Sector and One Academe; (f) IP Mandatory Representative (Provincial level - areas with ancestral domain) or Traditional Leaders; and (g) Provincial Prosecutor. Page 7 of 12 ‘The LPP, under supervision of the RTF-ELCAC, through the CORDS, shall: (@) Set-up exploratory dialogues. This is an opportunity for the body to consult and get inputs from the insurgent group on how to peacefully settle the armed conflict, or at the very least, how to humanize it. The body may request the group's leader to submit its proposed ground rules ‘and substantive agenda for the talks; (b) Coordinate with the RTF-ELCAC, through the CORDS, regarding the CG's and government's common talking points. After evaluating the situation, the NTF-ELCAC shall provide specific guidance to the body regarding the actual conduct of peace dialogues. The NTF-ELCAC may also designate one or two of its members to join the local panel; (©) Draft the ground rules. This may include conditions for holding the formal peace dialogues, such as: venue, composition of both panels, issuance of safe conduct passes, cessation of hostilities in the area, etc.; (@) Formulate the agenda. This should be informed of the results of the consultations with the community. It may also include other concems to humanize the armed ‘confit; (€) Draft the local-evel peace agreement and submit to the NTF-ELCAC, through the RTF-ELCAC/CORDS, for review and approval; (f) Hold the local-level peace agreement. The following principles shall form the foundation of any dialogue with the armed rebel group: (£1) The Philippine Republic is the only sovereignty. The government shail never accord belligerency status to any armed rebel group: (£2) The resolution of any issue or the response to any demand shall always be within the bounds of the Philippine Constitution and the ambit of law, (£3) The local peace panel, through the RTF- ELCACICORDS, ‘shall consult the NTF-ELCAC Tegarding any demand or issue that involves a ‘question of national policy or security prior to making any commitment; and (£4) Provide regular reports to the NTF-ELCAC, through the RTF-ELCAC/CORDS, regarding the status of local peace engagements. Page 8 of 12 (g)Submit to the NTF-ELCAC, through the RTF- ELCACICORDS, the draft joint localevel peace agreement, for approval; (h) Sign the joint local-level peace agreement; (@® Implement agreements; @ Monitor and evaluate compliance to agreements; and (&) Sign Completion/Exit Agreement. @) E-CLIP ‘Should the CTG choose this option, the LPP shall conduct initial dialogue with the group and endorse the latter to the E-CLIP/Amnesty Cluster for the availment of benefits, programs and services. ¢) Post-Localization Phase ‘The E-CLIP/Amnesty Cluster shall submit regular quarterly reports to NTF-ELCAC, through the RTF-ELCACICORDS. It shall also facilitate government's issuance of Amnesty Proclamation. ©. The NTF-ELCAC will provide an efficient mechanism and structure for the implementation of the Whole-of-Nation Approach aimed towards prioritizing and harmonizing the delivery of basic services and social development packages in conflict-affected areas and vulnerable communities, and ensuring the active participation of all sectors of society in the pursuit of the country’s peace agenda. E.O. No. 70 likewise provides for the establishment of a mechanism for local peace engagements or negotiations or interventions that is nationally orchestrated, directed and supervised, while being locally implemented. On 15 April 2019, the NTF-ELCAC convened its first meeting where the President approved the National Plan for the implementation of said EO, as well as the Implementation Plans (Implans) of each of the 12 Clusters/Lines of Effort that were formed by the NTF-ELCAC to help them in carrying out their mandate. These Plans resulted from a series of intensive meetings/workshops that were convened by the NTF- "18 member agencies are National Security Couneil (NSC), Department of Agrarian Reform (DAR), Department of Budget Management (DBM), Department of the Inferior and Local Government (DILG), Department of National Defense (DND). Disaster Risk Reduction and Management Act of 2010” EO 3 dated 28 February 2001on “Defining Policy and Administrative Structure for Govemment’s Comprehensive Peace Efforts” EO 115 dated 21 June 1999 on “Providing for the Mechanics and Operational Structure for the Localization of Peace Efforts to Address the Communist Insurgency” EO 125 dated 15 September 1993 on “Defining Policy and administrative Structure for Government’s Comprehensive Peace Efforts” RA 7160 dated entitled 10 October 1991 on the "Local Government Code of 1991” Other policy issuances that ensure