TERMS AND CONDITIONS


CIMB Hari-Hari Menang Campaign

1. The “CIMB Hari-Hari Menang” Campaign (“Campaign") is jointly organised by CIMB Bank Berhad
[197201001799 (13491-P)] (“CIMB Bank”) and CIMB Islamic Bank Berhad [200401032872
(671380-H)] (“CIMB Islamic Bank”). CIMB Bank and CIMB Islamic Bank shall hereinafter
collectively be referred to as “CIMB”.

Campaign Period

2. The Campaign shall run from 02:00 hours (GMT+8) on 01 October 2021 to 21:55 hours (GMT+8)
on 31 December 2021, both dates inclusive (“Campaign Period”).

3. CIMB reserves the right upon giving adequate prior notice of seven (7) calendar days to change
the duration and/or the commencement and/or expiry dates of the Campaign Period.

Eligibility

4. Subject to these Terms and Conditions, this Campaign is open to all existing and new CIMB
customers who have or open or apply for a: -

a. Current Account/-i and/or Savings Account/-i (excluding Junior Savers Account/-i) with CIMB
(“Participating CASA Account(s)”); and/or
b. Credit Card/-i issued by CIMB in Malaysia (excluding CIMB’s Platinum Business Card and
Fuel Tanker Card) (“Participating Credit Card(s)”); and

have a valid Malaysian mobile number maintained in CIMB’s records.

5. The following persons/entities are NOT eligible to participate in this Campaign:

a. Representatives and/or agents (including advertising and campaign agents, third party vendors
and service providers) of CIMB (including its subsidiaries and related companies); and/or
b. Small medium enterprises/Enterprise Banking/Commercial and Corporate customers as
determined by CIMB which include but shall not be limited to sole proprietorships, partnerships,
public limited companies, private limited companies, charitable/non-profit organization,
societies and professional partnerships; and/or
c. Individuals below the age of eighteen (18) years.

By participating in this Campaign, the customer represents and confirms that he/she does not fall
within the categories of persons/entities excluded above. Customers who are eligible to participate
in this Campaign shall hereinafter be referred as the “Eligible Customer(s)”.

6. Permanent, contract and/or temporary staff or employees of CIMB Group (i.e. CIMB Investment
Bank Berhad, CIMB Bank and CIMB Islamic Bank) and their immediate family members (i.e. their

spouses, children, parents, brothers and sisters) are eligible to win Daily Cash Prizes ONLY (as
set out in Table A at Clause 7 below) throughout the Campaign Period. Notwithstanding that such
staff or employees or their immediate family members may be awarded Qualifying Entries (as
defined at Clause 11 below), they will not be eligible to participate in the Grand Prize/Consolation
Prizes selection stage, and thus they can neither be a Grand Prize Winner nor a Consolation Prize
Winner.

7. Table A shows the prizes (“Prizes”) that are available to the winners of this Campaign.

8. Subject to Clause 6 above, each Eligible Customer(s) shall only be entitled to win a maximum of
one (1) Prize either under the Grand Prize or Consolation Prizes category throughout the Campaign
Period.

9. The Grand Prize/Consolation Prize Winner (hereinafter defined at Clauses 43 (b) and 44 (d) below
must maintain a minimum Average Balance (hereinafter defined at Clause 10 below) of RM1,500
in their Participating CASA Account(s) throughout each calendar month during the Campaign
Period or spend a minimum total of RM3,000 cumulatively with their Participating Credit Card within
the Campaign Period in order to qualify to win the Grand Prize/Consolation Prizes.

10. “Average Balance” refers to the sum of the Daily Day-End Balances for each calendar month
during the Campaign Period, divided by the number of days in each calendar month.

Eligible Customer C does not fulfil the criteria outlined in Clause 9. Eligible Customer C is not
eligible to win the Grand Prize/Consolation Prizes.

Participating Criteria and Qualifying Entry

11. There are two (2) categories of this Campaign namely: (i) Daily Banking; and (ii) Needs-based
Banking. Eligible Customer(s) may participate in the Campaign by performing the Eligible
Transaction(s) listed in Table B (subject to Clause 34 below) and shall stand to win Daily Cash
Prizes and/or earn “Qualifying Entries” (which will enable them to be in the running to win the
Grand Prize/Consolation Prize offered under this Campaign) in the manner stated therein.

