TERMS AND CONDITIONS


OPEN ACCOUNT AND WIN CASHBACK CAMPAIGN 2023
1. Open Account and Win Cashback Campaign (“Campaign”) is jointly organised by CIMB
Bank Berhad [Registration No.: 197201001799 (13491-P)] (“CIMB Bank”) and CIMB
Islamic Bank Berhad [Registration No.: 200401032872 (671380-H)] (“CIMB Islamic”).
Every mention of “CIMB” refers to both CIMB Bank and CIMB Islamic.

Campaign Period
2. The Campaign period shall commence on 1 March 2023 00:01 hours (GMT +8) and
end on 31 May 2023 23:59 hours (GMT +8), both dates inclusive unless otherwise
notified by CIMB (“Campaign Period”).

3. CIMB reserves the right to change the duration and/or the commencement and/or
expiry dates of the Campaign Period by giving seven (7) calendar days’ prior notice.

Eligibility

4. Subject to the Terms and Conditions herein, this Campaign is open to:

a. all individuals aged 18 years and above; and

b. all individuals who do not have a Current Account/-i and/or Savings Account/-
i (“CASA/-i”), including current secondary account holders without a primary
account, with CIMB prior to the Campaign Period.

(collectively referred to as the “Eligible Participant(s)”)

5. The following categories of persons/entities shall NOT be eligible to participate in this


Campaign: -

a. Small medium enterprises/enterprise banking/commercial and corporate


customers as shall be determined by CIMB which include but shall not be
limited to sole proprietorships, partnerships, public listed companies, private
limited companies, charitable/non-profit organisation/societies, clubs,
associations, cooperatives and professional partnerships; and/or

b. Individuals below the age of eighteen (18) years old; and/or

c. Individuals who are not of Malaysian nationality; and/or

d. Staff members of CIMB; and/or

e. Customers who have been declared as a bankrupt or have been wound up or


otherwise have bankruptcy or winding-up proceedings of any nature instituted
against them; and/or

f. Customers who have participated in other CIMB’s Current/Savings Account/-i


related campaign(s) during the Campaign Period except for the campaign(s)
stated in Clause 5g below. If the Eligible Participant(s) is concurrently a
participant in any other ongoing CASA/-i campaigns or promotional schemes
organised by CIMB, the Eligible Participant(s) shall only be eligible to be
declared as winner or recipient of rewards under one of such campaigns or
promotional schemes. CIMB reserves the right to decide which campaigns or
promotional schemes is applicable to the relevant Eligible Participant(s).

g. Campaign(s) to be exempted in Clause 5f are Prime Enhanced Campaign and


Activate Account and Get Cashback Campaign.

6. By participating in this Campaign, the Eligible Participant(s) represents and confirms


that he/she does not fall within the categories of persons/entities excluded at Clause
5 above.

Qualifying Criteria
7. In order to be qualified to earn the Reward(s) defined in Clause 11 hereof, the Eligible
Participant(s) must fulfil the following qualifying criteria (“Qualifying Criteria”):

c. CASA-i refers to the below accounts:

i. OctoSavers Account-i
ii. Preferred Savings Account-i
iii. EcoSave Savings Account-i
iv. Basic Savings Account-i
v. Preferred Current Account-i
vi. Current Account-i
vii. Basic Current Account-i

d. Once any of the CASA/-i listed in Clause 7b or 7c has been successfully


opened, customers will need to activate CIMB Clicks ID.

8. The Eligible Participant(s) must also comply with the prevailing terms and conditions
governing the following products while participating in this Campaign (whichever is
applicable):-
a. CIMB Clicks;
b. CIMB OCTO App;
c. CIMB CASA/-i;
d. CIMB Apply App;
e. CIMB Debit Mastercard or CIMB Octo Debit MasterCard;
(collectively referred to as the “Prevailing Terms And Conditions”).

9. The Eligible Participant(s) who have successfully met the Qualifying Criteria shall
hereinafter be referred to as the “Eligible Account Holder(s)”.

10. CASA/-i is protected by PIDM up to RM250,000 for each depositor.

Campaign Reward & Fulfilment

11. Subject to the terms and conditions herein, the Eligible Account Holder(s) will be
entitled to the following reward (“Reward(s)”) if they fulfill the following
requirements:

12. Each Eligible Account Holder shall be eligible to receive both Rewards during the
Campaign Period, but limited to once per Reward.

13. In the event where the new CASA/-i is opened as a joint account, the principle account
holder will be recognized as the Eligible Account Holder. Only the principle account
holder will be eligible to win any of the Rewards in Clause 11 table.