the protection of the rights and the promotion of the interests of vulnerable sectors. IV.POLICY FRAMEWORK AND GUIDELINES A OPERATING FRAMEWORK ‘The Framework for Local Peace Engagements and initiatives of the government shall be guided by the following principles: ‘The LPE mechanism and the government peace and development programs shall be nationally orchestrated, centrally directed, and locally supervised and implemented; ‘The country’s constitutional integrity and sovereignty shall not be compromised; There must be a complete and genuine resolution of the Local Armed Conflict, involving the Communist Party of the Philippines (CPP); New People’s Army (NPA), its organs of political power and its “Militia ng Bayan”; In the event of a ceasefire, the constitutional mandate of the State to ensure public safety, protect critical infrastructure and private properties; maintain peace and order and the rule of law, shall be maintained unconditionally; As part of the Government peace incentive programs, a full amnesty program and a normalization process shall be implemented; ‘The agenda of the Local Peace Engagements shall be based on the flash point issues raised in the target priority areas, the local development plans and the Philippine Development Plan 2017-2022; and, The human rights principles of inclusive participation, accountability and transparency shall guide the overall directions of local peace engagements, The State shall actively encourage its citizens to be involved in the pursuit of peace at the level of their communities, especially in determining the appropriate agenda, the results of which shall be truly responsive to their needs. ‘The LPE efforts shall also be guided by the principles underlying the comprehensive peace process, as previously laid down by the National Unification Commission (NUC) under EO 125 (series of 1993) “Defining Policy and administrative Structure 3 for Government's Comprehensive Peace Efforts” and subsequently reaffirmed under EO No. 3 (with same title issued in 2001). Thus, the localization of the peace process shall: 1. Be community-based, reflecting the sentiments, values and principles important to all Fili 2. Seek to forge a new social compact for a just. equitable, humane and pluralistic society. 2, Seek a principled and peaceful resolution of the armed conflict, with neither blame nor surrender, but with dignity for all concerned. ‘The localization of the peace process shall be done to generate a positive impact that shall revitalize and complement the “six paths to peace”, which are integral parts of the ‘government's comprehensive peace process and are provided for in EO No. 3 Defining Policy and administrative Structure for Government Peace Efforts (s.2001): 1. Pursuit of social, economic and political reforms that address the root causes of the armed conflicts; 2. Building consensus and empowerment for peace; 3. Pursuit of a peaceful, negotiated settlement with the different armed rebel groups; 4. Establishment of programs for reconciliation and reintegration into mainstream society; 5, Addressing concerns that arise out of the continuing armed hostil 6. Nurturing a positive climate for peace. ies; and, B. OPERATING STRUCTURES 4 National Task Force to End the Local Communist Armed Conflict (NTF- ELCAC) ‘These structures shall serve as the venue for integrating and coordinating national efforts to localize the peace efforts. They shall be responsible for overseeing and supervising the conduct of local peace engagements. They shall perform the following duties and responsibilities: 1. Provide policy directions and operational guidelines for efficient and effective implementation of local peace efforts: 'b. Identify national issues that bear directly on the insurgency, including issues and concerns that may be referred by the Regional Task Forces to End Local Communist Armed Conflict (RTFs-ELCAC) composed of the Joint RPOCs-RDCs Local Task Forces-ELCAC (LTF-ELCAC - VCity/Municipal/Barangay-P/C/M/B); c. Identify and recommend to the President, on a continuing basis, specific areas in the country that may be ready for local peace dialogues, after convening the RTF- ELCAC and LTFs-ELCAC (P/C/M/B); 4. Formulate a Basic Reform Agenda for Peace that shall pave the way for lasting peace settlements with the insurgents; e. Coordinate and monitor the activities of the RTF-ELCAC and LTFs-ELCAC (PIC/MIB) to ensure sustainability of peace efforts; f Develop and oversee the implementation of an appropriate Information, Education and Communication Plan for localizing the peace process; 8. Submission of regular reports to the President to sustain movement and progress of the