Notes:
1. The number of unique links available are capped at 316,000 for Category 1 and 4,000 for Category
2 on a daily basis. The unique links will be given to Eligible Customer(s) on a first-come, first-served
basis.
2. For transaction group 2B and 2C, unique links will be sent within T+3 days (T = date of that Eligible
Transaction), subject always to the daily cap on the number of unique links available for Category
2 and the daily/weekly limit of unique links for each transaction group as set out in Table B above.
3. Current Account/-i and Savings Account/-i are protected by PIDM up to RM250,000 for each
depositor.

12. Only the first Eligible Transaction(s) in each transaction group performed by Eligible Customer(s)
on a particular day will be taken into consideration in the provision of the unique link to the Eligible
Customer(s) for that particular day.

13. The number of unique links that each Eligible Customer(s) may receive under this Campaign is
subject to the pre-determined daily and weekly caps on the number of unique links available for
each transaction group and the overall cap on the number of unique links available for each
Campaign category.

14. For the avoidance of doubt and in reference to Clause 13, Eligible Customer(s) performing Eligible
Transaction(s) shall only be entitled to a maximum of one (1) unique link per day for each
transaction group of each Campaign category, and up to the maximum weekly cap of unique links
for each transaction group of the respective Campaign category as indicated in Table B for
subsequent Eligible Transaction(s) performed over different days of the week. For clarity,
illustrations of possible scenarios have been set out below: -

Card(s) shall subject to the same pre-determined daily and weekly caps on the number of unique
links available to each Eligible Customer(s).

16. For Eligible Customer(s) who possess more than one CIMB Participating CASA Account(s), the
Eligible Transaction(s) performed by the him/her across different Participating CASA Account(s)

accounts shall also be subject to the same pre-determined daily and weekly caps on the number
of unique links available to each Eligible Customer(s).

17. The number of Eligible Transaction(s) made by joint or supplementary accountholders will be
combined with the number of Eligible Transaction(s) made by the first named accountholder i.e.
the primary account holder.

18. The number of Qualifying Entries earned by joint or supplementary account holders will be
combined with the number of Qualifying Entries earned by the first named account holder i.e. the
primary account holder.

19. International Eligible Transaction(s) conducted in foreign currency shall be converted to Ringgit
Malaysia (MYR) based on CIMB’s prevailing exchange rate.

20. The Eligible Customer(s) shall ensure that all payments, transfers from or to other foreign currency
accounts within CIMB or other banks are in compliance with prevailing provisions of the Notices on
Foreign Exchange Notice and direction issued by Bank Negara Malaysia pursuant to the Financial
Services Act 2013 and the Islamic Financial Services Act 2013 and shall include any amendments
made thereto.

21. The tracking of the Eligible Transaction(s) performed by Eligible Customer(s) and the delivery of
unique links will be based on the transaction date(s) and time(s) (Malaysian Time) as captured by
CIMB’s transaction records during the Campaign Period.

22. Credit Card/Debit Card

22.1 A successful single credit card Retail Transaction(s) with a minimum transaction value of RM100 or
a successful single debit card Retail Transaction(s) with a minimum transaction value of RM50 shall
be considered as an Eligible Transaction(s) for the purposes of this Campaign. “Retail
Transaction(s)” under the Campaign shall mean any local and/or overseas retail transactions
including but not limited to any online purchases and/or recurring transactions made by an Eligible
Customer(s) that is successfully charged to his/her:

a. CIMB Debit Card (which must be linked to the Eligible Customer(s)’ Participating CASA
Account(s)) and such transaction must be charged to the Eligible Customer(s)’s Participating
CASA Account(s); and/or
b. Participating Credit Card(s)

during the Campaign Period.

22.2 The following transactions are hereby expressly excluded and shall not be treated as Eligible
Transaction(s) for the purposes of this Campaign:

a. Cash withdrawals, or transfers;


b. Any unposted, cancelled, void, disputed, refunded, fraudulent or unauthorised transactions;
c. Quasi Cash and gambling/betting transactions (MCC 7801, MCC 7995, MCC 9754, MCC
6050, MCC 6529, MCC 6530 and MCC 6534);

d. Insurance/takaful transactions (MCC 6300 and MCC 5960); and
e. Cash advance/deposit transactions.