14. CIMB will notify the winner(s) of Reward(s) ("Winner(s)”) via CIMB Clicks App or Short
Message Service (SMS) or by any other means of notification which CIMB may select
at its absolute discretion.

15. If the Winner(s) won RM50 Cashback:

a. One (1) RM50 Cashback may be won throughout the Campaign Period.

b. The Cash Prize Rewards will be credited into the Winner(s)’ signed up CASA/-i
within ninety (90) calendar days after the end of Campaign Period.

c. The Eligible Participants are responsible for ensuring that their mobile
numbers and email address provided are current and updated with CIMB.
CIMB shall not be responsible to the Eligible Participants for any loss (including
loss of opportunity and consequential loss flowing there from) suffered,
including the loss for any failure to fulfil the crediting of the Rewards, if their
mobile numbers and/or email address in CIMB’s record are not contactable,
current or updated.

16. If the Winner(s) won RM100 Cashback:

a. One RM100 Cashback may be won throughout the Campaign Period, from the
respective Campaign Month(s) which the Eligible Participant(s) had sign up
CASA/-i by maintaining a minimum month end balance of RM2,500 for 3
months continuously from the account opened date.

b. The Cash Prize Rewards will be credited into the Winner(s)’ signed up CASA/-i
within one hundred and twenty (120) calendar days after the end of Campaign
Period.

c. The Eligible Participants are responsible for ensuring that their mobile
numbers and email address provided are current and updated with CIMB.
CIMB shall not be responsible to the Eligible Participants for any loss (including
loss of opportunity and consequential loss flowing there from) suffered,
including the loss for any failure to fulfil the crediting of the Rewards, if their
mobile numbers and/or email address in CIMB’s record are not contactable,
current or updated.

17. By accepting and receiving the Reward(s), the Winner(s) agrees to hold harmless CIMB
and its affiliates and their respective directors, officers, employees and agents from
and against any claim, action, proceeding, judgement, damage, loss, expense or
liability in connection with such Winner(s):-
i. participation in the Campaign; or
ii. receipt, redemption or use of the Reward(s).

18. CIMB reserves the right to disqualify the Eligible Participant(s) who have failed to fulfil
the CIMB’s Prevailing Terms and Conditions and/or who have submitted incomplete
or inaccurate data, without prior notice.

19. Any Eligible Participant(s) who has been found performing certain action on their
account that are of high risk and not in line with CIMB’s Users Terms and Conditions
or terminates their account during the Campaign Period shall be automatically
disqualified from this Campaign and shall not be entitled to the Reward(s).

20. The Eligible Participant(s) whose CASA/-i is suspended, closed, cancelled or


terminated for any reason during the Campaign Period or prior to receiving the
Reward(s) will not be entitled to any Reward(s) under this Campaign.

21. CIMB shall be entitled to withhold any benefit under the services rendered, with prior
notice to the Eligible Participant(s) if the Eligible Participant(s) are found to have been
in breach of any of CIMB’s Users Terms and Conditions.

22. CIMB will not entertain any request from the Eligible Participant(s) to transfer any
Reward(s) awarded to them to any of their CIMB accounts or other accounts
maintained with other financial institutions or any third party’s accounts, exchange it
for or substituted it with cash or different reward or reward of similar value or any
other alternatives in any circumstances.

General Terms & Conditions

23. The Eligible Participant(s) agree that by participating in the Campaign, they:

a. have accessed, read and confirm their agreement to these Terms and
Conditions;
b. consent to CIMB processing and disclosing their personal data in accordance
with the CIMB Group Privacy Notice at www.cimb.com.my;
c. agree that all decisions fairly and reasonably made by CIMB in relation to every
aspect of this Campaign, shall be final, binding and conclusive; and
d. agree that CIMB shall not be liable or held responsible to the Eligible
Participant(s) if CIMB is unable to perform in whole or in part of any of its
obligations in these Terms and Conditions attributable directly or indirectly to:
i. the failure of any mechanical or electronic device, data processing
system or transmission line;
ii. electrical failure;
iii. industrial dispute, war, strike or riot;
iv. any act of God beyond CIMB’s control; or
v. any factor in a nature of a force majeure which is beyond CIMB’s
reasonable control.