ELCAC work; and, h, Undertake other tasks that the President may deem necessary ‘The NTF-ELCAC shall adopt the following guidelines to assist them in carrying out their mandated tasks: . Focus on issues of injustice that are (potential) causes of armed conflict in the affected barangays and vulnerable communities, also referred to as conflict areas. . Work on social, economic and political reforms whether local, sectoral or institutional that address the root causes of the armed conflicts. ith those that are quickly and effectively implementable to build confidence in the process. The basis will be the recommendations of local or sectoral inter- clusters’ assessments and decisions. |. Adopt a conflict-sensitive? and peace-promoting approach in the development, planning and implementation of policies, programs, projects and activities in support of the local peace engagements; . Use the imaginative problem-solving approach, cutting, where legally feasible, through the bureaucratic maze. For this purpose, close coordination and effective ‘working relationship with concerned government agencies, the private sector and civil society groups shall be undertaken to ensure the implementation of a Whole-of-Nation Approach. Initiate programs to empower communities to participate in developing a culture of peace. . After the proper security clearances, involve a wide range of individuals and groups from civil society, church, and private sector and ensure their active participation, for everyone to own the process. |. Adopt modalities of interventions that will ensure timely, responsive and sustained action to address issues of unpeace. 2% RTFs-ELCAC (Joint RPOCs-RDCs), supervised by the Cabinet Officers for Regional Development and Security (CORDS) ‘These are the structures responsible for coordinating the local peace engagements at the regional and local levels. Localization operationalizes the principle that genuine peace should be anchored on the sentiments and aspirations of the people, because the people are both the prime movers and beneficiaries of the peace process. Towards this end, they shall perform the following functions: Coordinate with concerned agencies and LGUs in determining focus areas for undertaking LPEs; Identify issues and concerns creating situations of “unpeace” or potential armed conflict, recommend appropriate action, and coordinate or cause the resolution of the same: Determine the programs and projects that can be implemented to address socioeconomic concems of communities affected; Promote an environment and culture of peace in the region; Refer to the NTF-ELCAC, issues and concerns requiring Presidential intervention and/or actions from the executive, legislative and judicial branches of the government; and provide regular feedback to the community; ‘Agree on institutional arrangements for their secretariat functions; and, Provide regular reports to the President, through the NTF-ELCAC, on their activities as well as the peace situation in their areas of responsibility. In light of the above functions, the RTFs-ELCAC and LTFs-ELCAC (PIC/M/B) are expected to fulfill the following roles: 2. As peace advocate, They shall champion the cause of peace in the area by utilizing local media and other advocacy channels. In coordination with OPAPP, they shall endeavor to build public support for ending violence and armed conflict through the conduct of continuing consultations on both the national and regional levels. This shall build consensus for a peace agenda and process, and the mobilization and facilitation of people's participation in the peace process. For this purpose, they may link up with the existing network of peace partners in the areas. » Asgrievance mechanism, They shall be the venue for reporting and resolving issues raised by the community that are at the root of, resulting from or further aggravating the armed conflict. As such, they shall ensure that legitimate concerns are properly documented and referred to the agencies or persons that can act on them within a specific timeframe. They shall also be responsible for following up the status of action on such issues and reporting the same to the NTF-ELCAC. . As facilitator. They shall assist the community in accessing projects, services and resources as components of a local “quick response program” for peace, especially for addressing socio-economic issues and those for ‘medium to long-term interventions that are to be incorporated in the LGU's Comprehensive Development Plans (CDPs). They shall also identify and network with persons and offices that can facilitate the entry of development interventions needed by the community. 