23. CIMB Clicks Transactions (website/mobile application)

23.1 A successful debit of funds from the Eligible Customer(s)’ Participating CASA Account(s) and/or
CIMB Debit Card (which must be linked to the Eligible Customer(s)’ Participating CASA Account(s))
that is duly registered for CIMB Clicks online banking facility for any of the following transactions
via CIMB Clicks (inclusive CIMB Clicks website or CIMB Clicks mobile application) in a single
transaction shall be considered as an Eligible Transaction(s):

a. Foreign Transfers of minimum RM250;


b. DuitNow QR of minimum RM10; and/or
c. Bill payment of minimum RM30.

23.2 “Foreign Transfers” refers to outward Foreign Telegraphic Transfer (FTT) and/or SpeedSend (SS)
transactions made via CIMB Clicks website and/or mobile application that debits funds from Eligible
Customer(s) Participating CASA Account(s) during the Campaign Period.

23.3 “DuitNow QR” refers to payment via the ‘DuitNow QR Scan’ function on the CIMB Clicks mobile
application that are linked to the Eligible Customer(s) CIMB Debit Card (which must be linked to
the Eligible Customer(s)’ Participating CASA Account(s))/Participating CASA Account(s).

23.4 “Bill payment” refers to online bill payments made via CIMB Clicks (either through the CIMB Clicks
website or CIMB Clicks mobile application only) during the Campaign Period. Payments made by
the Eligible Customer(s) at the ‘Pay Bills’ or ‘JomPAY’ section must be made using any of his/her
CIMB Debit Card (which must be linked to the Eligible Customer(s)’ Participating CASA Account(s))
/Participating CASA Account(s). Auto Billing and Financial Process Exchange (“FPX”) transactions
shall not be considered as an Eligible Transaction(s) for the purposes of this Campaign.

24. eGIA

24.1 A successful debit of funds from the Eligible Customer(s)’ Participating CASA Account(s) to his/her
eGIA account for the purposes of investing in a minimum of 1 gram of gold in a single transaction
(the gold price at the point of purchase shall be based on the prevailing gold price to be determined
solely by CIMB) shall be considered as an Eligible Transaction(s). This is applicable for both newly-
opened eGIAs and existing eGIAs.

24.2 “eGIA” refers to the Eligible Customer(s)’ CIMB e-Gold Investment Account, Gold Investment
Account (GIA) and Gold Investment Account via CIMB Clicks (GIA via CIMB Clicks).

24.3 Further particulars of the eGIA:

a. The eGIA is not a principal protected product nor an interest-bearing account. The returns
derived from the eGIA depends on gold price fluctuations and therefore the returns on the
Eligible Customer(s)’ investment in gold shall be uncertain and the Eligible Customer(s) runs
the risk earning no returns and/or the possibility of incurring losses. The Eligible Customer(s)

are advised to read and understand the contents of the CIMB’s e-Gold Investment Account
Agreement and open the eGIA based solely on their own judgement and/or independent advice
obtained. This product is not protected by Perbadanan Insurans Deposit Malaysia (“PIDM”).
b. Any money withdrawn from an insured deposit for the purpose of purchasing gold under eGIA
is no longer protected by PIDM.
c. Eligible Customer(s) are required to sign all relevant standard documents and comply with all
the applicable terms and conditions in respect of their investment in the relevant products under
the Campaign, which are separate from the Terms and Conditions herein.

25. Participating Unit Trust Product(s)

25.1 A successful debit of a minimum of RM1,000 from the Eligible Customer(s)’ Participating CASA
Account(s) to the Eligible Customer(s)’ Unit Trust account (for Participating Unit Trust Product(s)
only) in a single transaction shall be considered as an Eligible Transaction(s). This is applicable for
both additional Unit Trust purchases and new Unit Trust fund purchases made by the Eligible
Customer(s) via CIMB Clicks and/or via CIMB branch.

25.2 “Participating Unit Trust Product(s)” refers to a list of selected Conventional/Shariah-compliant


Unit Trust fund(s) (except all closed-ended fund(s) and Amanah Saham Nasional Berhad
Variable Price Fund(s) which are not eligible) with sales charge as stipulated in the
prospectus/information memorandum and is subject to change from time to time, including all new
Conventional/Shariah-compliant Unit Trust fund(s) which may be launched during the Campaign
Period by CIMB at its sole and absolute discretion.