24. The Eligible Participant(s) will be disqualified from participating in the Campaign
during the Campaign Period if:
a. the Eligible Participant(s) are in breach of the Prevailing Terms and Conditions;
b. the CASA/-i is terminated or closed or be made subject to any attachment,
adverse orders made by the Court or any authorities sanctioned by laws; or
c. the CASA/-i is delinquent, invalid or cancelled by the Eligible Participant(s) or
CIMB.

25. CIMB shall have the right to disqualify any Eligible Participant(s) that it determines to
be:
a. tampering with the application process; and/or
b. acting in breach of these Terms and Conditions.

26. CIMB shall not be liable to any Eligible Participant(s) or any party for any loss or
damage (including but not limited to, loss of income, profits or goodwill, direct or
indirect, incidental, consequential, exemplary, punitive or special damages) resulting
from:
a. the Eligible Participant(s)’ participation or non-participation in the Campaign;
and/or
b. any non-receipt or delayed receipt by the Eligible Participant(s) of CIMB’s
notifications under this Campaign,
unless such loss or damage arises from and is caused directly by CIMB’s gross
negligence or willful default.

27. CIMB will not be responsible for late, lost, incomplete, incorrectly submitted, delayed,
illegible, corrupted or misdirected application of the CASA/-i or related
correspondence whether due to error, omission, alteration, tampering, deletion, theft,
destruction or otherwise unless the same is caused directly by CIMB’s gross negligence
or willful default.

28. These terms and conditions:


a. CIMB shall have right to vary, add, delete or amend any of these Terms and
Conditions (“Amendment”) by giving twenty-one (21) calendar days’ prior
notice to the Eligible Participant(s) via:
i. announcement at CIMB’s website; and/or
ii. notice at CIMB’s branches; and/or
iii. notice at CIMB’s Currency Exchange counters; and/or
iv. advertisement in one newspaper of CIMB’s choice; and/or
v. any other means of notification which CIMB may select.
b. The Amendment shall be considered as binding on the Eligible Participant(s)
from date as specified by CIMB in the notification.
c. Eligible Participant(s) agree to access CIMB’s website at regular intervals to
view the Terms and Conditions of the Campaign and to ensure that they are
kept up-to date with any variation to these Terms and Conditions.
d. Shall prevail over any provisions or representations contained in any other
materials advertising the Campaign; and
e. Are to be read together with the Prevailing Terms and Conditions which shall
apply in addition to these Terms and Conditions.
f. Shall be subject to any prevailing laws, regulations and guidelines, directives,
notices issued by Bank Negara Malaysia or any other body having supervisory
authority over CIMB from time to time.

29. CIMB will not be liable to the Eligible Participant(s) for any loss or damage suffered or
incurred by the Eligible Participant(s) as a direct or an indirect result of the
Amendment.

30. Eligible Participants shall fully indemnify and keep CIMB indemnified against any fee,
cost, charge, expense, loss, damage or liability which CIMB may incur as a result of:
a. the Eligible Participant(s)’ participation in the Campaign; and/or
b. the Eligible Participant(s)’ receipt, redemption or use of the Reward(s).

31. Eligible Participants shall direct any query, feedback, concern, issue or complaint
pertaining to the CASA to CIMB and CASA-i to CIMB Islamic.

32. CIMB Islamic as the provider of the all CASA-i stated in Clause 7c.

33. This Campaign:


a. By participating in the Campaign, the Winner(s) authorises CIMB to publish
and/or display materials and/or information, including but not limited to the
name, photos and city of residence of the Winner(s) without compensation for
advertising and publicity purposes in the manner it deems appropriate
(“Publication Rights”).
b. If the Winner(s) objects to CIMB’s Publication Rights after participating in the
Campaign, CIMB shall have the right to forfeit the Reward(s) and select
another Winner(s).

34. The Winner(s):


a. The Winner(s) is solely responsible to ensure his/her mobile number and/or
email address and/or mailing address (“Contact Details”) given to CIMB is/are
current and updated.
b. CIMB shall have the right to forfeit the Reward(s) if the Winner(s)’ Contact
Details maintained in the CIMB record are invalid and/or not updated.
c. CIMB shall not be responsible to the Winner(s) for any loss (including loss of
opportunity and consequential loss arising therefrom) and damage suffered or
incurred if the Contact Details maintained in CIMB’s record are not current or
correct.

35. Eligible Participant(s) may contact CIMB’s Customer Resolution Unit (“CRU”) for any
feedback and/or complaint in relation to this Campaign via letter, phone call and email:

36. CIMB may change the above contact details by notifying the Eligible Participant(s) by
way of announcement at CIMB’s website at www.cimb.com.my or by any other
means of notification which CIMB may select.