3, Role of the LPE Cluster a ce The RTFs-ELCAC and LTF-ELCAC (P/C/M/B) will mirror the LPE Cluster at the national level. ‘The members of the LPE Cluster will be the focal agencies in cascading the LPE Implan and Guidelines to the regional and local levels. ‘The LPE Cluster will coordinate with the RTFs-ELCAC Secretariat and RTF Technical Working Group (RTF TWG) in ensuring that Action Plans related to the two tracks of the LPE are in line with the LPE Implan and Guidelines, ‘The LPE Cluster shall ensure that inter-cluster coordination (vertical and horizontal) shall be done in carrying out its Implan. The LPE Cluster serves as a conduit between the NTF and the RTF, through the latter's TWG and Secretariat. The LPE Cluster shall likewise ensure close coordination with the 11 Clusters/LOE. 4, TWO-TRACK APPROACH FOR LOCALIZATION ‘The LPE shall be undertaken in two tracks in pursuing the localization efforts, as follows: Q Consultatios ro ving These serve as the government's platform to ensure people’s participation in the peace process. It is a secured democratic space for continuing dialogues between the RTFs-ELCAC/LTFs-ELCAC (P/C/M/B) and community stakeholders to surface, discuss and clarify issues and concerns that are at the root of, resulting from or affecting the peace process. It also aims to gather recommendations and strategies to address these concerns. This track includes existing programs like PAMANA, and other convergence efforts at the regional, provincial, municipal and barangay levels. The target is the mass base and underground movements including supporters, family members and other political infrastructures, which comprise 85% of the ‘guerilla fronts. The issues, concems and recommendations raised shall then be considered in the formulation of the local peace agenda where appropriate levels of response shall also be identified. “k 2: Le (cTG) These refer to dialogues conducted between the local mechanisms and the leaders and/or members of the CTG. These may be undertaken either openly. or discreetly, with or without intermediaries, with those who are willing to engage with government, which will result in local-level peace agreements and their availment of peace and development programs. This track may also include peace dialogues with armed members of the group who will avail of the E-CLIP without the benefit of a local-level peace agreement. ist Te ‘These two (2) tracks can be undertaken simultaneously as an integrated whole package, or independently of each other, depending on the situation prevailing in the locality. They are intended to be flexible, adaptable and broad in range, in order to cater to any modality that the CTGs may avail of. ‘The programs, projects and activities (PPAs) under the LPE’s 2-tracks should coincide with or interface with the PPAs of other concemed Clusters to: (1) censure convergence of efforts at the community level (such as delivery of basic services and socio-economic packages); (2) ensure complementation of programs and services provided to the individual FRs, their families and communities; (3) establish and/or strengthen culture, values, gender and conflict sensitive peace dialogues/local peace agenda-identification by region and province; and (4) strengthen local capacities for conflict prevention, resolution and management. 5. MECHANICS FOR LOCALIZATION UNDER THE TWO-TRACK APPROACH Track 1: Community Consultations and Problem-! ions to be conducted .TFs-ELCAC and LTFs- A. Pre-Localization Phase 1, Request from the Retooled Community Support Program (RCSP) operators the result of their barangay area study to separate the insurgents from the peace-loving people and identify the needs of the people in the ground. 2. The Peace, Law Enforcement and Development Support (PLEDS) Cluster, through the RCSP, will conduct Local Conflict Analysis which will include the following: a. Assessment of Area Profile (areas, issues, and context) b. Identification of Actors (causes and dynamics) c. Prioritization of Issues 3. Social Preparati will be led by DSWD and DILG in ground/community coordination. This will include information dissemination, community education, and advocacy. The Strategic Communications (StratCom) Cluster will be in charge of the IEC materials. 4. Coordinate with other agencies to join the Localized Peace Engagement Team that will conduct the community problem- i ns to validate the needs and problems noted by the RCSP operators. Advocate information drive to the affected barangays and conduct Pulong-Pulong/Summing Up of RCSP to ensure total participation of the community. Localization Phase 1. Conduct community assemblies in the priority areas to inform the public about the RTFs-ELCAC/CORDSI/LTF (P/C/M/B) purposes, and to surface issues and recommendations on how they should be addressed so that peace can be realized. 