25.3 Further particulars of the Participating Unit Trust Product(s):

a. The Participating Unit Trust Product(s) is not protected by PIDM. At the point of investment in
selected Unit Trust fund(s), any other offer and/or promotion and/or lower sales charge
advertised by CIMB shall not be applicable. This Campaign is not valid in conjunction with any
offers and promotions (if any) offered by CIMB in relation to investment in selected Unit Trust
fund(s).
b. In the event Eligible Customer(s) exercises his/her cooling-off right or the investment is rejected
or cancelled by any parties for any reason whatsoever within the Campaign Period, the Eligible
Customer(s) shall not be entitled for the Prizes under this Campaign. The “cooling-off” is a
period of six (6) business days from the date of receipt of the Unit Trust application by CIMB.
Unit Trust fund(s) or any money withdrawn from an insured deposit for the purpose of
purchasing any unit in a Unit Trust fund(s) are not protected by PIDM.
c. For the avoidance of doubt, Unit Trust investments made via Employees Provident Fund under
the Member Investment Scheme (EPF-MIS) will not be an Eligible Transaction(s) for the
purposes of this Campaign.
d. Eligible Customer(s) are required to sign all relevant standard documents and comply with all
the applicable terms and conditions in respect of his/her investment in the relevant Unit Trust
products under this Campaign, which are separate from the Terms and Conditions herein.
e. The Participating Unit Trust Product(s) are arranged or offered by CIMB and shall be passed
to or affected by the selected Unit Trust management companies that are Capital Market
Services License holders under the Capital Markets and Services Act 2007 (“CMSA 2007”).

26. Amanah Saham Nasional Berhad (“ASNB”)

26.1 A successful debit of a minimum of RM1,000 from the Eligible Customer(s)’ Participating CASA
Account(s) to his/her ASNB account linked with CIMB Clicks in a single transaction shall be
considered as an Eligible Transaction(s). This is applicable for both additional ASNB investments
made and the subscription of new ASNB investments. Only investments made via CIMB Clicks will
be taken into consideration for the purposes of this Campaign.

26.2 The Eligible Customer(s)’ subscription of ASNB funds via CIMB Clicks shall be subject to his/her
eligible maximum investment limits (ASB and ASB2) and fund availability (ASM 2 Wawasan, ASM,
ASB 3 Didik and ASM3). The latest update on the Eligible Customer(s)’ fund availability status may
be obtained from ASNB’s website.

27. Card-Not-Present (“CNP”) Activation

27.1 A successful activation of the Card-Not-Present (“CNP”) function on the Eligible Customer(s)’ CIMB
Debit Card linked to his/her Participating CASA Account(s) shall be considered as an Eligible
Transaction(s).

27.2 Unique links will only be sent out to the Eligible Customer(s) who have performed the Eligible
Transaction(s) on T+3 days (T = date of successful activation of Card-Not-Present function on
his/her CIMB Debit Card), subject always to the pre-determined daily and weekly caps on the
number of unique links available for each transaction group and the overall cap on the number of
unique links available for each Campaign category as set out at Table B at Clause 11 above.

28. CASA Account Opening

28.1 A successful opening of a new Participating CASA Account(s) by Eligible Customer(s) shall be
considered as an Eligible Transaction(s).

28.2 Unique links will only be sent out to the Eligible Customer(s) who have performed the Eligible
Transaction(s) on T+3 day (T = date of new CASA opening), subject always to the pre-determined
daily and weekly caps on the number of unique links available for each transaction group and the
overall cap on the number of unique links available for each Campaign category as set out at Table
B at Clause 11 above.

29. CIMB Clicks Registration/Mobile Application Activation

29.1 An Eligible Customer(s)’ successful first-time registration for a CIMB Clicks account and/or
activation of CIMB Clicks Mobile Application shall be considered as an Eligible Transaction(s).
Subsequent registration of new CIMB Clicks account and/or activation of CIMB Clicks Mobile
Application on multiple devices will not be considered as an Eligible Transaction(s).

29.2 Unique links will only be sent out to the Eligible Customer(s) who have performed the Eligible
Transaction(s) on T+3 day (T = date of CIMB Clicks Registration/Mobile Application Activation),
subject always to the pre-determined daily and weekly caps on the number of unique links available

for each transaction group and the overall cap on the number of unique links available for each
Campaign category as set out at Table B at Clause 11 above.

30. The Eligible Customer(s) acknowledge and agree that CIMB’s determination as to what constitutes
an Eligible Transaction(s) for the purposes of this Campaign shall be deemed final, binding and
conclusive and such determination shall not be challenged by any party in any manner whatsoever.