2. Validate the issue as pointed out by the area study. 3. Classify issues and match with doable interventions and accountable persons and/or agencies. Based on the issues raised and recommendations made at the community assembly, it may analyze whether these require policy, program/project, resources or process interventions. The recommended intervention should be as specific, realistic and doable as possible. 4, Coordinate with concemed NTF-ELCAC Clusters and hold ‘commitment-setting session/s with the appropriate regional and/or provincial agencies for issues that can be addressed locally. It may send official communication to the NTF-ELCAC and to the concemed agencies regarding specific requests for action from the community prior to holding the pledging session. A Memorandum of Agreement (MOA) to implement the doable interventions within a specific period may be forged. Copies of the MOA shall be provided to the NTF- ELCAC and the heads of the agencies, for monitoring purposes. 5. Ensure converged, timely and efficient implementation of commitments made by concemed agencies and other peacebuilding and development programs, projects and activities. Post-Localization Phase ‘The Regional/Provincial/Municipal/Barangay LPE Team will then conduct a feedback assembly with the community to report on the resolution of major issues. The RTFs-ELCAC, through the CORDS, will monitor and assess the process/delivery of commitment. This will be reported to the NTF-ELCAC through the CORDS. 1. The RTF-ELCAC, through the CORDS, will recommend action to the NTF-ELCAC for issues that require’ Presidential intervention or executive, legislative and judicial action. It may request the NTF- ELCAC's intercession for issues that cannot be addressed locally. The NTF-ELCAC shall immediately deliberate on the same and endorse action documents for the President's approval. 10 2. The RTFS-ELCAC, through the CORDS, will also hold progress meetings with concemed provincial agencies to check on implementation of agreed programs and projects, and send regular monthly reports to the NTF-ELCAC regarding the status of such programs and projects. 3. The Regional/Provincial/Municipal/Barangay LPE Team will consolidate unacted problems and issues to be presented to the concerned agencies in the region through the RTF-ELCAC under the supervision of the CORDS. Feedback on the status will be given to the community concemed. 4. The RTFs-ELCAC, through the CORDS, will monitor and evaluate to ensure that appropriate measures are being undertaken to respond to the issues and concerns raised therein. A. Pre-Localization Phase: &. Out of the community problem sessions, feelers or intention to hold local peace dialogues or surrender may appear. b. The SAKM Cluster will verify intentions and identity of the members of the Communist Terrorist Group through reliable intermediaries/emissaries. This is necessary to validate the legitimacy of the Communist Terrorist Group and for the safety of RTF- ELCAC/CORDS (Joint RPOC-RDC and fei i members. Once the intent and identity of the members have been verified, then it may proceed. B. Localization Phase: There are two options. The leaders and/or members of the Communist Terrorist Group may either enter into a Local- level Peace Agreement with a Local Peace Panel or directly avail of the E-CLIP. 1. Local-level Peace Agreement Upon the recommendation of the RTF-ELCAC/CORDS, the NTF- ELCAC will create a Local Peace Panel (Regiona/Provincial/Municipal/Barangay) that will conduct local peace dialogues with the Communist Terrorist Group. The proposed Local Peace Pane! members are as follows: a. Local Chief Executive; b. Local Armed Forces of the Philippines Commanders; c. Local Philippine National Police Commanders; " Two (2) aceredited Civil Society Organizations; One (1) Religious Sector and One (1) Academ IP Mandatory Representative (Provincial level ~ areas with ancestral domain) or Traditional Leaders; & Provincial Prosecutor ape The Local Peace Panel (Regional/Provincial/Municipal/Barangay), under the supervision of the RTF-ELCAC, through the CORDS, shall: a. Set up exploratory dialogues. This is an opportunity for the body to consult and get inputs from the insurgent group on how to peacefully settle the armed conflict, or at the very least, how to humanize it. The body may request the group's leader to submit its proposed ground rules and substantive agenda for the talks. 