Campaign Mechanics

32. Subject to the Terms and Conditions herein, Eligible Customer(s) who successfully perform Eligible
Transaction(s) shall receive a Short Message Service (“SMS”) and/or Clicks Messenger containing
a unique link that is valid until 23:55 hours (GMT+8) of the day immediately subsequent to the day
that the Eligible Customer(s) receives the SMS and/or Clicks Messenger and will thereafter expire.
Eligible Customer(s) stand to win any of the following Daily Prizes by clicking on the unique link
that directs to the Hari-Hari Menang microsite and by following the instructions prompted on-screen
to complete the “Block Challenge”: -

a. Qualifying Entries to enable the Eligible Customer(s) to participate in Grand Prize/Consolation


Prizes selection at the end of Campaign Period; or
b. Daily Cash Prizes.

33. Campaign weekly cycle is defined as starting from Tuesday, 02:00 hours (GMT+8) up until Monday,

34. No SMS and/or Clicks Messenger notification containing unique link will be sent to the Eligible
Customer(s) from Monday, 21:55 hours (GMT+8) to Tuesday, 02:00 hours (GMT+8) of the week.
For the avoidance of doubt, transactions performed by Eligible Customer(s) from Monday, 21:55
hours (GMT+8) to Tuesday, 02:00 hours (GMT+8) will not be recorded or considered as an Eligible
Transaction(s) by CIMB for the purposes of this Campaign and thus no unique link(s) will be sent
for such transactions made.

35. The Campaign operates on CIMB’s real-time logic engine. In the event of a disruption to the
Campaign leading to undelivered unique links, CIMB will send out the recovery unique links on a
best-effort basis, but there is no guarantee that all undelivered unique links will be restored in the
recovery process.

36. The Hari-Hari Menang microsite is managed by CIMB’s appointed panel vendor and Eligible
Customer(s) are advised to use their mobile phone, tablet, desktop or laptop to access the Hari-
Hari Menang microsite.

37. The Qualifying Entries earned from the Eligible Customer(s)’ performance of the Eligible
Transaction(s) will be accumulated and the total Qualifying Entries earned throughout the
Campaign Period shall contribute towards the Eligible Customer(s)’s prospects of winning the
Grand Prize/Consolation Prizes at the end of Campaign Period.

38. CIMB shall track the number of Daily Prizes won by the Eligible Customer(s) throughout the
Campaign Period as follows:

a. Daily Cash Prizes: Totaling up of the amount of Daily Cash Prizes won by each Eligible
Customer(s).
b. Grand Prize/Consolation Prizes: Tabulation of the number of Qualifying Entries earned by
each Eligible Customer(s).

39. The unique links shall only be sent to first named accountholder (i.e., primary account holder) via
SMS and/or Clicks Messenger on their valid mobile number maintained in CIMB’s records. Joint or
supplementary accountholders shall have their unique link(s) redirected to the first named
accountholder (i.e., primary account holder).

40. Eligible Customer(s) shall not manipulate their performance of Eligible Transaction(s) to gain an
excessive amount of unique links, of which the intention to earn entries to participate in the
Campaign is apparent.

41. By participating in this Campaign, Eligible Customer(s) shall be deemed to have agreed to be bound
by these Terms and Conditions.

Winner Selection

42. At the end of Campaign Period, Eligible Customer(s) who have performed Eligible Transaction(s)
and earned Qualifying Entries in accordance with Clause 11 will automatically qualify for the winner
selection process.

43. Grand Prize

a. A total of fifteen (15) Potential Grand Prize Winners will be shortlisted at the end of Campaign
Period (“Potential Grand Prize Winner”) to participate in the Grand Prize Winner selection
stage.

b. The Potential Grand Prize Winners will be contacted by CIMB via telephone at their mobile
number maintained in CIMB’s records within eight (8) weeks from the end of Campaign Period
and shall be required to answer two (2) questions correctly in order to be declared as the Grand
Prize Winner. The first Potential Grand Prize Winner who responds with two (2) correct answers
shall be declared as the “Grand Prize Winner”.

c. If CIMB’s first attempt to contact the Potential Grand Prize Winner fails, due to reasons such
as there being no answer, the Potential Grand Prize Winner’s telephone number is not in
service, the lack of connection or for any other reasons whatsoever, a further two (2) attempts
will be made to call the said Potential Grand Prize Winner at the same mobile number. Where
the third attempt is unsuccessful, such Potential Grand Prize Winner shall be disqualified and
will not be entitled to win the Grand Prize and the next Potential Grand Prize Winner who
answers both questions correctly will be declared as the Grand Prize Winner.

d. In the event that a Potential Grand Prize Winner requests that CIMB returns the call at a later
time, the maximum time frame that the Potential Grand Prize Winner may request for is one
(1) hour later.

e. In the event that all fifteen (15) Potential Grand Prize Winners do not respond with two (2)
correct answers and/or maximum contact attempts have been made by CIMB, resulting in no
Grand Prize Winner, CIMB will perform the processes outlined under Clauses 43 (a – d) for the
second time. The mentioned process will be repeated until a Grand Prize Winner has been
determined.

44. Consolation Prizes

a. The Consolation Prizes under this Campaign shall be divided into three (3) groups as below:

b. Fifty (50) Potential Consolation Prize Winners from Group 1, twenty (20) Potential Consolation

3 will be shortlisted at the end of Campaign Period (“Potential Consolation Prize Winners”)
to participate in the Consolation Prize Winners selection stage. For the avoidance of doubt,
each Eligible Customer(s) shall only be entitled to win a maximum of one (1) Prize under the
Grand Prize or Consolation Prizes category at the end of Campaign Period as stated in Clause
8 above.

c. i. Eligible Customer(s) who only have a Participating CASA Account(s) at the time the
Potential Consolation Prize Winners are selected stand to win only from Group 1 or Group 3.

ii. Eligible Customer(s) who only have Participating Credit Card(s) at the time the Potential
Consolation Prize Winners are selected stand to win only from Group 2 or Group 3.

iii. Eligible Customer(s) who have both a Participating CASA Account(s) and Participating
Credit Card(s) at the time the Potential Consolation Prize Winners are selected stand to win
the Consolation Prize from Group 1, Group 2 or Group 3.

d. The Potential Consolation Prize Winner(s) will be contacted by CIMB via telephone at his/her
mobile number maintained in CIMB’s records within eight (8) weeks from the end of Campaign
Period and shall be required to answer two (2) question correctly in order to be declared as a
“Consolation Prize Winner”. The first five (5) Potential Consolation Prize Winners from Group
1, the first two (2) Potential Consolation Prize Winners from Group 2 and the first two (2)
Potential Consolation Prize Winners from Group 3 who respond with two (2) correct answers
shall be declared as the Consolation Prize Winners.

e. If the first attempt to contact the Potential Consolation Prize Winner fails, due to reasons such
as there being no answer, the Potential Consolation Prize Winner’s telephone number is not in
service, the lack of no connection or for any other reasons whatsoever, a further two (2)
attempts will be made to call the said Potential Consolation Prize Winner at the same mobile
number. Where the third attempt is unsuccessful, such Potential Consolation Prize Winner shall
be disqualified and will not be entitled to win the Consolation Prize and the next Potential
Consolation Prize Winner who answers both questions correctly will be declared as the
Consolation Prize Winner.

f. In the event that a Potential Consolation Prize Winner requests that CIMB returns the call at a
later time, the maximum time frame that the Potential Consolation Prize Winner may request
for is one (1) hour later.

g. In the event that from all the shortlisted Potential Consolation Prize Winners from respective
Consolidation Prizes Group, less than five (5) Potential Consolation Prize Winners from Group
1, less than two (2) Potential Consolation Prize Winners from Group 2 or less than two (2)
Potential Consolation Prize Winners from Group 3 responded with two (2) correct answers
and/or maximum contact attempts have been made by CIMB, resulting in insufficient

Consolation Prize Winners, CIMB will perform the processes outlined under Clauses 44 (a – f)
for the second time. The mentioned process will be repeated until sufficient numbers of
Consolation Prize Winners have been determined.

45. CIMB reserves the right to record these telephone conversations.

46. CIMB shall have the sole discretion to fix the appointed working day (Monday - Friday) and time
(9am - 6pm) to perform the actions under Clause 43-44. CIMB shall not be held responsible for any
incomplete, disconnected or unanswered SMS or Clicks Messenger or calls sent or made to the
Potential Grand Prize Winners or Potential Consolation Prize Winners where such incomplete,
disconnected or unanswered SMS or Clicks Messenger or calls were caused by the unavailability
of the Potential Grand Prize Winners or Potential Consolation Prize Winners at the appointed date
and time and/or due to any other whatsoever reasons.