'b. Coordinate with the RTF-ELCAC, through the CORDS, regarding, the Communist Terrorist Groups and government's common talking points. After evaluating the situation, the NTF-ELCAC shall provide specific guidance to the body regarding the actual conduct of peace dialogues. The NTF-ELCAC may also designate ‘one or two of its members to join the local panel. ¢. Draft the ground rules. This may include conditions for holding the formal peace dialogues, such as: venue, composition of both panels, issuance of safe conduct passes, cessation of hostilities in the area, etc. 4. Formulate the agenda. This should be informed of the results of the consultations with the community. It may also include other concerns to humanize the armed conflict. Draft the local-level peace agreement and submit to the NTF- ELCAC, through the RTF-ELCAC/CORDS, for review and approval f. Hold the tocal-level formal peace dialogues to discuss and agree (on a joint local-level peace agreement. The following principles shall form the foundation of any dialogue with the armed rebel ‘group: pine Republic is the only sovereignty. The government will never accord belligerency status to any armed rebel group. i The resolution of any issue or the response to any demand shall always be within the bounds of the Philippine ‘Constitution and the ambit of law. ji, The local peace panel, through the | RTF- ELCAC/CORDS, shall consult the NTF-ELCAC regarding any demand or issue that involves a question of, national policy or security prior to making any commitment. jv. Provide regular progress reports to the NTF-ELCAC, through the RTF-ELCAC/CORDS, regarding the status of local peace engagements. g. Submit to the NTF-ELCAC, through the RTF-ELCAC/CORDS, the draft joint local-level peace agreement, for approval. h. Sign the joint local-level peace agreement i. Implement agreements J. Monitor and evaluate compliance to agreements k. Sign Completion/Exit Agreement 2. E-CLIP Should the Communist Terrorist Group choose this option, the Local Peace Panel shall conduct initial dialogue with the group and endorse the latter to the ECLIP/ Amnesty Cluster for the availment of benefits, programs and services. C. Post-Localization Phase: ‘The ECLIP/Amnesty Cluster shall submit regular quarterly reports to the NTF-ELCAC, through the RTF-ELCAC/CORDS. It shall also facilitate ‘government's issuance of an Amnesty Proclamation. V. AMENDMENT CLAUSE ‘These Guidelines shall be periodically reviewed and amended as necessary, by the NTF-ELCAC. VLEFFECTIVITY These Guidelines shall take effect upon approval by the NTF ELCAC. MANILA BY THE PRESIDENT OF THE PHILIPPINES EXECUTIVE ORDER NO. 70 INSTITUTIONALIZING THE WHOLE-OF-NATION APPROACH IN ATTAINING INCLUSIVE AND SUSTAINABLE PEACE, CREATING A NATIONAL TASK FORCE TO END LOCAL COMMUNIST ARMED CONFLICT, AND DIRECTING THE ADOPTION OF A NATIONAL PEACE FRAMEWORK WHEREAS, Article II of the 1987 Constitution provides for the following State principles and policies: i, The Philippines renounces war as an instrument of national policy; ji, The maintenance of peace and order, the protection of life, liberty, and property, and the promotion of the general welfare are essential for the enjoyment by all the people of the blessings of democracy; and iii, The State shall promote a just and dynamic social order that will ensure the prosperity and independence of the nation and free the people from poverty through policies that provide adequate social services, promote full ‘employment, a rising standard of living, and an improved quality of life for all; WHEREAS, Executive Order No. 16 (s. 2017) adopted the National Security Policy 2017-2022, which calls for the end of all armed threats in the Philippines and recognizes that internal socio-political stability rests upon healing the rifts that divide the nation by promoting participatory governance, synergy of government development efforts, and enhancing the participation and responsibilities of local government units (LGUs), WHEREAS, one of the objectives of the Philippine Development Plan 2017- 2022 is to attain inclusive and sustainable peace through intensified development and other peace-building initiatives in conflict-affected and -vulnerable communities; WHEREAS, the Association of Southeast Asian Nations (ASEAN). through the Joint Communique of the 50" ASEAN Foreign Ministers meeting in Maria last 05 ‘August 2017, reaffirmed the importance and effectiveness of the Whole-of-Nation approach as opposed to a purely military option in combating terrorism and violent extremism; WHEREAS, there is a need to reframe and refocus the government policy for achieving inclusive and sustainable peace by recognizing that insurgencies, internal ‘THE PRESIDENT OF THE PHILIPPINES