47. The question and answer will be judged and decided upon by a panel of judges selected by CIMB
and the decision of the panel of judges shall be final and binding.

48. The Eligible Customer(s) are responsible for ensuring that their mobile numbers and email address
provided are current and updated with CIMB. CIMB shall not be responsible to the Eligible
Customer(s) for any loss or damage (including any loss of opportunity and consequential loss
flowing there from) suffered, including the loss due to any failure to fulfil the crediting of the Prizes,
if their mobile numbers and/or email address in CIMB’s record are not contactable, current or
updated.

Prize Fulfilment

49. The Grand Prize/Consolation Prizes shall be credited into the Grand Prize Winner’s and/or
Consolation Prize Winners’ Participating CASA Account(s) with the highest month end balance or
Participating Credit Card(s) account with the highest spend amount within eight (8) weeks after the
end of the Campaign Period. Prizes will be credited into the Grand Prize Winner’s and/or
Consolation Prize Winners’ Participating CASA Account(s) if the Grand Prize Winner and/or
Consolation Prize Winners have a Participating CASA Account(s) and a Participating Credit
Card(s).

50. The Daily Cash Prizes shall be credited into the Eligible Customer(s)’ Participating CASA
Account(s) with the highest month end balance or Participating Credit Card(s) account with the
highest spend amount within eight (8) weeks from the winning date. The Daily Cash Prize will be
credited into the Eligible Customer(s)’ Participating CASA Account(s) if he/she has a Participating
CASA Account(s) and a Participating Credit Card(s).

51. CIMB will not entertain any request from the Grand Prize Winner/Consolation Prize
Winners/Eligible Customer(s) who have won the Daily Cash Prize (collectively referred to as the
“Winners”) to credit their Prizes to their other CIMB accounts or any other accounts maintained
with other financial institutions or any third party’s accounts.

52. The Eligible Customer(s) agree that by participating in the Campaign, they:

a. have accessed, read and confirm their agreement to these Terms and Conditions;
b. consent to CIMB processing and disclosing their personal data in accordance with the CIMB
Group Privacy Notice at www.cimb.com.my;
c. agree that all decisions fairly and reasonably made by CIMB in relation to every aspect of this
Campaign, including the Prizes to be given away and determination of the Campaign winners,
shall be final, binding and conclusive; and
d. agree that CIMB shall not be liable or held responsible to the Eligible Customer(s) if CIMB is
unable to perform in whole or in part of any of its obligations in these Terms and Conditions
attributable directly or indirectly to:

i. the failure of any mechanical or electronic device, data processing system or


transmission line;
ii. electrical failure;
iii. industrial dispute, war, strike or riot;
iv. any act of God beyond CIMB 's control; or
v. any factor in a nature of a force majeure which is beyond CIMB’s reasonable control.

53. The Eligible Customer(s) will be disqualified from participating in the Campaign and the Grand
Prize, Daily Cash Prizes and/or Consolation Prizes will be forfeited if, during the Campaign Period
and/or before the crediting/delivery of Grand Prize, Daily Cash Prizes and/or Consolation Prizes:

a. the Eligible Customer(s) are in breach of the terms and conditions governing the Participating
CASA Account(s) and/or the Participating Credit Card(s);
b. the Participating CASA Account(s) and/or the Participating Credit Card(s) of the Eligible
Customer(s) has been terminated or dormant or closed or be made subject to any attachment,
adverse orders made by the Court or any authorities sanctioned by laws; or
c. the Participating CASA Account(s) and/or the Participating Credit Card(s) are delinquent,
invalid or cancelled by the Eligible Customer(s) or CIMB.

54. CIMB shall have the right to disqualify any Eligible Customer(s) that is determined to be:

a. tampering with the Qualifying Entries; and/or


b. acting in breach of these Terms and Conditions.

55. CIMB shall have the right to:

a. substitute the Prizes with other item(s) of similar cost; and/or


b. extend, shorten, discontinue, cancel, terminate or suspend the Campaign

by giving seven (7) calendar days’ prior notice to the Eligible Customer(s) via:

i. announcement at CIMB’s website; and/or


ii. notice at CIMB’s branches; and/or
iii. by any other means of notification which CIMB may select.

56. For avoidance of doubt, CIMB shall not be liable to the Eligible Customer(s) for any losses,
damages, costs or expenses as may be suffered or incurred by the Eligible Customer(s) as a direct
or indirect result of any Prizes and/or any cancellation, suspension, shortening or extension of the
Campaign.

57. CIMB shall not be liable to any Eligible Customer(s) or any party for any loss or damage (including
but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential,
exemplary, punitive or special damages) resulting from:

a. the Eligible Customer(s)’ participation or non-participation in the Campaign; and/or


b. any non-receipt or delayed receipt by the Eligible Customer(s) of the unique link SMS and/or
Clicks Messenger

unless such loss or damage arises from and is caused directly by CIMB’s gross negligence or wilful
default.

58. a. CIMB shall have right to vary, add, delete, or amend any of these Terms and Conditions
(“Amendment”) by giving twenty-one (21) calendar days’ prior notice to the Eligible Customer(s)
via:

i. announcement at CIMB’s website; and/or


ii. notice at CIMB’s branches; and/or
iii. advertisement in one newspaper of CIMB’s choice; and/or
iv. by any other means of notification which CIMB may select.

b. The Amendment shall be considered as binding on the Eligible Customer(s) from the date as
specified by CIMB in the notification.

c. Eligible Customer(s) agree to access CIMB’s website at regular intervals to view the Terms and
Conditions of the Campaign and to ensure that they are kept up-to date with any variation to these
Terms and Conditions.

59. CIMB will not be liable to the Eligible Customer(s) for any loss or damage suffered or incurred by
the Eligible Customer(s) as a direct or an indirect result of the Amendment.

60. The Eligible Customer(s) shall fully indemnify and keep CIMB indemnified against any fee, cost,
charge, expense, loss, damage or liability which CIMB may incur as a result of:

a. the Eligible Customer(s)’ participation in the Campaign; and/or


b. the Eligible Customer(s)’ receipt, redemption or use of the Prizes.

61. These Terms and Conditions:

a. shall prevail over any provisions or representations contained in any other materials advertising
the Campaign; and
b. are to be read together with the prevailing terms and conditions of the Participating CASA
Account(s) and/or the Participating Credit Card(s) and/or relevant CIMB products and/or CIMB
Clicks Internet Banking Agreement which shall apply in addition to these Terms and Conditions.

62. These Terms and Conditions shall be subject to any prevailing laws, regulations and guidelines,
directives, notices issued by Bank Negara Malaysia or any other body having supervisory authority
over CIMB from time to time.

63. a. The Winner is solely responsible to ensure his/her phone number and/or email address and/or
mailing address (“Contact Details”) given to CIMB is/are current and updated.

b. CIMB shall have the right to forfeit the Grand Prize, Daily Cash Prizes, and/or Consolation Prizes
if the Winners’ Contact Details maintained in the CIMB’s record are invalid and/or not updated.

c. CIMB shall not be responsible to the Winner for any loss (including loss of opportunity and
consequential loss arising therefrom) and damage suffered or incurred if the Contact Details
maintained in CIMB’s record are not current or correct.

64. The Eligible Customer(s) shall be solely responsible for the following as a result of receipt of the
Grand Prize, Daily Cash Prizes, and/or Consolation Prizes:

a. any tax filing obligation or any tax payment due to any authority; and
b. to seek independent advice on the possible implications on his/her own financial situation.

65. CIMB shall have the right to forfeit the Grand Prize, Daily Cash Prizes, and/or Consolation Prizes
and select another Winner if the Winner fails to attend the prize-giving ceremony and/or participate
other related events required by CIMB.

66. a) By participating in the Campaign, the Winner authorises CIMB to publish and/or display materials
and/or information, including but not limited to the name, photos and city of residence of the Winner
without compensation for advertising and publicity purposes in the manner it deems appropriate
(“Publication Rights”).

b) If the Winner objects to CIMB’s Publication Rights after participating in the Campaign, CIMB
shall have the right to forfeit the Daily Cash Prizes, Grand Prize and/or Consolation Prizes and
select another Winner.

67. Any query, feedback, concern, issue or complaint by the Eligible Customer(s) pertaining to the
Eligible Customer(s)’ accounts under CIMB Islamic Bank shall be directed to CIMB Islamic Bank
and CIMB Bank shall not be responsible for any matter relating to the Eligible Customer(s)’
accounts under CIMB Islamic Bank.

68. a. Eligible Customer(s) may contact CIMB’s Customer Resolution Unit (“CRU”) for any feedback
and/or complaint in relation to this Campaign via letter, phone call and email:
